No, not the <a href=\"https:\/\/socialists.nyc\/zohran-mayor-nyc-dsa\/\" rel=\"nofollow noopener\" target=\"_blank\">Mamdani DSA<\/a>, the other DSA, the EU\u2019s Digital Services Act, Europe\u2019s legal framework for regulating the tech industry, which is also arguably the entire world\u2019s <a href=\"https:\/\/cjil.uchicago.edu\/print-archive\/digital-services-act-and-brussels-effect-platform-content-moderation\" rel=\"nofollow noopener\" target=\"_blank\">de facto legal framework for regulating the tech industry<\/a>.<\/p>\n<p data-component=\"paragraph\">The targets today: Roblox, the gaming sandbox and online space where kids can interact, and where, perhaps too often, <a href=\"https:\/\/www.bloomberg.com\/features\/2024-roblox-pedophile-problem\/\" rel=\"nofollow noopener\" target=\"_blank\">adults can interact with kids<\/a>, along with ChatGPT, the AI chatbot your landlord now uses to write you 1,000-word emails that paraphrase Immanuel Kant when they could just say \u201cDon\u2019t leave extension cords on the driveway. -Jeff.\u201d<\/p>\n<p data-component=\"paragraph\">The EU\u2019s executive arm is preparing to designate ChatGPT and Roblox as \u201cvery large online platforms,\u201d <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2026-07-29\/chatgpt-roblox-to-fall-under-strictest-eu-rules-for-platforms\" rel=\"nofollow noopener\" target=\"_blank\">according to an anonymously sourced Bloomberg report<\/a>. If you\u2019re a tech platform, this label may sound like a cool trophy, but it\u2019s actually an anchor around your neck because it exposes you to the top level of EU regulations and scrutiny.<\/p>\n<p data-component=\"paragraph\">The threshold to be considered for the designation is 45 million EU-based monthly users, and <a href=\"https:\/\/eaccny.com\/news\/chapternews\/digital-services-act-eu-commission-designates-first-set-of-very-large-online-platforms-and-search-engines\/\" rel=\"nofollow noopener\" target=\"_blank\">other members<\/a> of the very large online platform club include the Amazon Store, TikTok, Wikipedia, YouTube, Facebook, Instagram, LinkedIn, and of course Zalando (<a href=\"https:\/\/www.zalando.com\/\" rel=\"nofollow noopener\" target=\"_blank\">It\u2019s European<\/a>).<\/p>\n<p>So now, according to Bloomberg\u2019s anonymous sources, Roblox and ChatGPT parent OpenAI could be subject to penalties for not policing for illegal and harmful content per the DSA\u2019s definition, and they will soon have to write up plans for \u201crisk mitigation\u201d and compile transparency reports.<\/p>\n<p>  Perhaps the most irritating part for the platforms: they have to pay a \u201csupervisory fee.\u201d According to the <a href=\"https:\/\/eur-lex.europa.eu\/EN\/legal-content\/summary\/digital-services-act-supervisory-fees-on-providers-of-very-large-online-platforms-and-search-engines.html\" rel=\"nofollow noopener\" target=\"_blank\">text of the law<\/a>:  <\/p>\n<p>\u201cFees per service are calculated using a mathematical formula that takes into account the service\u2019s number of users. The fee may not be greater than 0.05% of the service provider\u2019s worldwide profit in the preceding financial year.\u201d<\/p>\n<p class=\"ArticleBodyText_articleBodyContent__17wqE typography_articleBody___5jDr paywall\" data-component=\"paragraph\">Bloomberg reached out to the European Commission, OpenAI and Roblox. The commission declined, and OpenAI and Roblox didn\u2019t answer the requests.<\/p>\n<p data-component=\"paragraph\">The DSA is perhaps most famous in the U.S. for coming into effect in 2022 and almost immediately clashing with Elon Musk amid his Twitter (later X) takeover around the same time. DSA regulators were informally inaugurated as the world\u2019s platform cops in 2023 when the EU <a href=\"https:\/\/www.nytimes.com\/2023\/12\/18\/technology\/x-twitter-european-union-investigation.html\" rel=\"nofollow noopener\" target=\"_blank\">went after X<\/a> for failing to moderate types of content the DSA doesn\u2019t tolerate, and for having design elements thought to be deceptive. X was eventually hit with a <a href=\"https:\/\/thehill.com\/policy\/technology\/5749310-elon-musk-x-appeals-eu-fine\/\" rel=\"nofollow noopener\" target=\"_blank\">$140 million fine, but appeals are ongoing<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"The DSA has struck again and corporations are trembling.
