{"id":24533,"date":"2026-06-04T06:00:07","date_gmt":"2026-06-04T06:00:07","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/24533\/"},"modified":"2026-06-04T06:00:07","modified_gmt":"2026-06-04T06:00:07","slug":"sacked-sydney-nurses-argue-video-showing-alleged-antisemitic-threats-was-recorded-illegally","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/24533\/","title":{"rendered":"Sacked Sydney nurses argue video showing alleged antisemitic threats was recorded illegally"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">An online video chat between an Israeli content creator and two Sydney nurses who were subsequently fired involved &#8220;stupid things said by stupid people&#8221;, a court has been told.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ahmed Rashad Nadir and Sarah Abu Lebdeh were charged following the February 2025 conversation with Max Veifer on cam chat app Chatruletka.<\/p>\n<p class=\"paragraph_paragraph___QITb\">In a video recording of the chat, which Mr Veifer posted to his social media, the pair allegedly said they refused to treat Israeli patients and made threats to kill them.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The former nurses at Bankstown Hospital have both pleaded not guilty to one charge of using a carriage service to menace, harass or offend, while Ms Abu Lebdeh has also denied a further charge of threatening violence to a group.<\/p>\n<p><img decoding=\"async\" alt=\"Israeli content creator Max Veifer as seen in social media video with a man who says he is a doctor in NSW hospital\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/06\/1780552807_497_05ad1f15290b9f7609f19eddf94241af.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Israeli content creator Max Veifer as seen in the video. (Supplied)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ahead of a trial in August, their defence lawyers have argued the video was unlawfully obtained, breaking a NSW law that prohibits the recording of a private conversation without consent.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Nadir&#8217;s counsel, Greg James KC, on Thursday told Sydney&#8217;s Downing Centre District Court that Mr Veifer had illegally recorded a private conversation between the three people.<\/p>\n<p class=\"paragraph_paragraph___QITb\">He argued that because the sound of the conversation was captured in NSW with a microphone in the state, it breached a NSW law concerning surveillance devices.<\/p>\n<p>&#8220;It doesn&#8217;t matter where you use the device, as long as it&#8217;s recording a private conversation that took place in NSW,&#8221;  he said.Privacy of recorded conversation in question<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Veifer gave evidence on Monday via video link from Israel, telling the court he would always record Chatruletka sessions for his own &#8220;protection&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But Mr James said that reasoning did not fit within a carve-out of surveillance device law which provides for some lawful justifications.<\/p>\n<p class=\"paragraph_paragraph___QITb\">He said the influencer was intentionally seeking out people with views opposing his own on Chatruletka, hoping to record and upload the conversations to his followers.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;This man is running, in effect, vigilante activity,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;He&#8217;s seeking to draw out the opinions. Having succeeded in drawing them out, he&#8217;s not protecting himself from them, he&#8217;s capitalising on them.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">The barrister argued the video was protected by Chatrouletka&#8217;s terms, obtained through deception of those terms and in breach of local law, and said Mr Veifer could not have believed what was said amounted to an actual confession.<\/p>\n<p>&#8220;It was plainly stupid things said by stupid people.&#8221;Israeli content creator might give evidence in person<\/p>\n<p class=\"paragraph_paragraph___QITb\">Justin Hannebery KC, representing the Crown, said even if the conversation was deemed to have been private, &#8220;not all private conversations are created equal&#8221; and the expectation of privacy may differ with the context of the situation.<\/p>\n<p class=\"paragraph_paragraph___QITb\">He said Chatrouletka connected &#8220;complete strangers&#8221; online.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;It isn&#8217;t exactly with a close personal friend, where that expectation might be regarded as absolutely heightened.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Hannebery also argued the use of a listening device in another country where the &#8220;only reason it is used&#8221; is to connect on a random chat website stretched the application of NSW law.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;That&#8217;s the equivalent of saying, &#8216;I used the microphone Mick Jagger is using if I go to a Rolling Stones concert&#8217;,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Hannebery told the judge that if Mr Veifer was required to give evidence in the trial, &#8220;the plan is&#8221; for him to travel from Israel to appear in person.<\/p>\n<p class=\"paragraph_paragraph___QITb\">That issue, however, would be put to the side until the court ruled on the legality of the video recording.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Judge Micheal McHugh will deliver that decision on June 23.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Outside court, Mr Nadir&#8217;s lawyer Zemarai Khatiz said that if the video was excluded from the case, it would be &#8220;a devastating blow to the prosecution&#8217;s case&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ms Abu Lebdeh&#8217;s lawyer, Rayan Kadadi, said the court had &#8220;a big question to decide&#8221; when it considered whether or not the video was illegally obtained.<\/p>\n","protected":false},"excerpt":{"rendered":"An online video chat between an Israeli content creator and two Sydney nurses who were subsequently fired involved&hellip;\n","protected":false},"author":2,"featured_media":24534,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[5],"tags":[21259,22731,22728,21256,21264,1109,6966,22729,21257,596,21258,247,22730,13297],"class_list":["post-24533","post","type-post","status-publish","format-standard","has-post-thumbnail","category-sydney","tag-ahmad-rashad-nadir","tag-antisemitic-nurses","tag-bankstown-nurses","tag-bankstown-lidcombe-hospital","tag-chatruletka","tag-court","tag-downing-centre-local-court","tag-israeli-patients","tag-max-veifer","tag-nsw","tag-sarah-abu-lebdeh","tag-sydney","tag-sydney-nurses","tag-threats"],"_links":{"self":[{"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/posts\/24533","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/comments?post=24533"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/posts\/24533\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/media\/24534"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/media?parent=24533"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/categories?post=24533"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/tags?post=24533"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
