{"id":131379,"date":"2026-08-06T09:49:16","date_gmt":"2026-08-06T09:49:16","guid":{"rendered":"https:\/\/www.europesays.com\/ai\/131379\/"},"modified":"2026-08-06T09:49:16","modified_gmt":"2026-08-06T09:49:16","slug":"openai-says-apples-trade-secrets-lawsuit-is-rotten-to-its-core","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ai\/131379\/","title":{"rendered":"OpenAI says Apple\u2019s trade secrets lawsuit is \u2018rotten to its core\u2019"},"content":{"rendered":"<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">OpenAI has asked a federal judge to toss out Apple\u2019s landmark lawsuit accusing the ChatGPT maker of stealing trade secrets, describing the allegations as \u201cmeritless.\u201d In <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.474095\/gov.uscourts.cand.474095.59.0.pdf\" rel=\"nofollow noopener\" target=\"_blank\">a motion filed yesterday<\/a> to dismiss the complaint, OpenAI says that Apple is mischaracterizing both the actions of the AI startup\u2019s employees as theft, and \u201cgeneric\u201d product development information as \u201ctrade secrets,\u201d adding that Apple made no reasonable efforts to maintain such secrecy.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">Several aspects of that blog make a more formal appearance in OpenAI\u2019s dismissal request, alleging that Apple\u2019s case is poorly investigated, built on selective or out-of-context communications, and \u201crotten to its core.\u201d For example, OpenAI claims that Chang Liu \u2014 a former Apple staffer now working for OpenAI who stands accused of downloading confidential files from Apple after leaving the company \u2014 was simply assisting ex-colleagues who asked him for help.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">\u201cApple should not be permitted to use a baseless and pretextual lawsuit to make up for its shortcomings in the market for talent and retaining its employees, and its failures to integrate AI into its products,\u201d OpenAI says in the dismissal filing. \u201cOpenAI is building something entirely new and different from anything at Apple. OpenAI does have an interest in hiring the best engineers, inventors, developers and creators \u2014 many of whom have decided to leave Apple and to come to OpenAI, attracted by the innovative and exciting work the company is doing.\u201d<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">The judge is set to hear arguments on the motion on October 1st.
