The U.S. Justice Department said on Friday it had intervened in a lawsuit by Elon Musk<\/a>‘s xAI<\/a> challenging a Colorado law aimed at regulating artificial intelligence systems.<\/p>\n

In its intervention, the Justice Department said the law violates the Fourteenth Amendment’s equal protection \u200cguarantee by \u2060requiring \u2060companies to guard against unintended discriminatory effects while allowing some discrimination \u200baimed at promoting diversity.<\/p>\n

“Laws that require AI companies to infect their \u200bproducts with woke DEI ideology are illegal,” Assistant Attorney General for Civil Rights Harmeet Dhillon said in a \u200bstatement.<\/p>\n

The Colorado Attorney General’s Office declined \u2060to comment.<\/p>\n

In \u200cits lawsuit filed earlier this month in U.S. District Court in Colorado, xAI sought to block \u2060the state from enforcing Senate Bill 24-205<\/a>, which is scheduled to take effect on June 30. The law imposes disclosure and risk-mitigation requirements on developers of so\u2011called “high\u2011risk” AI systems used in decisions involving employment, housing, education, healthcare and financial services.<\/p>\n

Musk’s artificial intelligence firm said the law violates the First Amendment \u200cby restricting how developers design AI systems and compelling speech on contentious public issues.<\/p>\n

The federal \u200bintervention escalates \u200bwhat had been \u2060a single-company legal challenge into a direct confrontation between the Trump administration and Colorado over state-level AI regulation.<\/p>\n
