{"id":76989,"date":"2026-06-17T14:04:04","date_gmt":"2026-06-17T14:04:04","guid":{"rendered":"https:\/\/www.europesays.com\/ai\/76989\/"},"modified":"2026-06-17T14:04:04","modified_gmt":"2026-06-17T14:04:04","slug":"trump-doj-intervenes-in-xai-air-pollution-case-against-naacp-in","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ai\/76989\/","title":{"rendered":"Trump DOJ intervenes in xAI air pollution case against NAACP in"},"content":{"rendered":"<p>The Trump administration is intervening on behalf of Elon Musk\u2019s xAI after the\u00a0<a href=\"https:\/\/thehill.com\/policy\/energy-environment\/5831325-naacp-musk-xai-pollution-data-center\/\" rel=\"nofollow noopener\" target=\"_blank\">NAACP accused it in court of illegally polluting the air<\/a>\u00a0of a Memphis-area community.<\/p>\n<p>In April, the civil rights organization alleged that xAI did not get an air pollution permit for its Colossus Gas Plant, which powers its Colossus 2 data center that in turn powers the AI chatbot Grok.<\/p>\n<p>In a filing on Monday, the Justice Department asked the court to dismiss the case. It argued that it\u2019s up to the United States when to enforce the Clean Air Act.<\/p>\n<p>The Trump administration also argued that Grok\u2019s ability to operate \u201cis a matter of paramount national security.\u201d<\/p>\n<p>It described it as one of only four AI models that can support \u201cnational security applications\u201d and one of three that can support \u201cmission-critical operations across Secret and Top-Secret classified networks.\u201d<\/p>\n<p>It said that during the war with Iran, Grok enabled the U.S. to \u201cdeploy over 2,000 munitions to 2,000 distinct targets within 96 hours.\u201d<\/p>\n<p>The NAACP\u2019s lawsuit alleged that xAI\u2019s plant, made up of 27 gas turbines, emits large amounts of pollution that are linked to asthma, respiratory diseases, heart problems and certain cancers. It also says that the communities surrounding the plant have a disproportionately high Black population.<\/p>\n<p>It said that if it had gone through the Clean Air Act process,\u00a0 it may have been required to cut down on this pollution.<\/p>\n<p>In response to the Trump administration\u2019s filing,\u00a0Abre\u2019 Conner, NAACP director of Environmental and Climate Justice, said in a statement that \u201cAt a time when the ultra-rich seem to be protected and supported by some of our government entities, it is important that polluting industries don\u2019t get to benefit at the expense of the health of Black communities.\u201d<\/p>\n<p>\u201cLaws like the Clean Air Act are a bedrock insurance policy for communities to hold polluters accountable for decisions that cause them harm. This should not be up for debate, and the NAACP will continue to stand up for democracy and against federal bullying and authoritarianism,\u201d Conner added.\u00a0<\/p>\n<p>In court, xAI\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.msnd.52261\/gov.uscourts.msnd.52261.54.0_2.pdf\" rel=\"nofollow noopener\" target=\"_blank\">has argued<\/a>\u00a0that it rightly relied on the state of Mississippi\u2019s determination that the portable turbines it uses are \u201cmobile\u201d sources of pollution and therefore, it did not need to get a permit typically required for \u201cstationary\u201d pollution sources like power plants.\u00a0<\/p>\n<p>The suit comes amid public backlash to data centers, including for environmental reasons.<\/p>\n<p>Updated at 2:16 p.m. EDT<\/p>\n<p>Copyright 2026 Nexstar Media Inc.
