He is seeking to convince the jury that the defendants, including Microsoft, were &#8220;unjustly enriched to the tune of hundreds of billions of dollars.&#8221;<\/p>\n<p>&#8220;Microsoft would only put $10 billion \u2014 which is a huge sum of money \u2014 into something if they feel like they will get a return,&#8221; Musk said in explaining why he was so mad about the investment. Altman, OpenAI&#8217;s CEO, was in the courtroom during Musk&#8217;s testimony.<\/p>\n<p>Musk, while under direct questioning by his lead trial attorney, Steven Molo, said he was concerned that Microsoft would effectively be in control of AGI, or <a target=\"_self\" class=\"\" href=\"https:\/\/www.businessinsider.com\/openai-updated-principles-three-key-changes-competition-agi-anthropic-2026-4\" data-track-click=\"{&quot;element_name&quot;:&quot;body_link&quot;,&quot;event&quot;:&quot;tout_click&quot;,&quot;index&quot;:&quot;bi_value_unassigned&quot;,&quot;product_field&quot;:&quot;bi_value_unassigned&quot;}\" rel=\"nofollow noopener\">artificial general intelligence<\/a>, that was &#8220;started by a charity.&#8221;<\/p>\n<p>&#8220;Microsoft would have motivations that are different from a charity,&#8221; Musk added.<\/p>\n<p>The investment was Microsoft&#8217;s second in OpenAI. Microsoft first invested $1 billion in 2019.<\/p>\n<p>When asked why Musk didn&#8217;t file any lawsuits in 2019, he said that he understood the situation as one with a capped profit. Cohen, told the jury in opening statements on Tuesday that Microsoft &#8220;helped OpenAI pursue and further its mission.&#8221;<\/p>\n<p>&#8220;Unlike Mr. Musk, Microsoft never tried to control OpenAI,&#8221; Cohen said.<\/p>\n<p>When asked on Wednesday how Musk responds to those comments, Musk testified, &#8220;They&#8217;re trying to trick the jury.&#8221;<\/p>\n<p>Throughout the monthlong trial, the jury is expected to hear more testimony from tech heavyweights, including Altman, Brockman, and <a target=\"_self\" class=\"\" href=\"https:\/\/www.businessinsider.com\/microsoft-ceo-satya-nadella-ai-revolution-2025-12\" data-track-click=\"{&quot;element_name&quot;:&quot;body_link&quot;,&quot;event&quot;:&quot;tout_click&quot;,&quot;index&quot;:&quot;bi_value_unassigned&quot;,&quot;product_field&quot;:&quot;bi_value_unassigned&quot;}\" rel=\"nofollow noopener\">Microsoft CEO Satya Nadella<\/a>.<\/p>\n<p>OpenAI has repeatedly slammed Musk&#8217;s lawsuit as &#8220;baseless,&#8221; and in opening arguments, OpenAI and Altman&#8217;s lead lawyer, William Savitt, told the jury that Musk only went after the ChatGPT-maker because he &#8220;didn&#8217;t get his way with OpenAI.&#8221;<\/p>\n<p>&#8220;The only thing Musk cared about is being on top,&#8221; said Savitt.<\/p>\n<p>While under cross-examination by Savitt on Wednesday, Musk accused the attorney of trying to &#8220;trick&#8221; him.<\/p>\n<p>&#8220;Your questions are not simple.
