(Supplied: TasPorts)<\/p>\n<p class=\"paragraph_paragraph___QITb\">The subsequent clean-up of diesel and other pollutants that spilled into the river was extensive, and the salvage of the tugs took more than six months.<\/p>\n<p class=\"paragraph_paragraph___QITb\">State-owned TasPorts sued the ship&#8217;s owner CSL Australia for more than $20 million in compensation over the incident.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Today&#8217;s High Court ruling means that case will now continue before the Federal Court.<\/p>\n<p>Ship company seeks to limit cost\u00a0<\/p>\n<p class=\"paragraph_paragraph___QITb\">The incident unfolded as Goliath attempted to make a tight turn in Devonport&#8217;s Mersey River.<\/p>\n<p class=\"paragraph_paragraph___QITb\">In May 2022, an Australian Transport Safety Bureau (ATSB) review into the event found an <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2022-05-05\/atsb-goliath-tugboat-collision-devonport-prelim-report\/101041262\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/101041262\" rel=\"nofollow noopener\" target=\"_blank\">incorrect steering setting had been used by the ship<\/a>, which caused it to unexpectedly speed up before it made contact with the tugs.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Around the same time, TasPorts began legal action against CSL Australia in the Federal Court, seeking around $22 million, which included more than $17 million in costs for the river clean-up and salvage and disposal of the tugs.<\/p>\n<p><img decoding=\"async\" alt=\"Tugboats York Cove\u00a0and\u00a0Campbell Cove\u00a0submerged with Goliath ship in background.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/05\/66c58ccb27cdbd1317e1816591c8ea4d.webp\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Tugboats York Cove\u00a0and\u00a0Campbell Cove\u00a0were docked at the time of the incident. (Supplied: ATSB)<\/p>\n<p class=\"paragraph_paragraph___QITb\">However, a judge in the Federal Court sided with the shipping company, which argued that its liability for wreck removal costs could be limited under an international maritime convention.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The convention on the Limitation of Liability for Maritime Claims allows claims to be limited in certain circumstances, and this case was affected by an Australian decision to not adopt a section of the convention that limits liability for the raising, removal and destruction of a sunk or wrecked ship.<\/p>\n<p class=\"paragraph_paragraph___QITb\">TasPorts won an appeal before the Full Court against the single Federal Court judge&#8217;s ruling, which CSL then appealed to the High Court.<\/p>\n<p class=\"paragraph_paragraph___QITb\">On Wednesday, the High Court ruled in TasPorts&#8217; favour, saying that as Australia had opted out of the relevant parts of the convention, CSL Australia was not able to rely on them in arguing for limited liability.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;The High Court unanimously dismissed the appeal,&#8221; it said in a statement.<\/p>\n<p class=\"paragraph_paragraph___QITb\">CSL was not trying to avoid liability entirely but limit it to a figure of about $15 million.<\/p>\n<p>Loading&#8230;<\/p>\n<p class=\"paragraph_paragraph___QITb\">Maritime lawyer Chris Keane, who acted for TasPorts, said the ruling on limited liability meant his client&#8217;s initial claims will return to the Federal Court.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;The proceedings continue because there&#8217;s a dispute as to precisely how much is owed,&#8221; he said.<\/p>\n<p>&#8220;The rest of the proceeding has been in a holding pattern while (the limit liability) was resolved.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Keane said the ruling would have no bearing on whether TasPorts was ultimately successful in its pursuit of compensation.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But, he said, this ruling would provide greater certainty for port authorities and insurance companies in the future.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;We can now feel pretty confident that claims for wreck removal, certainly under Australian law, will fall outside the limitation fund.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">In a statement, TasPorts&#8217; interim chief executive Allan Gray acknowledged the High Court&#8217;s decision to dismiss CSL Australia&#8217;s appeal with costs.<\/p>\n<p class=\"paragraph_paragraph___QITb\">He said the matter had &#8220;broader implications for port operators across Australia, particularly in relation to asset protection, risk allocation and certainty for those responsible for maintaining essential port infrastructure&#8221;.<\/p>\n<p>Environmental charges in local court<\/p>\n<p class=\"paragraph_paragraph___QITb\">In a separate case, CSL Australia has been <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-04-21\/csl-australia-charges-goliath-cement-ship-tugboat-sinkings\/106588108\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/106588108\" rel=\"nofollow noopener\" target=\"_blank\">charged with unlawfully causing serious environmental harm<\/a> and causing environmental nuisance over the incident.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The charges were listed in the Devonport Magistrates Court for the first time in April.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The prosecution has alleged the crash caused the tugs to sink and release hydrocarbons into the Mersey River.<\/p>\n<p><img decoding=\"async\" alt=\"York Cove tugboat is raised\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/live-production.wcms.abc-cdn.net.au\/0d1ecae4e6d8fbb1fb3cc78bca1ab1b2?impolicy=wcms_crop_resize&amp;cropH=576&amp;cropW=864&amp;xPos=80&amp;yPos=0&amp;width=862&amp;height=575\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">The York Cove out of the water after being sunk.
