{"id":324052,"date":"2026-07-09T17:04:22","date_gmt":"2026-07-09T17:04:22","guid":{"rendered":"https:\/\/www.europesays.com\/africa\/324052\/"},"modified":"2026-07-09T17:04:22","modified_gmt":"2026-07-09T17:04:22","slug":"lawyer-ndegwa-njiru-released-hints-at-challenging-his-unlawful-arrest-and-detention","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/africa\/324052\/","title":{"rendered":"Lawyer Ndegwa Njiru released, hints at challenging his &#8216;unlawful arrest and detention&#8217;"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/africa\/wp-content\/uploads\/2026\/07\/a56aefc1-f3e0-4c8e-91ff-aa72e17aff7e.webp\" style=\"max-width: 100%; width: 100%;\"\/>Lawyer Ndegwa Njiru among other suspects present in court over alleged traffic charge at Milimani law courts, Nairobi on July 9, 2026\/LEAH MUKANGAI<\/p>\n<p>Lawyer Ndegwa Njiru was on Thursday freed after an alleged traffic-related charge against him failed to proceed in court following the Office&#13;<br \/>\nof the Director of Public Prosecutions&#8217; (ODPP) decision not to approve the&#13;<br \/>\ncharges.<\/p>\n<p>Njiru had been arrested earlier on Thursday morning, but the prosecution informed him and his lawyers that no&#13;<br \/>\ncharges had been preferred against him.<\/p>\n<p>His release came hours after he was presented before the&#13;<br \/>\nMilimani Law Courts, where he had been expected to answer to the alleged&#13;<br \/>\noffence.<\/p>\n<p>Speaking at Milimani Law Court after his release, Njiru&#13;<br \/>\nmaintained that he would not be intimidated despite his arrest.<\/p>\n<p>&#8220;We are not going to allow fear to enslave us. We will&#13;<br \/>\novercome our fear,&#8221; he said.<\/p>\n<p>Njiru was represented by a legal team comprising senior&#13;<br \/>\nadvocates Nelson Havi, Kibe Mungai and Vincent Lempaa, who argued that his&#13;<br \/>\narrest and continued detention had no legal basis because the ODPP had not&#13;<br \/>\napproved any criminal charge against him.<\/p>\n<p>According to the lawyers, prosecutors confirmed that no&#13;<br \/>\nobstruction charge had been sanctioned, effectively bringing the intended&#13;<br \/>\nprosecution to an end before a plea could be taken.<\/p>\n<p>The defence maintained that Njiru&#8217;s constitutional rights&#13;<br \/>\nand fundamental freedoms had been violated by his arrest and detention, arguing&#13;<br \/>\nthat police could not lawfully continue holding him in custody without an&#13;<br \/>\napproved charge.<\/p>\n<p>Following his release, Njiru hinted at moving to the High&#13;<br \/>\nCourt to seek legal redress over what he termed an unlawful arrest and&#13;<br \/>\ndetention.<\/p>\n<p>Counsel Nelson Havi commended the team of lawyers who stood&#13;<br \/>\nby Njiru in the court precincts.<\/p>\n<p>Njiru had earlier dismissed allegations linking him to&#13;<br \/>\nalcohol consumption, insisting he has never consumed alcohol and describing the&#13;<br \/>\naccusations against him as baseless.<\/p>\n<p>The lawyer confirmed his arrest through a statement on his&#13;<br \/>\nsocial media pages on Wednesday evening, claiming he was detained after his&#13;<br \/>\nvehicle developed mechanical problems on the busy highway.<\/p>\n<p>\u201cI have been arrested by the Kasarani police. I am at&#13;<br \/>\nKasarani station.
