(KNWA\/KFTA) \u2014 Elon Musk&#8217;s AI company xAI has filed its own lawsuit against a Bentonville photographer accused of using the company&#8217;s Grok chatbot to generate child sexual abuse material (<a data-ylk=\"slk:CSAM;elm:context_link;itc:0;sec:content-canvas;\" data-yga=\"{&quot;yLinkElement&quot;:&quot;link&quot;,&quot;yLinkElementType&quot;:&quot;article_link&quot;}\" href=\"https:\/\/www.nwahomepage.com\/news\/what-to-know-about-the-term-child-sexual-abuse-material\/\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">CSAM<\/a>). It is the first civil case to name the photographer as a defendant since his arrest in June.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Russell Bloodworth, 43, operated a photography business in Bentonville for about 15 years.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">He was arrested June 10 and charged with 100 counts of distributing, possessing or viewing matter depicting sexually explicit conduct involving a child, plus 100 counts of unlawful creation or distribution of deepfake visual material.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">According to the investigating detective&#8217;s affidavit, Bloodworth used Grok to alter lawful photos of his minor photography clients into sexually explicit AI-generated images and videos. He has since pleaded <a data-ylk=\"slk:not guilty;elm:context_link;itc:0;sec:content-canvas;\" data-yga=\"{&quot;yLinkElement&quot;:&quot;link&quot;,&quot;yLinkElementType&quot;:&quot;article_link&quot;}\" href=\"https:\/\/www.nwahomepage.com\/northwest-arkansas-news\/bentonville-photographer-pleads-not-guilty-to-200-csam-related-charges\/\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">not guilty<\/a>.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The suit against Bloodworth, filed July 30 in the Wichita Falls Division of the U.S. District Court for the Northern District of Texas, is one of several lawsuits tied to his case, but the only one where Bloodworth himself is a defendant.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The others target xAI directly. On July 23, <a data-ylk=\"slk:an Arkansas family anonymously sued xAI;elm:context_link;itc:0;sec:content-canvas;\" data-yga=\"{&quot;yLinkElement&quot;:&quot;link&quot;,&quot;yLinkElementType&quot;:&quot;article_link&quot;}\" href=\"https:\/\/www.nwahomepage.com\/news\/state-news\/arkansas-family-sues-xai-alleging-grok-used-to-create-csam-of-their-daughter\/\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">an Arkansas family anonymously sued xAI<\/a> in the U.S. District Court for the Eastern District of Arkansas, alleging Grok was used to alter professional photographs Bloodworth had taken of their daughter. Potts Law Firm, which represents that family, has since filed two more individual suits for other Arkansas families and says it plans to keep filing cases individually rather than as a class action.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Separately, on Aug. 18, a different legal team, including Herrera Law Group and Beasley Allen, filed a class action against xAI in California on behalf of six Arkansas children, a distinct group of plaintiffs from the Potts suits. Bloodworth is not a party in any of the victim-led cases.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">What xAI is asking for<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">xAI alleges Bloodworth breached the terms of service every Grok user agrees to, and is seeking payment as a result.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">According to xAI&#8217;s complaint, Bloodworth created four Grok accounts in March. The company alleges that between March 30 and April 30, he uploaded ordinary, non-sexual photos of real people, including minors, then used &#8220;adversarial&#8221; prompts to circumvent Grok&#8217;s safety filters until the chatbot generated sexually explicit images. xAI says it identified the activity, reported it to the National Center for Missing and Exploited Children on April 23, and that report led to Bentonville police identifying and arresting Bloodworth.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">xAI cites an indemnification clause in its terms of service, a provision requiring users to cover xAI&#8217;s costs if their conduct results in legal claims against the company. xAI is asking a judge to order Bloodworth to cover its legal expenses from defending against the family&#8217;s lawsuit and any future suits tied to his alleged conduct, and to permanently bar him from creating another Grok account.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The &#8220;neutral tool&#8221; argument<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">xAI&#8217;s complaint repeatedly describes Grok as &#8220;a powerful, neutral generative artificial intelligence tool&#8221; and argues that &#8220;every response, every image, every generation is the result of the user&#8217;s prompts and directions.&#8221;<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">It says Grok&#8217;s Spicy and Unhinged modes are text-based conversational features only, unrelated to image generation, and that users of Grok&#8217;s image tools have no reduced safeguards against abuse. The complaint cites a Jan. 3 post from Musk on X stating that anyone using Grok to make illegal content would face the same consequences as if they had uploaded it themselves.<\/p>\n<p><img alt=\"&lt;em&gt;X post made by Elon Musk included in xAI's complaint.&lt;\/em&gt;\" loading=\"lazy\" width=\"900\" height=\"335\" decoding=\"async\" data-nimg=\"1\" class=\"rounded-lg\" style=\"color:transparent\" src=\"https:\/\/www.europesays.com\/ai\/wp-content\/uploads\/2026\/08\/https:\/\/media.zenfs.com\/en\/knwa_fayetteville_articles_688\/1471091c8f128f95f1b1a372d758c0f2.png\"\/><\/p>\n<p>X post made by Elon Musk included in xAI&#8217;s complaint.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">xAI also cited its enforcement record, saying it suspended 77,723 accounts and made 100,235 reports to NCMEC&#8217;s CyberTipline in 2026, leading to at least 299 arrests.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">What the other lawsuits claim<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Both the original Potts-led suit and the Aug. 18 class action argue xAI&#8217;s own safeguards, not just Bloodworth&#8217;s conduct, are to blame. Potts Law Firm has said Grok&#8217;s Spicy Mode allowed the kind of content other AI companies prohibit outright.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The class action, brought by a separate set of plaintiffs, goes further, alleging xAI is the only major AI company that built sexually explicit image generation into its product without the filters and testing the complaint says are standard across the industry. It cites a surge in late December and early January, after Musk posted an AI altered photo of himself in a bikini, that a digital rights group estimated produced roughly 3 million sexualized images over 11 days, including thousands the group said appeared to depict children.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The class action also cites a Senate Judiciary Committee exchange in which NCMEC told Sen. Chuck Grassley that most of xAI&#8217;s 2025 CyberTipline reports lacked enough information for law enforcement to act on.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">What&#8217;s next<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Bloodworth&#8217;s next hearing in the criminal case remains set for Sept. 21.
