{"id":48512,"date":"2026-05-22T18:36:11","date_gmt":"2026-05-22T18:36:11","guid":{"rendered":"https:\/\/www.europesays.com\/ai\/48512\/"},"modified":"2026-05-22T18:36:11","modified_gmt":"2026-05-22T18:36:11","slug":"openai-must-produce-testimony-from-musk-case-in-copyright-suits","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ai\/48512\/","title":{"rendered":"OpenAI Must Produce Testimony From Musk Case in Copyright Suits"},"content":{"rendered":"<p>OpenAI Inc. must produce testimony from the company\u2019s recent trial victory over Elon Musk and X.AI as part of separate, sprawling copyright litigation against the artificial intelligence giant, a federal magistrate judge ruled.<\/p>\n<p>Depositions from OpenAI founders Sam Altman and Greg Brockman, as well as from Microsoft Corp. CEO Satya Nadella and the person designated to testify for OpenAI as an entity, could show inconsistency about the commercial nature of OpenAI\u2019s use of copyrighted works, the US District Court for the Southern District of New York said Thursday. <\/p>\n<p>Magistrate Judge Ona Wang found production relevant to that first factor of the fair use analysis and not burdensome to OpenAI\u2014particularly after the plaintiffs narrowed their initial request.<\/p>\n<p>The order could undermine OpenAI\u2019s bid to downplay the commercial aspect of its use of the material at issue in 19 copyright lawsuits that have been consolidated for pretrial purposes. <\/p>\n<p>Musk\u2019s suit asserted that OpenAI betrayed its mission to benefit the public by morphing into a for-profit business. A jury this week <a data-terminal-id=\"TF93J2T9NJLY\" href=\"https:\/\/news.bloomberglaw.com\/litigation\/elon-musk-loses-case-against-sam-altman-to-force-openai-overhaul\" rel=\"nofollow noopener\" target=\"_blank\">rejected Musk\u2019s claims<\/a> as brought too late, clearing <a data-terminal-id=\"TFDL98KGIFQJ\" href=\"https:\/\/news.bloomberglaw.com\/california-brief\/openai-faces-ipo-unknowns-even-after-victory-over-elon-musk\" rel=\"nofollow noopener\" target=\"_blank\">one of several hurdles<\/a> for OpenAI to move toward an <a data-terminal-id=\"TFCO2WT9NJLW\" href=\"https:\/\/news.bloomberglaw.com\/artificial-intelligence\/openai-is-preparing-to-file-for-an-ipo-in-the-coming-weeks-1\" rel=\"nofollow noopener\" target=\"_blank\">initial public offering<\/a>.<\/p>\n<p>OpenAI\u2014along with Microsoft\u2014now faces potentially catastrophic liability if a court deems its use of a vast array of copyrighted works to train AI doesn\u2019t qualify as fair use, a novel question being litigated across the country.<\/p>\n<p>The copyright suits\u2014many of them putative class actions\u2014were filed between 2023 and this year, with discovery in the original 12 cases <a data-terminal-id=\"SU697MDWRGG0\" href=\"https:\/\/news.bloomberglaw.com\/ip-law\/openai-copyright-lawsuits-discovery-consolidated-in-new-york\" rel=\"nofollow noopener\" target=\"_blank\">consolidated<\/a> in April 2025.<\/p>\n<p>In January, as the Musk case headed for trial, the copyright plaintiffs <a href=\"https:\/\/www.bloomberglaw.com\/public\/document\/InReOpenAIIncCopyrightInfringementLitigationDocketNo125md03143SDN\/73?doc_id=X5MUM2EE2VM9M69S3GFAI6AEJI5\" rel=\"nofollow noopener\" target=\"_blank\">moved to compel<\/a> OpenAI to produce Brockman\u2019s notebook in which the company\u2019s president recorded notes about his work. Wang ordered OpenAI to <a data-terminal-id=\"TBP65LKIUPS5\" href=\"https:\/\/news.bloomberglaw.com\/ip-law\/new-york-times-wins-bid-for-openai-presidents-diary-in-ip-suit\" rel=\"nofollow noopener\" target=\"_blank\">produce portions of the diary<\/a> in March. <\/p>\n<p>That motion also renewed an earlier request for depositions of six individuals from the Musk case. OpenAI later trimmed the request down to the four depositions, Wang said.<\/p>\n<p>OpenAI \u201cinconsistently\u201d objected to the production by arguing both that the plaintiffs haven\u2019t shown any inconsistencies and that plaintiffs misinterpreted the testimony, Wang said.
