While artificial intelligence (AI) is being introduced to R&D sites nationwide, it has been argued that poor AI products should be prevented from spreading into patents in advance. The industry calls this a ‘garbage-in, pattern-out’ phenomenon. AI R&D speed war is also important, but it is suggested that there is an urgent need for a practical device to filter out insolvent patents and select real innovations.
Park Sung-pil, president of the Graduate School of Science and Future Strategy at the Korea Advanced Institute of Science and Technology (KAIST), said, “The R&D paradigm is rapidly changing to focus on AI-assisted inventions, with Son Jeong-ui, chairman of Softbank applying for more than 1,000 patents with AI and the government’s K-Moonshot project operating,” adding, “If AI’s poor products are indiscriminately poured into patents by focusing on maximizing productivity, trust in the entire patent system could collapse.” The pan-national ‘K-Moonshot Project’ aims to double the productivity of science and technology research by utilizing AI by 2030.
The event was hosted by the Ministry of Intellectual Property and organized by the Korea Institute of Engineering. Last month, the Ministry of Land, Infrastructure and Transport distributed the ‘Right Patent Application Guide in the AI Era’. When using AI, the main point is that it can be recognized as a patent only when a person’s actual contribution is demonstrated through a “research note” or an “inventor confirmation letter.”
Professor Park warned that simply leaving a prompt input record can be a data that acknowledges that there is no real contribution from a person. He stressed that to prove practical contributions, it can be recognized as an independent design that has been tested only when key evidence such as ▲ history of changes in parameters and design values modified by the researcher after ▲AI output is left in the research note ▲ experimental verification data ▲ filtering logic that selected and excluded specific candidates and evidence ▲ timing of judgment.
Director Park urged the establishment of standard guidelines that contain such specific levels of description. “If the use of AI tools is standardized and the level of ordinary technicians, which is the standard for patent examination, is raised, solutions that were not known in the past may be devalued as self-evident technology, making it difficult to obtain patents,” he said. “We need to hurry to invest in documents and prepare for responses such as mandatory research notes to prevent innovation from falling.”
LG AI Research Institute President Lim Woo-hyung, Hanyang University Professor Lee Sang-wook, and Kakao AI Safety Leader Kim Kyung-hoon participated in the panel discussion to discuss ways to reform the patent system to secure the author’s qualification and human intellectual subjectivity in the AI era. They said, “AI is an invention tool to the end,” adding, “The patent system should change its paradigm to precisely distinguish between real innovation and self-evident inventions rather than simply increasing the amount of invention protection.”
Meanwhile, more than 100 leaders in the engineering and technology sector, including government officials and members of the Korea Institute of Engineering, CEOs, CTOs, CIPOs, university presidents, and heads of government-funded research institutes, attended the forum.
