{"id":3625,"date":"2026-05-02T23:57:24","date_gmt":"2026-05-02T23:57:24","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/3625\/"},"modified":"2026-05-02T23:57:24","modified_gmt":"2026-05-02T23:57:24","slug":"retiring-act-chief-magistrate-lorraine-walker-on-mistakes-rehabilitation-and-compassion","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/3625\/","title":{"rendered":"Retiring ACT chief magistrate Lorraine Walker on mistakes, rehabilitation and compassion"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">In the middle of a morning court session, then-ACT chief magistrate Lorraine Walker unexpectedly stood and walked off the bench.<\/p>\n<p class=\"paragraph_paragraph___QITb\">She was overcome with emotion, having just formally wrapped up a case for a woman who had died.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Heart is not something anyone expects from the court system, especially in these days of calls for tougher penalties and tighter bail laws.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But that was something Lorraine Walker, <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2011-10-13\/new-act-chief-magistrate\/3570012\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/3570012\" rel=\"nofollow noopener\" target=\"_blank\">the ACT&#8217;s first female chief magistrate<\/a>, aimed to portray.<\/p>\n<p class=\"paragraph_paragraph___QITb\">She was appointed as a magistrate in 2010, and sworn in as chief magistrate in 2011, coming to the job after a career in England and as a military lawyer.<\/p>\n<p class=\"paragraph_paragraph___QITb\">To her, putting someone in jail and throwing away the key is not the best option when rehabilitation could better protect the community.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;They will come out,&#8221; she said.<\/p>\n<p>&#8220;And if they come out brutalised, [with] the issues that cause their offending not addressed, you&#8217;ll just see worse and more crime.&#8221;<img decoding=\"async\" alt=\"The exterior of a concrete court building.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/05\/9eadc49925060ffed75d1bd98626ce26.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Former ACT chief magistrate Lorraine Walker says rehabilitation is more effective to improve community safety than prison sentences. (ABC News: Matt Roberts)<\/p>\n<p class=\"paragraph_paragraph___QITb\">But make no mistake, former chief magistrate Walker was no softie, and presided over multiple high-profile cases, including that of former federal parliamentary speaker Peter Slipper, who Ms Walker <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2014-09-24\/peter-slipper-sentencing-hearing\/5759326\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/5759326\" rel=\"nofollow noopener\" target=\"_blank\">found guilty of three counts of dishonesty over the misuse of his Cabcharge allowance<\/a>.\u00a0<\/p>\n<p class=\"paragraph_paragraph___QITb\">It was alleged he used the allowance to visit wineries in the Canberra region in 2010, costing around $900.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Slipper was sentenced to 300 hours of community service, but his conviction was later <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2015-02-26\/peter-slipper-wins-cabcharge-taxi-conviction-appeal\/6262018\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/6262018\" rel=\"nofollow noopener\" target=\"_blank\">overturned in an appeal by the ACT Supreme Court<\/a>.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But one of her biggest tasks, which delivered her longest-running cases, was as the chief coroner on inquiries as diverse as <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2025-06-13\/coronial-inquiry-into-orroral-valley-bushfire-outside-act\/105412176\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/105412176\" rel=\"nofollow noopener\" target=\"_blank\">the 2020 Orroral Valley Fire<\/a> and <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-02-14\/act-coronor-apologises-delay-report-david-wood-antarctica\/106344760\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/106344760\" rel=\"nofollow noopener\" target=\"_blank\">the death of a Canadian helicopter pilot, David Wood<\/a>, who fell into a crevasse on the Western Ice Shelf in Antarctica.<\/p>\n<p>&#8216;Sometimes you get it wrong&#8217;<\/p>\n<p class=\"paragraph_paragraph___QITb\">During her tenure, the ACT courts have gone through a period of enormous change as the workload grew, and the number of magistrates increased to 10.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Even the building was extended to accommodate a busier Supreme Court.<\/p>\n<p class=\"paragraph_paragraph___QITb\">With that, has come increasing criticism from the public domain about leniency, particularly around bail applications.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Lorraine Walker is the first to admit it is a difficult task.<\/p>\n<p>&#8220;We get it wrong sometimes. That&#8217;s the reality,&#8221;  she said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;It&#8217;s a risk assessment that you carry out with limited information, with some considerations that must be taken into account and usually over a very short time frame.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Sometimes you get it wrong, and sometimes that is a source of regret.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">She conceded high-profile cases where there was tragic reoffending were damaging, but said the integrity of the system would only be maintained if judicial officers had a wide discretion.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;It&#8217;s really important that the courts be allowed to perform their role, [and laws] not be simply a response to concerns of the public who may not fully appreciate what the function of bail is, what the considerations for bail are,&#8221; former chief magistrate Walker said.<\/p>\n<p><img decoding=\"async\" alt=\"A magistrate in court\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/05\/64e2682b44ece804f35d468308a9e5f9.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Lorraine Walker retired from the role of ACT chief magistrate in March. (ABC News: Tobias Hunt)<\/p>\n<p>Challenging to divert young people from justice system<\/p>\n<p class=\"paragraph_paragraph___QITb\">If there is one area that frustrated Lorraine Walker most, it was the ACT Children&#8217;s Court.<\/p>\n<p class=\"paragraph_paragraph___QITb\">She said it was increasingly busy, despite <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2025-06-30\/act-raises-age-of-criminal-responsibility-to-14\/105474436\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/105474436\" rel=\"nofollow noopener\" target=\"_blank\">the increase in the age of criminal responsibility<\/a>, and was dealing with very complex matters.<\/p>\n<p class=\"paragraph_paragraph___QITb\">In recent times, that has included several children charged with murder, and two young men charged in relation to violent extremist material.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Former chief magistrate Walker said there were few options for diverting young people in trouble, particularly because Canberra is a small jurisdiction.<\/p>\n<p class=\"paragraph_paragraph___QITb\">She said she had not done the figures, but the outcomes were bad.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;I sat for a couple of years in the Children&#8217;s Court, almost exclusively, and I dealt with many of those young people that I had sentenced in the Children&#8217;s Court as adults,&#8221; Lorraine Walker said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;By the time they get to the criminal justice system, it&#8217;s often too late to be very effective in changing their trajectory.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;[That] is why the Children&#8217;s Court, in its care and protection jurisdiction, is so important.&#8221;<\/p>\n<p>Lack of &#8216;up-fronting&#8217; causing delays<\/p>\n<p class=\"paragraph_paragraph___QITb\">Lorraine Walker is the first to defend the system, but she conceded there were many shortcomings.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The former chief magistrate said she was not criticising the ACT Office of the Director of Public Prosecutions, but a greater emphasis by prosecutors and lawyers on cases earlier in the process could prevent long delays.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;A lot of the work is done quite late in the piece,&#8221; former chief magistrate Walker said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;So matters that, if they could have been considered earlier might have taken a different course, are either resolved earlier, or even not proceeded at all, if the evidence did not support that.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;It doesn&#8217;t happen until later because there is not that up-fronting of the work.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">Clearly, being the chief magistrate has its challenges, but Lorraine Walker said there were days that brought joy when people with significant problems were able to turn the corner.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;It&#8217;s such a cliche,&#8221;
