{"id":101267,"date":"2026-07-10T05:32:35","date_gmt":"2026-07-10T05:32:35","guid":{"rendered":"https:\/\/www.europesays.com\/ai\/101267\/"},"modified":"2026-07-10T05:32:35","modified_gmt":"2026-07-10T05:32:35","slug":"the-denver-post-seeks-serious-sanctions-against-openai-in-lawsuit","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ai\/101267\/","title":{"rendered":"The Denver Post seeks \u2018serious sanctions\u2019 against OpenAI in lawsuit"},"content":{"rendered":"<p>The Denver Post, The New York Times and other media outlets are asking for \u201cserious sanctions\u201d against OpenAI, saying the company <a href=\"https:\/\/www.denverpost.com\/2026\/01\/07\/ny-daily-news-other-papers-seek-sanctions-over-allegations-open-ai-deleted-key-evidence\/\" rel=\"nofollow noopener\" target=\"_blank\">destroyed evidence and intentionally hid its ability to locate stolen news stories<\/a> in training data and responses to ChatGPT users, according to a new motion filed Thursday.<\/p>\n<p>The motion, filed in Manhattan Federal Court as <a href=\"https:\/\/www.nj.com\/news\/2026\/07\/newspapers-take-on-ai-giants-in-court-warn-of-death-knell-for-local-journalism.html\" rel=\"nofollow noopener\" target=\"_blank\">part of an ongoing copyright infringement suit<\/a>, said Open AI expert John Vincent \u201cVinnie\u201d Monaco \u201cfinally revealed\u201d in an April deposition that the company had engaged in a campaign of deception throughout the lawsuit, including by severely misrepresenting technological capabilities and destroying millions of chat histories.<\/p>\n<p>What precise admissions Monaco made were redacted from Thursday\u2019s filing. But lawyers said the disclosure upended the company\u2019s repeated claims \u2014 to both the news organizations and the court \u2014 that\u00a0<a href=\"https:\/\/www.dailynews.com\/2025\/11\/26\/8-more-newspapers-sue-openai-microsoft-alleging-stolen-content-used-in-ai-apps\/\" rel=\"nofollow noopener\" target=\"_blank\">OpenAI was unable to search its datasets for instances of stolen journalism<\/a>.\u00a0OpenAI\u2019s alleged theft and reproduction of journalists\u2019 work is central to the lawsuit, which also names Microsoft as a defendant.<\/p>\n<p>\u201cFor two years, OpenAI has been making misrepresentations to the court regarding its ability to search for Daily News content in its training datasets and output logs \u2013 key evidence concerning OpenAI\u2019s theft of copyrighted content,\u201d said Steven Lieberman, who represents The Post and affiliated papers in MediaNews Group and Tribune Publishing.<\/p>\n<p>\u201cThis motion asks the court to punish OpenAI for hiding and destroying evidence showing how ChatGPT was trained on stolen journalism.\u201d<\/p>\n<p><a href=\"https:\/\/www.nytimes.com\/2026\/06\/25\/technology\/times-lawsuit-openai-microsoft.html\" rel=\"nofollow noopener\" target=\"_blank\">The Post and other plaintiffs<\/a> are seeking unspecified monetary sanctions, special jury instructions and other measures.<\/p>\n<p>The motion alleges that <a href=\"https:\/\/hls.harvard.edu\/today\/does-chatgpt-violate-new-york-times-copyrights\/\" rel=\"nofollow noopener\" target=\"_blank\">OpenAI \u201cwithheld highly relevant evidence<\/a>, prolonged discovery, inflated expenses, and burdened the Court. And not inadvertently: its corporate representative and at least one of its outside counsel knew.\u201d<\/p>\n<p>The companies\u2019 deception was occurring as\u00a0<a href=\"https:\/\/www.npr.org\/2025\/03\/26\/nx-s1-5288157\/new-york-times-openai-copyright-case-goes-forward\" rel=\"nofollow noopener\" target=\"_blank\">OpenAI was arguing the news outlets were invading the privacy of ChatGPT users<\/a>\u00a0and publicly claiming that any stolen news stories the chatbot spouted were the result of \u201ca rare bug,\u201d court filings detail.<\/p>\n<p>In a statement, OpenAI brushed off the allegations.<\/p>\n<p>\u201cAs the Times\u2019 case weakens and they\u2019ve been forced to drop claims against us, they\u2019re persisting with their efforts to invade the privacy of people who have nothing to do with this case, including by making these blatantly false allegations. We\u2019ll continue defending our users\u2019 privacy and the long-established principles of fair use,\u201d the company\u2019s statement read.<\/p>\n<p>Manhattan Magistrate Judge Ona Wang took seriously the privacy concerns of ChatGPT users, previously ordering multiple layers of protection and ensuring any information exchanged was anonymized.<\/p>\n<p>In the lawsuit, the news organizations allege <a href=\"https:\/\/www.nydailynews.com\/2026\/06\/26\/daily-news-other-outlets-allege-microsoft-urged-open-ai-to-steal-journalists-work\/\" rel=\"nofollow noopener\" target=\"_blank\">OpenAI is stealing and distorting their copyrighted works<\/a>, inhibiting their ability to sell their original journalism while also providing ChatGPT users with reporting that\u2019s often inaccurate. They have been joined by the Authors Guild, and a litany of best-selling writers are also parties in the complex litigation. OpenAI has admitted a growing number of readers are turning to ChatGPT for news, rather than directly to the journalists who gather it.<\/p>\n<p>Earlier this year, Open AI put forward Monaco as the go-to authority on all matters relating to Project Giraffe, an internal operation purportedly designed to limit large language models, or LLMs, from regurgitating copyrighted works. Judge Wang found in January that he was horribly unprepared for his first deposition, unable to answer basic questions, and ordered him to sit for another in April.<\/p>\n<p>Lawyers for the news organizations said the truth came out when they got another shot.<\/p>\n<p>\u201cThis is a case about copying. There is no question that it happened. Nor should there be one about what was copied, how often, or to what end. The evidence is in OpenAI\u2019s training datasets and ChatGPT output logs. But instead of just producing that evidence at the start of the case and focusing on the merits of its fair use defense, OpenAI chose obstruction,\u201d the motion says.<\/p>\n<p>\u201cOnly a compelled re-deposition of an ill-prepared witness exposed the facts.\u201d<\/p>\n<p>Lawyers and investigators for the news organizations were required to perform a taxing process of piecing together over 80 million responses from ChatGPT users and other evidence related to Project Giraffe, according to Thursday\u2019s filing.<\/p>\n<p>The news organizations are asking that the jurors who ultimately decide the case be made aware that OpenAI deleted billions of ChatGPT responses, in violation of the judge\u2019s orders to preserve data.
