(ABC News: Erin Byrnes)<\/p>\n<p class=\"paragraph_paragraph___QITb\">The northern hearings have so far focused on the alleged regulatory capture of Workplace Health and Safety Queensland (WHSQ) by the CFMEU, with allegations the union used its influence over the regulator to achieve its desired outcomes.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The inquiry has previously heard this was a form of &#8220;institutional corruption&#8221; and o<a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-03-10\/qld-cfmeu-inquiry-workplace-health-safety\/106435286\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/106435286\" rel=\"nofollow noopener\" target=\"_blank\">ccurred at a time when Labor&#8217;s Grace Grace was the Minister for Industrial Relations.\u00a0<\/a><\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2026-03-10\/qld-cfmeu-inquiry-workplace-health-safety\/106435286\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Workplace safety regulator &#8216;captured&#8217; by CFMEU, inquiry hears<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">The fourth round of hearings into alleged misconduct within the construction union began in Brisbane on Tuesday.<\/p>\n<p>Asbestos planted to &#8216;shut the place down&#8217;<\/p>\n<p class=\"paragraph_paragraph___QITb\">WHSQ operations manager John Dalamaras told the inquiry he and another colleague responded to a request to inspect the Cairns Performing Arts Centre construction site on April 4, 2018.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;The CFMEU made us aware they had found some [asbestos-containing material] around the site,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Union officials were concerned it was spread over the site and were wanting us to shut the site down \u2026 [as there was a] risk of people contracting asbestosis.&#8221;<\/p>\n<p><img decoding=\"async\" alt=\"John Dalamaras speaking at a desk. \" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/05\/aa1793ddede4dc61570c702d28cf81dc.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">John Dalamaras told the inquiry he could only assume asbestos had been placed at the construction site.\u00a0 (ABC News)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Dalamaras said it had been raining in the days leading up to the site visit when the 50-cent-sized pieces of &#8220;small, bonded asbestos&#8221; were discovered.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;One particular piece we were shown was very odd as it was white. It didn&#8217;t look like it had come out of the dirt,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">He said the piece was not wet despite the rain.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;It was sitting above the track in the dirt. We found that quite off,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">He said the piece looked like it had been planted, and he could only assume it was placed there by union officials &#8220;to make out there was lots of asbestos there&#8221; and &#8220;to shut the place down&#8221; so WHSQ would take enforcement action.\u00a0<\/p>\n<p class=\"paragraph_paragraph___QITb\">When asked why the CFMEU would want to shut the site down, Mr Dalamaras said the council was in the middle of enterprise bargaining with the union at the time.<\/p>\n<p class=\"paragraph_paragraph___QITb\">He said a contractor had been engaged by the builder to remove the material and, as the area had been cordoned off, they did not hold the belief of the unions that there was a &#8220;serious risk to health and safety&#8221;.<\/p>\n<p>Credibility attacked on social media<\/p>\n<p class=\"paragraph_paragraph___QITb\">During the incident, Mr Dalamaras&#8217;s colleague, Inspector Rob Duckworth, was allegedly called a &#8220;f***ing dog&#8221; repeatedly by local CFMEU delegate Roly Cummins.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Rob was in shock, I could see that,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">He said he reported the incident to his superiors and suggested Mr Cummins be charged with intimidation under the Workplace Health and Safety Act.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Cummins was found guilty in September 2020 of intimidating an inspector at a construction site and fined $5,000, but he successfully appealed the charges in 2021.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Soon afterwards, Mr Dalamaras became aware that the CFMEU were making posts about him and Mr Duckworth on social media sites, calling them useless and attacking their credibility.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Helen Burgess liked some of the comments on there,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The inquiry previously heard evidence that Ms Burgess \u2014 who was the director of construction, compliance and field services from 2018 to 2023 \u2014 \u00a0was the primary conduit between the CFMEU and WHSQ, regularly taking calls from union officials.<\/p>\n<p><img decoding=\"async\" alt=\"Shannon Farrington speaks at a desk. \" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/05\/6779acda5307c2b0a72901e6fbb5d259.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Former operations manager Shannon Farrington gave evidence at the CFMEU inquiry in Cairns.\u00a0 (ABC News)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Former operations manager Shannon Farrington, who also gave evidence in Cairns, spoke about the times she received calls from Ms Burgess to respond to CFMEU complaints, bypassing the standard referral process.<\/p>\n<p class=\"paragraph_paragraph___QITb\">She said Ms Burgess, who was based in Brisbane, was not supposed to have control over inspectors and staff north of about Gladstone, but she and her bosses were still getting directions from her.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;I assumed she was getting real-time information from CFMEU delegates,&#8221;
