A man has been jailed for more than seven years over the manslaughter of a prominent Sydney surfer in a dispute over $50.<\/p>\n

Jayson Brett Dal Molin, 43, had earlier pleaded guilty to the manslaughter of Guy Haymes, who died after being assaulted in a Manly apartment in February 2024.<\/p>\n

The court heard he stripped Mr Haymes naked and held him upside down by his ankles, after beating him several times in the head.<\/p>\n

Dal Molin had accused Mr Haymes of stealing $50 he had misplaced.<\/p>\n

Dal Molin’s was jailed for seven years and six months, which was backdated to June 2024.<\/p>\n

He will be eligible for parole in March 2029.<\/p>\n

Judge Jennie Girdham on Wednesday said she found the offence to be medium to high on the scale of objective seriousness given its violent nature.<\/p>\n

“The victim was subject to acts of humiliation and was struck about his head in circumstances where he did not try to defend himself,” Judge Girdham said.<\/p>\n

“It is true that the offender did not use any weapon, but he did use his fists with devastating consequences.”<\/p>\n

She said she also had to consider the impact of Mr Haymes’s death on his family, with his brother Mark having testified to that effect.<\/p>\n

“Clearly no sentence will undo the impact of the terrible loss of the victim on his family’s life,” Judge Girdham said.<\/p>\n

“I appreciate that no sentence I can impose will ever bring the victim back \u2026 nor can it be regarded as in some way a measure of the life of the victim.”<\/p>\n

\u00a0The judge said she had to also consider Dal Molin’s experience of childhood violence, and his remorse, having decided to give evidence in the proceedings.<\/p>\n

“Remorse is a step towards atonement, but there is little he can do to ameliorate the harm of the offence,” Judge Girdham said.<\/p>\n
