At that time, the board appeared to recommend approval for a substation connected to the proposed <a href=\"https:\/\/nebius.com\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/nebius.com\/\">Nebius<\/a> AI data center, while denying a separate request for a switching station tied to the same development.<\/p>\n<p class=\"text | article-text\">However, according to a legal memo issued by the city Thursday, neither the substation nor the switching station required approval from the zoning board in the first place.<\/p>\n<p class=\"text | article-text\">That determination means that, despite the earlier partial denial, both components of the project can move forward through other regulatory channels, effectively clearing a path for continued progress on the development.<\/p>\n<p class=\"text | article-text\">The proposed facility has drawn strong opposition from neighbors in Oxmoor Valley, with residents raising concerns about potential noise, environmental impacts and strain on local infrastructure.<\/p>\n<p class=\"text | article-text\">City officials also addressed questions regarding Birmingham\u2019s moratorium on data center developments.<\/p>\n<p class=\"text | article-text\">In a separate letter, the city clarified that both the <a href=\"https:\/\/nebius.com\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/nebius.com\/\">Nebius<\/a> project and the expansion of <a href=\"https:\/\/www.dcblox.com\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.dcblox.com\/\">DC Blox<\/a> in Titusville are exempt from the moratorium.
