{"id":99181,"date":"2026-07-08T16:24:09","date_gmt":"2026-07-08T16:24:09","guid":{"rendered":"https:\/\/www.europesays.com\/ai\/99181\/"},"modified":"2026-07-08T16:24:09","modified_gmt":"2026-07-08T16:24:09","slug":"google-beats-suit-over-data-tracking-by-gemini-ai-assistant","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ai\/99181\/","title":{"rendered":"Google Beats Suit Over Data Tracking by Gemini AI Assistant"},"content":{"rendered":"<p>Google LLC defeated a proposed class action alleging it used its Gemini AI assistant to illegally track the private communications of users of its Gmail, instant messaging, and videoconference programs.<\/p>\n<p>The plaintiffs failed to allege a concrete harm sufficient to establish their standing to sue in federal court, Judge No\u00ebl Wise of the US District Court for the Northern District of California <a href=\"https:\/\/www.bloomberglaw.com\/public\/document\/ThelevGoogleLLCDocketNo525cv09704NDCalNov112025CourtDocket\/1?doc_id=X1J2I28RDQP8638IOGEQ5V3MMBF\" rel=\"nofollow noopener\" target=\"_blank\">said<\/a> Tuesday.<\/p>\n<p>Wise granted Google\u2019s motion to dismiss, but gave the plaintiffs leave to file an amended complaint.<\/p>\n<p>Thomas Thele and Melo Porter <a href=\"https:\/\/www.bloomberglaw.com\/public\/document\/ThelevGoogleLLCDocketNo525cv09704NDCalNov112025CourtDocket?doc_id=X1092BV3TJ38ARATR9P1ARBIQJ6\" rel=\"nofollow noopener\" target=\"_blank\">alleged<\/a> in the lawsuit that Google silently changed the settings for its Gmail, Chat, and Meet applications in October 2025, turning on its AI tool by default and allowing it to collect users\u2019 private data without their knowledge or consent.<\/p>\n<p>Users previously had been given the option of turning the AI program on, it said. Disabling the tool required users to dig into Google\u2019s privacy settings, it said.<\/p>\n<p>The lawsuit brought claims of intrusion upon seclusion; invasion of privacy under the California Constitution; and violations of the Stored Communications Act, the California Invasion of Privacy Act, and the California Computer Data Access and Fraud Act.<\/p>\n<p>The core of the plaintiffs\u2019 claims was that Google intruded into their private affairs, but Wise said they failed to allege their theory of harm with enough specificity.<\/p>\n<p>They didn\u2019t allege when they signed up for Google\u2019s services, why they chose Oct. 10, 2025, as the start date for their claims, whether the Gemini features were enabled when they created their accounts, or whether they had since disabled the features, he said.<\/p>\n<p>They also failed to identify the personal data that Google accessed or used, or show that they were at risk of future harm.<\/p>\n<p>\u201cPlaintiffs have so far only alleged that Gemini could be used to track their data,\u201d he said. \u201cThis is insufficient to allege an injury in fact.\u201d<\/p>\n<p>Adhoot &amp; Wolfson PC represents the plaintiffs and the proposed class.
