Former Sports Principal Secretary Ambassador Peter Kirimi Kaberia is among 10 people the Office of the Director of Public Prosecutions (ODPP) has approved for prosecution over alleged irregularities in the use of Sh330 million allocated for Kenya\u2019s preparations to host the 2018 Africa Nations Championship (CHAN).<\/p>\n
The ODPP has approved charges against Kaberia, four other former Ministry of Sports officials and five private-sector businessmen following investigations by the Ethics and Anti-Corruption Commission (EACC).<\/p>\n
Six companies have also been listed for prosecution in connection with the case.<\/p>\n
The suspects will have an opportunity to respond to the allegations in court and are presumed innocent unless and until proven guilty.<\/p>\n
The charges follow the EACC\u2019s investigations, after which the commission submitted its inquiry file to the ODPP for review and guidance.<\/p>\n
The DPP said it had independently and thoroughly evaluated the evidence and determined that there were sufficient grounds to prosecute the suspects and companies involved.<\/p>\n
Those approved for prosecution include Kaberia, former Senior Principal Finance Officer Stephen Njoroge Muthuma, former Director of Administration Harun Chebet Komen, former Principal Accountant Enock Ondwari Onditi and former Senior Superintendent Engineer John Kiende Ruga.<\/p>\n
The other individuals are Marcos Gonzalez Puente, director of Auditel Kenya; Samuel Mbaa Njoroge, director of Taxwise Consulting Limited; Kitheka Muema, director of Restea Enterprises Limited; Anthony Mwangi Kimanthi, director of Lease Pride Limited; and Ephrahim Kinyua Muchangi, director of Leasepath Limited.<\/p>\n
The companies listed in the case are Auditel Kenya, Taxwise Consulting Limited, Restea Enterprises Limited, Lease Pride Limited, Leasepath Limited and Liroma Assurance.<\/p>\n
According to the ODPP, the suspects and entities will face charges including abuse of office, unlawful acquisition of public property, failure to comply with procurement laws, acquisition of proceeds of crime and financial misconduct.<\/p>\n
The case relates to a Sh1.5 billion contract awarded by the State Department for Sports Development in 2017 as Kenya prepared to host CHAN.<\/p>\n
The contract was for the design, supply, installation and commissioning of security systems, pitch lighting and audio-visual networks at various stadiums.<\/p>\n
The EACC investigation, as outlined in its recovery proceedings, alleges that the procurement process was single-sourced and that required procurement procedures were not followed.<\/p>\n
The commission also alleges that the Sh330 million payment was made in connection with the contract without the required milestone completion certificate.<\/p>\n
The alleged irregularities form part of investigations into the use of funds allocated for Kenya\u2019s preparations for the tournament.<\/p>\n
CHAN was scheduled to be hosted by Kenya in 2018, although the country was later stripped of the hosting rights after failing to meet the requirements to stage the tournament.<\/p>\n
The ODPP said its decision followed an independent evaluation of the evidence contained in the inquiry file submitted by the EACC.<\/p>\n
