ui-draggable-handle\"\/><\/p>\n<p>The Ethics and Anti-Corruption Commission has recommended the suspension of National Government Affirmative Action Fund (NGAAF) CEO Roy Sasaka Telewa, even as the Employment and Labour Relations Court issued temporary orders stopping any move to remove him from office.<\/p>\n<p>In a letter dated January 12, 2026, and addressed to Gender CS Hanna Wendot,&#13;<br \/>\nthe commission is conducting investigations related to the CEO&#8217;s wealth and other&#13;<br \/>\nissues touching on financial administration.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe Commission said the investigations are being conducted under the&#13;<br \/>\nAnti-Corruption and Economic Crimes Act 2003, the Proceeds of Crime and&#13;<br \/>\nAnti-Money Laundering Act 2009 and the Public Procurement and Asset Disposal&#13;<br \/>\nAct 2015.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nAccording to the letter signed by EACC CEO Abdi Mohamud, the agency&#13;<br \/>\nconducted searches on January 8 at Telewa\u2019s residence and office pursuant to a&#13;<br \/>\ncourt-issued warrant. <\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe Commission claimed that \u201cseveral documents and information&#13;<br \/>\nwere recovered\u201d during the operation.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe EACC said the nature of the allegations and the ongoing inquiry warrant the temporary removal of the CEO from office.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\n\u201cWe recommend that the&#13;<br \/>\nabove-named officer be suspended from office for a period of six months,\u201d the&#13;<br \/>\nletter stated.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe Commission cited various legal provisions supporting its recommendation,&#13;<br \/>\nincluding Section 42(7) of the Leadership and Integrity Act 2012, which allows&#13;<br \/>\nthe suspension of a state officer where such action is considered necessary&#13;<br \/>\npending the determination of allegations.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe letter further referenced Regulation 25 of the Leadership and Integrity&#13;<br \/>\nRegulations 2015, which permits suspension once the Commission has initiated&#13;<br \/>\ninvestigations and made such a recommendation. <\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nRegulation 25(3) provides that an officer under suspension shall be on half pay&#13;<br \/>\nwhile investigations continue.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe EACC also highlighted provisions of the Public Service Code of Conduct&#13;<br \/>\nand Ethics 2016, specifically Section 36(6), which states that a public officer&#13;<br \/>\nfacing allegations may be suspended while an inquiry is underway. <\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe agency noted that it has powers under Section 4(4) of the Leadership and&#13;<br \/>\nIntegrity Act to require public entities to take necessary actions to enforce&#13;<br \/>\ncompliance with ethical and leadership standards. <\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\n\u201cThe Commission is empowered\u2026 to require public entities to carry out such&#13;<br \/>\nfunctions and exercise such powers as may be necessary to enforce compliance&#13;<br \/>\nwith the leadership and integrity requirements,\u201d the letter stated.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe recommendation places responsibility on the Ministry of Gender, Culture&#13;<br \/>\nand Children Services, under which NGAAF falls, to act on the proposal. <\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe Commission said it would notify the ministry once the inquiry is&#13;<br \/>\nconcluded. <\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe letter was copied to the Chief of Staff and Head of Public Service Felix&#13;<br \/>\nKoskei, and the Chairperson of the NGAAF Board.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nHowever, a day after the EACC\u2019s letter, the ELRC issued conservatory orders&#13;<br \/>\nthat temporarily halted any attempt to suspend or remove Telewa from his&#13;<br \/>\nposition.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe orders, issued on January 13, 2026, by Lady&#13;<br \/>\nJustice Jemimah Wanza Keli, arose from a Notice of Motion dated January 12,&#13;<br \/>\nfiled by Telewa against the NGAAF Board, the Cabinet Secretary for Gender and&#13;<br \/>\nAffirmative Action, and two other respondents.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe court certified the application as urgent&#13;<br \/>\nand restrained the respondents from convening or proceeding with a Board&#13;<br \/>\nmeeting scheduled for January 13, or any other meeting \u201cin furtherance of the&#13;<br \/>\nimpugned process,\u201d pending the hearing of the application.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\n\u201cThat pending the hearing of this Application and the court is further&#13;<br \/>\npleased to issue a temporary conservatory order restraining the Respondents&#13;<br \/>\nwhether by themselves, their agents, servants or any person acting under their&#13;<br \/>\nauthority, from suspending, removing, terminating or purporting to terminate&#13;<br \/>\nthe Petitioner\u2019s contract of service; convening, directing, influencing or&#13;<br \/>\nacting upon any Board meeting or process aimed at his removal; appointing or&#13;<br \/>\nretaining any person in an acting or substantive capacity as CEO of NGAAF; or&#13;<br \/>\nin any other manner interfering with the Applicant\u2019s lawful tenure and&#13;<br \/>\nfunctions as CEO,\u201d Justice Keli ordered. <\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe orders were issued pending the hearing of&#13;<br \/>\nthe application inter partes on January 21, 2026.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe court directed that the application be&#13;<br \/>\nserved for response within seven days and issued a penal notice warning that&#13;<br \/>\ndisobedience of the orders would result in consequences for those involved.<\/p>\n","protected":false},"excerpt":{"rendered":"The Ethics and
