{"id":36866,"date":"2026-05-13T00:32:10","date_gmt":"2026-05-13T00:32:10","guid":{"rendered":"https:\/\/www.europesays.com\/ai\/36866\/"},"modified":"2026-05-13T00:32:10","modified_gmt":"2026-05-13T00:32:10","slug":"openais-sam-altman-takes-the-stand-to-fend-off-elon-musks-accusations-he-stole-a-charity","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ai\/36866\/","title":{"rendered":"OpenAI&#8217;s Sam Altman takes the stand to fend off Elon Musk&#8217;s accusations he &#8216;stole a charity&#8217;"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/ai\/wp-content\/uploads\/2026\/05\/K2SL45EGJFLSHDCMZ423TBJE7U.jpg\" alt=\"OpenAI CEO Sam Altman walks inside the federal courthouse during a recess in the proceedings in the trial over Elon Musk's lawsuit against OpenAI in Oakland, California, on May 12, 2026.\" class=\"width_full\" style=\"aspect-ratio:2817 \/ 1922;width:100%\"\/><\/p>\n<p>OpenAI CEO Sam Altman walks inside the federal courthouse during a recess in the proceedings in the trial over Elon Musk&#8217;s lawsuit against OpenAI in Oakland, California, on May 12, 2026.<\/p>\n<p class=\"article-body__image-by color_dgray f_s_xxs m-none\">JOSH EDELSON \/ AFP via Getty Images<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">OpenAI CEO Sam Altman took the stand on Tuesday to defend himself against accusations from co-founder-turned-adversary Elon Musk that he &#8220;<a href=\"https:\/\/www.npr.org\/2026\/04\/28\/nx-s1-5801438\/musk-altman-openai-trial-opening-statements\" target=\"_blank\" rel=\"nofollow noopener\">stole a charity<\/a>&#8221; by converting the maker of ChatGPT into <a href=\"https:\/\/www.npr.org\/2026\/04\/29\/nx-s1-5803833\/elon-musk-testimony-openai-altman-day-2\" target=\"_blank\" rel=\"nofollow noopener\">a for-profit juggernaut<\/a>.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">The trial, now in its third week, pits two of the tech world\u2019s biggest personalities against one another in a high-stakes clash that could usher in major changes for one of the world\u2019s leading artificial intelligence companies and potentially alter the AI landscape.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">Musk\u2019s lawyers made the case that OpenAI, Altman and OpenAI president Greg Brockman, with the help of investments from Microsoft, jettisoned OpenAI\u2019s founding mission of being a non-profit focused on creating advanced AI for the benefit of humanity. Instead, the Musk team argues that they enriched themselves by creating a for-profit subsidiary that now effectively controls the nonprofit.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">OpenAI\u2019s legal team has argued that Musk is motivated by sour grapes and is out to damage a competitor. And on the stand Tuesday, Altman pushed back against the notion that Musk actually cares about OpenAI.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">\u201cMr. Musk did try to kill it,\u201d he said, adding that Musk launched a competitor called xAI, tried to poach its talent, and alleged that he engaged in \u201cbusiness interference.\u201d<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">The dispute goes back nearly a decade to when the founders of OpenAI \u2014 including Musk \u2014 decided they needed to create a for-profit entity in order to attract top talent and raise big money to develop competitive AI technology.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">Musk, who donated $38 million to OpenAI early on, wanted control of the for-profit; the other founders were against it.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">On the stand, Altman testified that the co-founders felt no single person should control AGI, or artificial general intelligence, and that Musk was not a good fit for the company.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">Musk left the board in 2018, and Altman called that a morale boost for employees who did not like his \u201chardcore\u201d approach.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">The trial has <a href=\"https:\/\/www.kqed.org\/news\/12082428\/inside-sam-altman-and-elon-musks-battle-over-openai\" target=\"_blank\" rel=\"nofollow noopener\">opened a rare window<\/a> into the machinations of some of Silicon Valley\u2019s most ambitious tech entrepreneurs as they debated the future of AI and wrangled over investment plans and control of OpenAI. It would go on to become a global leader in AI thanks to the launch of ChatGPT in 2022.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">OpenAI\u2019s lawyers have drawn on once-private text messages and emails to try to paint Musk as power-hungry and initially supportive of plans for the for-profit to attract huge investments. The OpenAI team also tried to undermine Musk\u2019s credibility by highlighting messages that appeared to show that he tried to poach talent from OpenAI before he left the company\u2019s board, and was kept appraised of its decisions after leaving by then-board member Shivon Zilis, who is the mother of four of Musk\u2019s children.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">Musk\u2019s lawyers, meanwhile, have tried to make the case that Altman and Brockman were intent on reaping personal profits from OpenAI despite its original nonprofit mission. OpenAI\u2019s nonprofit still exists, and owns the for-profit entity, now valued in the hundreds of billions of dollars. But Musk argues that it has been sidelined.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">While cross examining Altman, Musk\u2019s attorney Steven Molo tried to undercut his credibility, asking if he was trustworthy. \u201cI believe so,\u201d said Altman. When Molo asked Altman if he always told the truth, Altman replied: \u201cI\u2019m sure there are some times in my life when I did not.\u201d Asked if he had been called a liar by business associates, Altman said: \u201cI have heard people say that.\u201d<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">If the United States District Court for the Northern District of California finds Altman, Brockman and Microsoft liable for Musk\u2019s two civil claims \u2014 \u201cbreach of charitable trust\u201d and \u201cunjust enrichment\u201d \u2014 Musk has asked for them to \u201cdisgorge\u201d up to $150 billion to the nonprofit entity.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">He is also seeking the unwinding of the for-profit and wants Altman and Brockman removed from their leadership roles.
