The DOJ was joined by a Department of Defense official and Mississippi Gov. Since last summer, Mississippi has allowed the facility to operate <a href=\"https:\/\/www.theguardian.com\/environment\/2026\/feb\/13\/elon-musk-xai-datacenters-air-pollution-mississippi\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">a growing number of natural gas turbines without permits<\/a>, sparking <a href=\"https:\/\/www.mississippifreepress.org\/xai-faces-fierce-opposition-over-southaven-mississippi-power-plant-permit\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">sustained public backlash and complaints<\/a> about noise and air pollution. xAI currently has 57 turbines at the plant, up from 27 in February, the NAACP alleges in recent <a href=\"https:\/\/southernenvironment.sharefile.com\/share\/view\/6701e736c67e4228\/fo2a1f3d-071c-41dd-b977-44521d4d425c\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">court filings<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">The NAACP\u2019s April lawsuit accuses xAI of endangering public health and breaking federal law, insisting that the Clean Air Act requires permits and pollution controls for the turbines housed in Southaven. The group <a href=\"https:\/\/www.mississippifreepress.org\/xai-gas-turbines-causing-harm-in-southaven-naacp-argues-in-motion-to-shut-them-down\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">has requested an injunction<\/a> to shut down the machines while the broader litigation plays out.<\/p>\n<p class=\"wp-block-paragraph\">In its filing Monday, the DOJ argued that the Clean Air Act \u201caffords the United States primacy over citizen-enforcers\u201d like the NAACP, giving the federal government discretion over when and how the law should be enforced. The agency also highlighted Grok\u2019s pivotal role in \u201cnational security\u201d applications, including recent military operations against Iran.<\/p>\n<p class=\"wp-block-paragraph\">\u201cGrok\u2019s continued operation and availability \u2018is a matter of paramount national security,\u2019\u201d the filing states, citing an attached briefing from Cameron Davis, the DOD\u2019s chief digital and artificial intelligence officer.<\/p>\n<p class=\"wp-block-paragraph\">The DOJ\u2019s filing drew criticism from civil rights and environmental groups, including Earthjustice, which is representing the NAACP in the case.<\/p>\n<p class=\"wp-block-paragraph\">\u201cTrump\u2019s Justice Department wants to shield Elon Musk\u2019s data center company, xAI, from being held accountable for its illegal pollution\u2014and it\u2019s attempting to grab power from impacted communities, the courts, and Congress to do so,\u201d Laura Thoms, director of enforcement at Earthjustice, said in a Tuesday statement. \u201cThis isn\u2019t about national security; it\u2019s a desperate attempt to protect wealthy tech companies from obeying the laws meant to protect people from pollution.\u201d<\/p>\n<p class=\"wp-block-paragraph\">xAI now faces multiple lawsuits over its operations in Southaven, where the company <a href=\"https:\/\/www.actionnews5.com\/2026\/01\/08\/largest-economic-development-history-20-billion-dollar-data-center-coming-southaven\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">is building a new data center down the road<\/a> from its energy plant.
