{"id":34921,"date":"2026-06-20T05:18:11","date_gmt":"2026-06-20T05:18:11","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/34921\/"},"modified":"2026-06-20T05:18:11","modified_gmt":"2026-06-20T05:18:11","slug":"melville-council-advertises-new-tree-planning-policy-to-regulate-trees-on-private-property","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/34921\/","title":{"rendered":"Melville council advertises new tree planning policy to regulate trees on private property"},"content":{"rendered":"<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Privately owned trees in the City of Melville could be more strictly protected by a new local planning policy.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">The draft policy was presented at Tuesday\u2019s council meeting. It follows a WA Local Government Association format and aims to retain more trees across the city and protect urban canopy.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Councillors voted 6-5 to send the tree policy out for public advertising. The results from a public consultation will be presented to the council for final consideration and adoption.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">As part of the policy, development approval would be required for any resident causing \u201ctree damaging activity\u201d to a regulated tree.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Regulated trees are those that are at least 8m high, have an average canopy diameter of at least 6m or a trunk circumference of at least 1.5m. This also includes trees that were required to be planted as replacements to offset tree loss from developments.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Tree damaging activities include works under the planning and development regulations, such as removing trees, lopping large branches and causing root damage.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Exemptions may be granted if the tree is a palm tree, cypress tree or fruit tree, or if the damage is deemed \u201curgently necessary\u201d for public safety or protection of property.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">The draft policy has caused a stir across the local community and councillors, with some wanting to protect mature trees at all costs, and others questioning government \u201coverreach\u201d by regulating activity on private property.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Cr Michael McGoldrick presented an alternative motion to council suggesting it did not proceed with the officer\u2019s recommendation to endorse the policy. It was lost 5-6.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cWe all wholeheartedly agree with the benefits of trees for a cooling canopy as well as encouraging animal life. However, I\u2019ve listened to the community and their message is clear \u2013 they do not agree with council regulating trees on privately owned land,\u201d he said.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cIt\u2019s unfair to families, it\u2019s unreasonable to expect ratepayers to fund implementing this policy, and thirdly it\u2019s unnecessary because we already have a sound planning policy that encourages sustainable development.\u201d<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">The new policy would require additional council resources, including two full-time staff costing about $200,000 each year.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Cr Nicole Robins suggested it would be hypocritical for the city to regulate private trees, given councillors voted against planting mandatory verge trees in December last year.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cIt\u2019s a complete double standard for us to say on one hand, that we\u2019re not going to use our land &#8211; council verges &#8211; to increase urban canopy, but we will instead &#8230; expect you to do it with yours,\u201d she said.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Cr Karen Wheatland raised concerns about time wasting and the extra costs associated with not supporting the officer\u2019s recommendation to advertise a policy that had taken significant resources to draft.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cThe decision tonight is not about whether or not landowners will have to go and fight for their trees on their property, this is about advertising the draft policy we\u2019ve worked on for some time based on community feedback,\u201d she said.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cIt will give the community the opportunity to give their views on that.\u201d<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Cr Scott Green emphasised the council was not voting on personal views, but simply the opportunity to advertise the policy to the public and come up with a solution.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cWe need to acknowledge the officer\u2019s recommendation for the proposed policy is an accurate reflection of the discussions we\u2019ve already had, the feedback we\u2019ve received and the process we\u2019ve followed so far,\u201d he said.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">The recommended policy will now be released for public feedback.<\/p>\n","protected":false},"excerpt":{"rendered":"Privately owned trees in the City of Melville could be more strictly protected by a new local planning&hellip;\n","protected":false},"author":2,"featured_media":34922,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[2],"tags":[22,21,3683,1774,13283,152,335,149,4316,464],"class_list":["post-34921","post","type-post","status-publish","format-standard","has-post-thumbnail","category-australia","tag-au","tag-austrlia","tag-environment","tag-local-government","tag-melville","tag-news","tag-perth","tag-politics","tag-south","tag-wa-news"],"_links":{"self":[{"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/posts\/34921","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/comments?post=34921"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/posts\/34921\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/media\/34922"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/media?parent=34921"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/categories?post=34921"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/tags?post=34921"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
