{"id":10821,"date":"2026-05-14T00:53:11","date_gmt":"2026-05-14T00:53:11","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/10821\/"},"modified":"2026-05-14T00:53:11","modified_gmt":"2026-05-14T00:53:11","slug":"coles-found-to-have-misled-shoppers-on-discounted-items-in-bombshell-federal-court-case","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/10821\/","title":{"rendered":"Coles found to have misled shoppers on discounted items in bombshell Federal Court case"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">Supermarket giant Coles broke consumer law by misleading shoppers on discount prices, a Federal Court judge has found.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The Australian Competition and Consumer Commission (ACCC) sued Coles alleging it misled shoppers with fake discounts on hundreds of common household items under its prominent &#8220;Down\u202fDown&#8221; promotional campaign.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Federal court judge Michael O&#8217;Bryan handed down his judgment in Melbourne this morning, finding that in 13 of the 14 pricing tickets submitted to the court, the discount was not genuine, and would have misled an ordinary customer.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The judge found Coles did not sell products at a higher price for at least 12 weeks before discounting them.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;I have concluded that 13 of the 14\u00a0&#8216;Down Down&#8217; tickets&#8230; were misleading because the relevant products were not sold at the &#8216;was&#8217; price stated on the ticket for a reasonable period and as a consequence the discount represented on the tickets was not genuine,&#8221;Justice O&#8217;Bryan said.\u00a0<\/p>\n<p>&#8220;Coles engaged in conduct in trade or commerce that was misleading.&#8221;<img decoding=\"async\" alt=\"A red and white sign hangs over displays of fruit in a Coles supermarket and reads &quot;great value, hands down&quot;\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/05\/526e2fdbd295b54a17c637208fdfbbfb.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/>Internal guidelines considered in judgment<\/p>\n<p class=\"paragraph_paragraph___QITb\">The ACCC took the supermarket giant to court over the prices it charged on 245 common household items including paper towels, dog food and yoghurt, under its prominent \u201cDown\u00a0Down\u201d promotion\u00a0between February 2022 and May 2023.\u00a0<\/p>\n<p class=\"paragraph_paragraph___QITb\">The consumer watchdog claimed the supermarket giant misled shoppers, by jacking up the price of an item for a short time, before putting it on a discount.<\/p>\n<p class=\"paragraph_paragraph___QITb\">It alleged shoppers\u00a0were paying the same or more than the product&#8217;s regular price, which made the discount fake or &#8220;illusory&#8221;.\u00a0\u00a0<\/p>\n<p><img decoding=\"async\" alt=\"ACCC\u2019s legal counsel Garry Rich leaving court.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/05\/2615f143b68af3077123e00b2f23495f.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">ACCC&#8217;s legal counsel Garry Rich argues that when customers see the &#8216;Down Down&#8217; promotion, they don&#8217;t know the price was &#8220;actually lower four weeks ago&#8221;.
