{"id":13131,"date":"2026-04-22T22:17:14","date_gmt":"2026-04-22T22:17:14","guid":{"rendered":"https:\/\/www.europesays.com\/ai\/13131\/"},"modified":"2026-04-22T22:17:14","modified_gmt":"2026-04-22T22:17:14","slug":"florida-attorney-general-issues-subpoenas-in-openai-criminal-probe","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ai\/13131\/","title":{"rendered":"Florida attorney general issues subpoenas in OpenAI criminal probe"},"content":{"rendered":"<p><img alt=\"\" loading=\"lazy\" width=\"900\" height=\"505\" decoding=\"async\" data-nimg=\"1\" class=\"standard-img w-full w-full h-auto\" style=\"color:transparent\" src=\"https:\/\/www.europesays.com\/ai\/wp-content\/uploads\/2026\/04\/fef24f5974391706c5a8e7ec8af553c2.jpeg\"\/><\/p>\n<p>Florida Attorney General James Uthmeier (R) on Tuesday launched a criminal investigation into OpenAI and its chatbot, serving the company with subpoenas.<\/p>\n<p>Uthmeier, who <a href=\"https:\/\/thehill.com\/policy\/technology\/5824392-florida-investigates-openai-chatgpt\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:initially opened a probe;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">initially opened a probe<\/a> into OpenAI and ChatGPT earlier this month, said at a <a href=\"https:\/\/x.com\/AGJamesUthmeier\/status\/2046590680168825272?s=20\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:news conference;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">news conference<\/a> that the individual accused of fatally shooting two people at Florida State University (FSU) last April communicated with ChatGPT before the incident.<\/p>\n<p>Two individuals, 57-year-old Robert Morales and 45-year-old Tiru Chabba, were killed in the attack.<\/p>\n<p>Uthmeier noted that prior to allegedly carrying out the shooting, the man accused in the case was \u201cadvised\u201d by the chatbot on what type of gun to use, which ammo went with which gun, whether or not a gun would be useful in short range, what time of day would be appropriate to interact with more people and where on FSU\u2019s campus he would encounter a higher population.<\/p>\n<p>Given that, the attorney general said that his prosecutors told him that \u201cif it was a person on the other end of that screen, we would be charging them\u201d with murder. Under Florida law, anyone who aids, abets or counsels someone in the commission of a crime may be considered a principal in the first degree.<\/p>\n<p>\u201cTechnology, AI, is supposed to support mankind, it is supposed to help mankind, it is supposed to advance mankind, not end it,\u201d Uthmeier remarked. \u201cAnd unfortunately, what we\u2019ve seen in our initial review is that ChatGPT offered significant advice to the shooter before he committed such heinous crimes.\u201d<\/p>\n<p>The attorney general said his office subpoenaed OpenAI for all policies and internal training materials from March 1, 2024, through April 17 of this year regarding user threats of harm to others, user threats of harm to self and cooperation with law enforcement, including policies for the reporting of past, present or future crimes.<\/p>\n<p>The Office of Statewide Prosecution also subpoenaed the company for organizational charts and listings of all ChatGPT employees from March 1 and Oct. 1, 2024, and April 17, 2025 \u2014 the day the shooting occurred.<\/p>\n<p>Kate Waters, a spokesperson for OpenAI, told The Hill that the company will \u201ccontinue to cooperate with authorities,\u201d but denied that ChatGPT was responsible for the shooting.<\/p>\n<p>\u201cIn this case, ChatGPT provided factual responses to questions with information that could be found broadly across public sources on the internet, and it did not encourage or promote illegal or harmful activity,\u201d she added. \u201cChatGPT is a general-purpose tool used by hundreds of millions of people every day for legitimate purposes. We work continuously to strengthen our safeguards to detect harmful intent, limit misuse, and respond appropriately when safety risks arise.\u201d<\/p>\n<p>Florida Gov. Ron DeSantis (R) has <a href=\"https:\/\/thehill.com\/homenews\/administration\/5649792-florida-desantis-ai-regulation\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:pushed for state-level regulations;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">pushed for state-level regulations<\/a> on AI, putting him at odds with President Trump.<\/p>\n<p>In December, Trump <a href=\"https:\/\/thehill.com\/policy\/technology\/5645562-executive-order-limits-state-ai\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:signed an executive order;elm:context_link;itc:0;sec:content-canvas\" class=\"link rapid-noclick-resp\">signed an executive order<\/a> aimed at preempting state laws that regulate the technology in favor of federal standards, while DeSantis rolled out a \u201cCitizen Bill of Rights\u201d for AI that same month.<\/p>\n<p>Updated at 5:53 p.m. EDT<\/p>\n<p>Copyright 2026 Nexstar Media, Inc.
