{"id":24745,"date":"2026-06-04T10:30:36","date_gmt":"2026-06-04T10:30:36","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/24745\/"},"modified":"2026-06-04T10:30:36","modified_gmt":"2026-06-04T10:30:36","slug":"greens-david-pocock-demand-chalmers-wind-back-tax-bill-powers","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/24745\/","title":{"rendered":"Greens, David Pocock demand Chalmers wind back tax bill powers"},"content":{"rendered":"<p>Nearly three weeks after unveiling <a class=\"body-link\" href=\"https:\/\/www.theaustralian.com.au\/nation\/politics\/treasury-chief-jenny-wilkinsons-blunt-message-to-aussies-hit-by-budget-tax-increases\/news-story\/14707e131be6f43c855e0ae33552ebd5\" data-tgev=\"event119\" data-tgev-container=\"bodylink\" data-tgev-order=\"14707e131be6f43c855e0ae33552ebd5\" data-tgev-label=\"nation\" data-tgev-metric=\"ev\" rel=\"nofollow noopener\" target=\"_blank\">the plan to raise nearly $88bn through changes to negative gearing, CGT and trusts<\/a>, \u00adAnthony Albanese finally introduced the first tranche of tax \u00adlegislation to parliament and \u00addeclared his new system would cement Labor as the party of aspiration and reform. <\/p>\n<p>But both the Greens and independent senator David Pocock said the high level of ministerial discretion in the Treasurer\u2019s new tax bill was a concern and that it left Dr Chalmers with the ability to fundamentally alter the laws after they are voted on by parliament. <\/p>\n<p>The Australian on Tuesday <a class=\"body-link\" href=\"https:\/\/www.theaustralian.com.au\/nation\/politics\/jim-chalmers-will-have-final-tax-discretion\/news-story\/d4ec4d04efc0e346d6be856a48fe5db3\" target=\"_self\" data-tgev=\"event119\" data-tgev-container=\"bodylink\" data-tgev-order=\"d4ec4d04efc0e346d6be856a48fe5db3\" data-tgev-label=\"nation\" data-tgev-metric=\"ev\" rel=\"nofollow noopener\">\u00adreported that the new legislation contained nine ministerial \u00addiscretions<\/a> allowing Dr Chalmers to change the rules at any point in\u00a0the future. The move has \u00adreceived wide-ranging criticism from top silks, tax partners and \u00adaccounting experts.<\/p>\n<p><img decoding=\"async\" class=\"poster-img\" src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/06\/c208c285a9c4e16733db6999e90f87e7.jpeg\" data-sctrack=\"op-poster-img\" alt=\"\u2018Check the numbers\u2019: Jim Chalmers calls out Tim Wilson over productivity claims\" fetchpriority=\"high\"\/><\/p>\n<p>Greens Treasury spokesman Nick McKim, whose party chaired a parliamentary inquiry into CGT reform, told The Australian on Wednesday that including such powers could determine whether the Greens voted against the bill. <\/p>\n<p>\u201cWe aren\u2019t talking about minor tweaks and adjustments here,\u201d Senator McKim said.<\/p>\n<p>\u201cThe Treasurer would have the power to fundamentally alter these tax changes after it \u00adbecame\u00a0law.\u201d<\/p>\n<p>\u201cIt is a concern to the Greens and it is something we want to explore in the upcoming inquiry.\u201d<\/p>\n<p>Dr Chalmers repeatedly said that the response to the high level of discretionary powers was \u201ca beat-up\u201d and pointed to previous politicians\u2019 use of such powers.<\/p>\n<p> \u201cThis is another beat-up, unfortunately,\u201d Dr Chalmers told the Nine Network on Tuesday.<\/p>\n<p>The Albanese government has already moved to minimise scrutiny of its tax bill by allowing just two days of public hearings into its overhaul of the CGT and negative gearing changes, before forcing legislation through the Senate by early July.<\/p>\n<p>With <a class=\"body-link\" href=\"https:\/\/www.theaustralian.com.au\/nation\/australia-risks-business-exodus-to-new-zealand-over-new-capital-gains-tax-rules\/news-story\/01d451992be10c828a0c6bde8eb40205\" data-tgev=\"event119\" data-tgev-container=\"bodylink\" data-tgev-order=\"01d451992be10c828a0c6bde8eb40205\" data-tgev-label=\"nation\" data-tgev-metric=\"ev\" rel=\"nofollow noopener\" target=\"_blank\">crossbenchers, business leaders and young investors across the country questioning the budget<\/a>, the Prime Minister in parliament again called critics of his government\u2019s tax plan \u201callies\u201d of the Liberals, Nationals and One Nation. <\/p>\n<p> \u201cThe three right-wing parties and their allies \u2014 we saw some of\u00a0the commentary of the \u00adallies\u00a0this morning \u2013 want people to earn less, and they oppose \u00adincome-tax cuts,\u201d Mr Albanese said on Wednesday.<\/p>\n<p>\u201cThis legislation makes our tax system work better for these 13\u00a0million Australians by returning more of the money that they earn.\u201d<\/p>\n<p>Senator Pocock, who sits on the Senate\u2019s powerful committee for the scrutiny of delegated legislation, said he would also push back against the high level of ministerial discretion. <\/p>\n<p>\u201cThe Albanese government has gone to extraordinary lengths \u00adtrying to avoid parliamentary scrutiny of these significant reforms to our tax system,\u201d Senator Pocock said. <\/p>\n<p>\u201cI am particularly concerned at the record level of ministerial discretion the Treasurer has sought to award himself in this legislation.<\/p>\n<p>Senator Pocock said that although he had campaigned for and supported changes to the CGT as it related to residential property, he believed there had not been any \u201cmeaningful engagement with the community about changes to taxation on other asset classes\u201d. <\/p>\n<p>\u201cThis bill as drafted gives the Treasurer the power to issue instruments in the future, without legislation, that would make fundamental changes, such as which asset classes are covered,\u201d he said.\u00a0<\/p>\n<p>The Treasurer will be able use legislative instruments to make highly consequential changes to new negative gearing and CGT laws. Among the choices the Treasurer will have are decisions on which assets keep CGT discounts and whether a home counts as a \u201cnew build\u201d into the future.<\/p>\n<p>Motions against the Treasurer\u2019s legislative intruments can be made by those who oppose them but such changes don\u2019t carry the same public scrutiny as a change to a bill. Motions against must also be made within a limited number of days. <\/p>\n<p>Dr Chalmers has said other major tax reform throughout history has involved a lot of change. <\/p>\n<p>\u201cIf you compare that with other episodes of substantial tax reform it\u2019s not unusual for there to be multiple rounds of legislation or for legislative instruments to be used,\u201d the Treasurer said.<\/p>\n<p>Eight of the discretionary measures relating to taxes on investment cover the definition of a new dwelling, the application of the apportionment method, the additional CGT asset classes for 50 per cent discount, income support payment exemptions from the minimum CGT and a host of other quarantining and other housing definitions. <\/p>\n<p>Legal, tax and accounting professionals blasted Dr Chalmers this week for including the record number of ministerial discretions on what are the most consequential tax changes in decades, criticising the government for including the powers because the rushed changes were not yet properly thought through. <\/p>\n<p>K&amp;L Gates tax partner Stuart Broadfoot said he thought the reason the government \u201cleft it to ministers to decide\u201d was because \u201cthey\u2019re not ready, and the legislation\u2019s not ready, and they\u2019re trying to ram it through\u201d.<\/p>\n<p>After Labor last year won a large majority by securing 94 of the 150 House of Representatives seats, Mr Broadfoot added: \u201cI assume they have the political space to do it now, and they\u2019re worried that if they wait, then they won\u2019t
