Anthropic Class Action Lawsuit: Claude Max Usage Misrepresentation Allegations - News and Statistics

A proposed class action has been filed against Anthropic, accusing the artificial intelligence firm of deceiving customers regarding the usage allowances tied to its premium Claude Max subscription tiers.

The legal complaint, submitted on June 14 in the U.S. District Court for the Northern District of California by user Karl Kahn, aims to represent all Claude subscribers who bought the company’s Max plans. It asserts that Anthropic misrepresented the extent of usage provided under these higher-tier subscriptions.

According to the filing, Kahn initially signed up for Claude Pro in June 2025, later moving to the Max 5x tier in January and the Max 20x tier in April of the current year. He claims he paid too much for both upgraded plans, received less service than what was advertised, and occasionally bought extra usage after hitting his plan’s caps.

Kati Daffan, a founding partner at Vaca Daffan LLP and Kahn’s attorney, stated that the case rests on well-established consumer protection statutes that forbid businesses from misleading buyers about their offerings. Daffan noted that the law requires companies to be truthful in their promotions, and failure to do so can result in liability, mandated changes in business practices, and customer refunds. She added that such civil actions are routinely filed against firms that misrepresent aspects of their goods or services.

Anthropic provides multiple subscription options for individual users, starting with a no-cost tier offering restricted access and moving up to the paid Pro and Max levels. The Pro plan is priced at $20 per month or $200 annually, designed for typical users, while the Max tier targets those with heavier Claude usage. The Max 5x subscription costs $100 monthly and is advertised as delivering five times the Pro plan’s usage capacity per session. The Max 20x plan, at $200 per month, is promoted as offering 20 times that capacity. Anthropic also says Max subscribers get early access to new models and features, use of Claude Code, and elevated usage thresholds intended to minimize disruptions during extended tasks.

The lawsuit contends that Anthropic failed to transparently define how usage was calculated, leaving subscribers unable to confirm if they were getting the promised level of access under the Max plans. Daffan suggested that this opacity might explain why no comparable lawsuits had emerged earlier, as consumers lacked the data needed to assess whether they were receiving the advertised service quality.
