{"id":9886,"date":"2026-04-21T08:47:31","date_gmt":"2026-04-21T08:47:31","guid":{"rendered":"https:\/\/www.europesays.com\/ai\/9886\/"},"modified":"2026-04-21T08:47:31","modified_gmt":"2026-04-21T08:47:31","slug":"naacp-sues-elon-musks-xai-over-pollution-from-data-centers-impacting-residents-in-north-mississippi-and-memphis-tn-afrotech","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ai\/9886\/","title":{"rendered":"NAACP Sues Elon Musk&#8217;s xAI Over Pollution From Data Centers Impacting Residents In North Mississippi And Memphis, TN &#8211; AfroTech"},"content":{"rendered":"<p>The NAACP has filed a lawsuit against Elon Musk\u2019s xAI.<\/p>\n<p>The lawsuit, which also lists its subsidiary, MZX Tech, as a defendant, was filed on Tuesday, April 14, in the U.S. District Court for the Northern District of Mississippi, and concerns power data centers in and near Memphis, TN, <a class=\"editor-rtfLink\" href=\"https:\/\/www.cnbc.com\/2026\/04\/14\/elon-musk-xai-memphis-data-centers.html\" target=\"_blank\" rel=\"noopener nofollow\">according to<\/a> CNBC.<\/p>\n<p>The lawsuit claims that 27 gas turbines are now operating in Southaven, MS, 13 miles south of Memphis, E&amp;E News by POLITICO <a href=\"https:\/\/www.eenews.net\/articles\/naacp-sues-musks-xai-over-data-center-pollution\/\" target=\"_blank\" rel=\"noopener nofollow\">reports.<\/a> They were installed between August and December 2025 and are allegedly causing harm to those in North Mississippi and Memphis through air pollution, per CNBC. According to a press release shared with AFROTECH\u2122, the turbines supply energy to xAI\u2019s Colossus 2 data center, which runs its chatbot Grok.<\/p>\n<p>The lawsuit alleges the operation of the gas turbines is illegal because no air permit was issued, according to CNBC. It also claims violations of the Clean Air Act, which regulates emissions of hazardous air pollutants in the interest of <a href=\"https:\/\/afrotech.com\/charles-r-drew-university-of-medicine-and-science-launches-pitch-accelerator\" target=\"_blank\" rel=\"noopener nofollow\">public health<\/a> and welfare, <a href=\"https:\/\/www.epa.gov\/laws-regulations\/summary-clean-air-act\" target=\"_blank\" rel=\"noopener nofollow\">according to<\/a> the United States Environmental Protection Agency.<\/p>\n<p>\u201cxAI has been pumping illegal pollution into this community in its rush to power the \u2018Colossus 2\u2019 <a href=\"https:\/\/afrotech.com\/amazon-announces-25b-commitment-toward-mississippi-data-center-operations-and-addresses-water-usage\" target=\"_blank\" rel=\"noopener nofollow\">data center.<\/a> No company \u2013 and no industry \u2013 has a free license to pollute our air,\u201d said Laura Thoms, director of enforcement for Earthjustice, in the press release. \u201cxAI isn\u2019t above the law, and we\u2019re filing this <a href=\"https:\/\/afrotech.com\/daymond-john-claims-he-is-owed-at-least-tens-of-millions-in-lawsuit\" target=\"_blank\" rel=\"noopener nofollow\">lawsuit<\/a> to hold them accountable.\u201d<\/p>\n<p>The press release noted that gas turbines release \u201csmog-forming pollution, fine particulate matter, and hazardous chemicals.\u201d Such pollutants can be linked to higher instances of asthma, respiratory diseases, heart problems, and certain cancers.<\/p>\n<p>Abre\u2019 Conner, NAACP director of environmental and climate justice, commented, per the release: \u201cA data center should not be a potential death sentence for a <a href=\"https:\/\/afrotech.com\/derrick-rose-launches-family-owned-flower-shop-in-chicago\" target=\"_blank\" rel=\"noopener nofollow\">community\u2019s<\/a> health. By looking to evade clear air laws to operate dirty turbines that emit pollution and known carcinogens, these companies are following a shameful, familiar pattern: asking Black and frontline communities to bear the toxic brunt of \u2018innovation.\u2019\u201d<\/p>\n<p>Conner continued, \u201cAs we shared since xAI started operating in Memphis, our homes, churches, and playgrounds will not be sacrifice zones for Big Tech\u2019s convenience. The NAACP stands firm that true progress cannot be built by ignoring community health and our environment. Our right to clean air is not up for negotiation, especially when companies prove expediency not people is their priority.\u201d<\/p>\n<p data-start=\"0\" data-end=\"381\" data-is-last-node=\"\" data-is-only-node=\"\">The NAACP is seeking a court ruling confirming that xAI violated the Clean Air Act and ordering the shutdown of the unpermitted turbines in Southaven. The organization is also asking the court to require xAI to install its best emissions control <a href=\"https:\/\/afrotech.com\/alpha-school-a-private-school-with-ai-tutors-is-making-its-way-to-chicago\" target=\"_blank\" rel=\"noopener nofollow\">technology<\/a> at the power plant and impose financial penalties for each day the company violates the law, the press release read.<\/p>\n","protected":false},"excerpt":{"rendered":"The NAACP has filed a lawsuit against Elon Musk\u2019s xAI.
