Ms Spokes told the publication she does not accept the outcome despite having been warned to expect it.<\/p>\n
Marat Ganiev, 55, was initially charged with murder in November 2024 after police discovered Ms Bell\u2019s body in a rubbish truck at a waste depot in Dandenong.<\/p>\n
It had been previously alleged Mr Ganiev killed Ms Bell in his apartment before enlisting his friend Eyal Yaffe, 59, to help remove a fridge containing her remains. <\/p>\n
The teenager had vanished about six weeks earlier after leaving her Brunswick home, with the disappearance prompting a public outcry for information. <\/p>\n
Mr Ganiev had pleaded not guilty and the charge was later downgraded to manslaughter with a trial scheduled to begin later this month.<\/p>\n
But, on Tuesday, Crown prosecutor Jeremy McWilliams announced in the Victorian Supreme Court that the charge would be withdrawn and prosecutors intended to lay a new charge of attempting to pervert the course of justice. <\/p>\n
The trial was vacated and a new summary of the allegations will be served on his lawyers within two weeks, the court was told. <\/p>\n
A separate charge of attempt to pervert the course of justice against Mr Yaffe was also withdrawn and he left the court a free man.<\/p>\n
Ms Spokes said she was at a loss to understand why the decisions had been made regarding the downgraded and dropped charge.<\/p>\n
\u201cThe community should have a chance to have a say. With no review process available, this does not meet community expectations,\u201d she said.<\/p>\n
According to Ms Spokes, the Office of Public Prosecutions (OPP) told her they had \u201cconfidence in the charge of manslaughter [against Ganiev] up until four days ago\u201d, The Age reports.<\/p>\n
\u201cWhere is the integrity of our state justice system?\u201d she asked.<\/p>\n
\u2018The aftermath\u2019<\/p>\n
Ms Bell\u2019s grandfather, David Spokes, said: \u201cAll my personal and professional life I have believed that our adversarial system of justice delivers just that \u2013 justice. No more. Our justice system is failing badly and needs reform,\u201d he said, noting police had acted with integrity and impartiality at all times.<\/p>\n
\u201cWe call on Attorney-General Sonia Kilkenny to intervene and change the system. It\u2019s time for the pendulum to swing back to support victims of violence.\u201d<\/p>\n
During a committal hearing, the Melbourne Magistrates\u2019 Court was told forensic pathologists were unable to say how Ms Bell died or whether her injuries occurred after her death. <\/p>\n
In a statement, an Office of Public Prosecutions spokeswoman said Mr Ganiev\u2019s manslaughter charge had been withdrawn \u201cas there are no reasonable prospects of conviction due to insufficient evidence to support the charge\u201d.<\/p>\n
Mr Yaffe did not comment as he left court.<\/p>\n
Outside of court, Ms Spokes shared her disappointment and spoke about the \u201ccrushing reality of life without Isla\u201d. <\/p>\n
\u201cI raised Isla to be full of compassion and care and integrity and strength,\u201d she said. <\/p>\n
\u201cMy expectations in our legal system were low, but obviously not low enough.\u201d<\/p>\n
In a statement given to The Age, Isla\u2019s close friend Isy said: \u201cI have absolutely no words. <\/p>\n
\u201cWhat does this say to girls, young women, all women?<\/p>\n
\u201cWe\u2019re just disposable. I am so heartbroken.\u201d<\/p>\n
