BIRMINGHAM, Ala. (WBRC<\/a>) – New developments are emerging in a plan to build a massive \u201cAI factory\u201d in Birmingham\u2019s Oxmoor Valley neighborhood, as city officials clarify that critical portions of the project can move forward without additional zoning approvals.<\/p>\n

The update follows an hourslong meeting before the city\u2019s Zoning Board of Adjustment last month, where the proposal sparked intense discussion and community concern. In the weeks since, the city has determined that Alabama Power<\/a> and Nebius<\/a> do not need special exceptions to build a substation and a switching station tied to the project.<\/p>\n

\"Nebius,Nebius, a Netherlands-based tech company, owns about 80 acres off Lakeshore Parkway. They ae hoping to build a two-building AI factory in a former bank-back office building.(WBRC)<\/p>\n

The clarification comes after confusion surrounding actions taken during the March 26 Zoning Board of Adjustment meeting. At that time, the board appeared to recommend approval for a substation connected to the proposed Nebius<\/a> AI data center, while denying a separate request for a switching station tied to the same development.<\/p>\n

However, according to a legal memo issued by the city Thursday, neither the substation nor the switching station required approval from the zoning board in the first place.<\/p>\n

That determination means that, despite the earlier partial denial, both components of the project can move forward through other regulatory channels, effectively clearing a path for continued progress on the development.<\/p>\n

The proposed facility has drawn strong opposition from neighbors in Oxmoor Valley, with residents raising concerns about potential noise, environmental impacts and strain on local infrastructure.<\/p>\n

City officials also addressed questions regarding Birmingham\u2019s moratorium on data center developments.<\/p>\n

In a separate letter, the city clarified that both the Nebius<\/a> project and the expansion of DC Blox<\/a> in Titusville are exempt from the moratorium. Officials say both companies submitted their applications roughly two months before the moratorium took effect and are being reviewed under the zoning framework that was in place at the time.<\/p>\n

The latest clarification adds another layer to an already complex and closely watched project, as residents and city leaders continue to navigate questions surrounding growth, infrastructure and community impact in the Oxmoor Valley area.<\/p>\n
