After a three-week trial, the jury deliberated less than two hours.<\/p>\n<p>Musk, the world\u2019s richest man, was a co-founder of OpenAI, which launched in 2015 and went on to create ChatGPT. After investing $38 million in its first years, <a class=\"Link AnClick-LinkEnhancement\" href=\"https:\/\/apnews.com\/article\/elon-musk-openai-altman-trial-b3c647391fbaa0f081611027b4e98479\" data-gtm-enhancement-style=\"LinkEnhancementA\" rel=\"nofollow noopener\" target=\"_blank\">Musk<\/a> accused OpenAI <a class=\"Link AnClick-LinkEnhancement\" href=\"https:\/\/apnews.com\/article\/altman-musk-openai-trial-7648a50c3981dcc464324d1835b77f93\" data-gtm-enhancement-style=\"LinkEnhancementA\" rel=\"nofollow noopener\" target=\"_blank\">CEO Sam Altman<\/a> and his top deputy of shifting into a moneymaking mode behind his back.<\/p>\n<p>The jury served in an advisory role, but Judge Yvonne Gonzalez Rogers accepted the verdict Monday as the court\u2019s own and dismissed Musk\u2019s claims.<\/p>\n<p>Musk posted on his social media platform X that he would file an appeal. He said the judge and jury never weighed in on the merits of the case, just \u201ca calendar technicality.\u201d<\/p>\n<p>\u201cThere is no question to anyone following the case in detail that Altman &amp; Brockman did in fact enrich themselves by stealing a charity. The only question is WHEN they did it!\u201d he wrote.<\/p>\n<p>Musk\u2019s lawyer, Steven Molo, said Musk\u2019s feud with OpenAI was far from resolved. He compared Monday\u2019s verdict to moments in U.S. history like the Siege of Charleston and the Battle of Bunker Hill which were \u201cmajor losses for Americans, but who won the war?\u201d<\/p>\n<p>OpenAI argued it came down to a business rivalry<\/p>\n<p>The trial in Oakland, California shed light on the bitter falling-out between the two Silicon Valley titans and the beginnings of OpenAI, now <a class=\"Link AnClick-LinkEnhancement\" href=\"https:\/\/apnews.com\/article\/openai-chatgpt-nonprofit-microsoft-c661df3242766d6b0ddbab401ad1fd84\" data-gtm-enhancement-style=\"LinkEnhancementA\" rel=\"nofollow noopener\" target=\"_blank\">a company<\/a> valued at $852 billion and moving toward potentially one of the largest initial public offerings in history.<\/p>\n<p>Altman and OpenAI claimed there was never a promise to keep OpenAI a nonprofit forever. In fact, they argued, Musk knew this and filed his lawsuit because he couldn\u2019t have unilateral control over the fast-growing AI developer.<\/p>\n<p>OpenAI argued the lawsuit aimed to undercut the company\u2019s rapid growth and bolster Musk\u2019s xAI, which he launched in 2023 as a competitor.<\/p>\n<p>Outside court Monday, OpenAI lawyer William Savitt told reporters that jurors determined the lawsuit was an \u201cafter-the-fact contrivance\u201d that amounted to Musk trying to sabotage a competitor and \u201dto overcome a long history of very bad predictions about what OpenAI has been and will become.\u201d<\/p>\n<p>Microsoft, an OpenAI investor and a co-defendant in Musk\u2019s lawsuit, said it welcomed the decision and remains \u201ccommitted to our work with OpenAI to advance and scale AI for people and organizations around the world.\u201d<\/p>\n<p>Musk was seeking damages to be paid to the altruistic efforts of OpenAI\u2019s charitable arm as well as Altman\u2019s ouster from OpenAI\u2019s board. Musk\u2019s decision to stop funding the company contributed to the rift between the former allies. Musk says he was responding to deceptive conduct that OpenAI\u2019s board picked up on when it <a class=\"Link AnClick-LinkEnhancement\" href=\"https:\/\/apnews.com\/article\/altman-ai-chatgpt-murati-893e4a460c10eb3a8f1afefa6156eca3\" data-gtm-enhancement-style=\"LinkEnhancementA\" rel=\"nofollow noopener\" target=\"_blank\">fired Altman<\/a> as CEO in 2023 before he <a class=\"Link AnClick-LinkEnhancement\" href=\"https:\/\/apnews.com\/article\/altman-openai-chatgpt-31187f7f6eca8ff9d0eef7585aac6ace\" data-gtm-enhancement-style=\"LinkEnhancementA\" rel=\"nofollow noopener\" target=\"_blank\">got his job back<\/a> days later.<\/p>\n<p>The trial saw testimony from Musk, Altman and his top lieutenant Greg Brockman, along with Microsoft CEO Satya Nadella and a slew of others in the tech titans\u2019 orbit.<\/p>\n<p>Musk told jurors on his first of three <a class=\"Link AnClick-LinkEnhancement\" href=\"https:\/\/apnews.com\/article\/musk-altman-openai-trial-chatgpt-a4a8930b17b534d49a13e53d581d9e4c\" data-gtm-enhancement-style=\"LinkEnhancementA\" rel=\"nofollow noopener\" target=\"_blank\">days on the stand<\/a> that, fundamentally, \u201cI think they\u2019re going to try to make this lawsuit &#8230; very complicated, but it\u2019s actually very simple,\u201d Musk said. \u201cWhich is that it\u2019s not OK to steal a charity.\u201d<\/p>\n<p>Musk\u2019s lawsuit claimed that, in addition to \u201cbreach of charitable trust,\u201d Altman and Brockman unjustly enriched themselves from the windfall as the ChatGPT maker soared in valuation. Brockman revealed during the trial that his stake in OpenAI is worth about $30 billion.<\/p>\n<p>The trial detailed a clash between tech titans<\/p>\n<p>Altman and Musk both vied to be OpenAI\u2019s CEO in its early years. In his testimony, Altman said he had concerns about Musk\u2019s attempts to gain more control over OpenAI, which was aiming to safely build a better-than-human form of AI called <a class=\"Link AnClick-LinkEnhancement\" href=\"https:\/\/apnews.com\/article\/agi-artificial-general-intelligence-existential-risk-meta-openai-deepmind-science-ff5662a056d3cf3c5889a73e929e5a34\" data-gtm-enhancement-style=\"LinkEnhancementA\" rel=\"nofollow noopener\" target=\"_blank\">artificial general intelligence<\/a>.<\/p>\n<p>\u201cPart of the reason we started OpenAI is we didn\u2019t think AGI could be under the control of any one person, no matter how good their intents are,\u201d Altman said.<\/p>\n<p>The trial also shed light on Altman\u2019s removal from the OpenAI board in 2023, before he <a class=\"Link AnClick-LinkEnhancement\" href=\"https:\/\/apnews.com\/article\/openai-sam-altman-chatgpt-2f3303dff2280478947e9bfb04863537\" data-gtm-enhancement-style=\"LinkEnhancementA\" rel=\"nofollow noopener\" target=\"_blank\">returned to his role<\/a> a few days later.
