{"id":38777,"date":"2026-06-26T01:36:28","date_gmt":"2026-06-26T01:36:28","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/38777\/"},"modified":"2026-06-26T01:36:28","modified_gmt":"2026-06-26T01:36:28","slug":"labor-to-scrap-its-widows-tax-for-negative-gearing-cgt-changes-after-independent-senator-david-pocock-raised-concerns","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/38777\/","title":{"rendered":"Labor to scrap its widows tax for negative gearing, CGT changes after independent senator David Pocock raised concerns"},"content":{"rendered":"<p>Labor is making another change to its controversial tax legislation as backlash over the laws has forced the government to back down again on its budget reforms.<\/p>\n<p>Treasurer Jim Chalmers will axe elements of the government&#8217;s negative gearing and capital gains tax changes, which would have impacted divorcees and widows.<\/p>\n<p>Dubbed the &#8220;widows tax&#8221;, the measure would have scrapped grandfathering exemptions for those property tax changes in the case of a divorce or a death.<\/p>\n<p>This was expected to impact about 680,000 properties owned before Mr Chalmers\u2019 budget address.<\/p>\n<p>Finance Minister Katy Gallagher confirmed Labor was scrapping the &#8220;widows tax&#8221;.<\/p>\n<p>It came after independent Senator David Pocock said he would seek to amend the legislation.<\/p>\n<p>\u201cWe have made clear from the get-go &#8230; that we were aware that there would be tranches of legislation \u2026 that would require us to work through some particular and specific interactions of tax law in subsequent legislation,\u201d Ms Gallagher told the Senate.<\/p>\n<p>\u201cWe were aware of some of the issues that Senator Pocock is raising around grandfathering and shared ownership.<\/p>\n<p>&#8220;And we were working through them in the usual way, and we intend to address these, the arrangements for jointly owned assets in circumstances like inheritance, or divorce in subsequent legislation.\u201d<\/p>\n<p>This marks the latest backdown in Labor\u2019s plans to scrap the 50 per cent CGT discount and restrict negative gearing to new builds and properties purchased before budget night.<\/p>\n<p><a class=\"body-link\" href=\"https:\/\/www.skynews.com.au\/australia-news\/politics\/anthony-albanese-and-jim-chalmers-soften-impact-of-capital-gains-tax-for-small-businesses-following-sector-backlash\/news-story\/11b4531fcf3d6678dab0164643f37b5d\" rel=\"noopener nofollow\" target=\"_blank\" data-tgev=\"event119\" data-tgev-container=\"bodylink\" data-tgev-order=\"11b4531fcf3d6678dab0164643f37b5d\" data-tgev-label=\"australia-news\" data-tgev-metric=\"ev\">Labor has carved out businesses earning less than $10 million annually<\/a> from its CGT change.<\/p>\n<p>To get the legislation through, the Albanese government struck a deal with the Greens to <a class=\"body-link\" href=\"https:\/\/www.skynews.com.au\/australia-news\/politics\/albanese-government-strikes-deal-with-greens-leader-larissa-waters-on-tax-hike-in-exchange-for-ndis-inquiry\/news-story\/9753896a7780094cc00f011eac846e98\" rel=\"noopener nofollow\" target=\"_blank\" data-tgev=\"event119\" data-tgev-container=\"bodylink\" data-tgev-order=\"9753896a7780094cc00f011eac846e98\" data-tgev-label=\"australia-news\" data-tgev-metric=\"ev\">ban borrowing in self-managed super funds<\/a> for purchasing investment properties.<\/p>\n<p>It also wound back provisions that would have given the Treasurer discretionary powers over the taxes after they had been legislated.<\/p>\n<p>The government was also forced to exempt testamentary trusts from its plans to impose a 30 per cent tax on discretionary trusts.<\/p>\n<p>The &#8220;widows tax&#8221; came to light after Treasury officials confirmed during Senate Estimates that in the event of a transfer of an interest the &#8220;new owner &#8230; would no longer benefit from the exemption\u201d.<\/p>\n<p>Mr Pocock said this would mean some Australians would lose \u201clegitimate access\u201d to grandfathered exemptions and vowed to move an amendment ensuring they remain in place.<\/p>\n<p>\u201c(The amendment) allows the transferee to choose to apply the same concession to a later capital gain that the transferee would have been entitled to apply immediately before the transfer,\u201d he said.<\/p>\n<p>The senator also attacked the government&#8217;s messaging on the tax changes which he described as &#8220;disappointing&#8221;.<\/p>\n<p>&#8220;They\u2019re saying that this is something that they knew about all along, and we\u2019re going to address, and yet just this morning we had ministers on radio saying that it wasn\u2019t an issue, it was just how the system worked, and there was nothing to see here,\u201d Mr Pocock said.<\/p>\n<p>\u201cI appreciate the minister\u2019s commitment on this but some of it\u2019s hard to comprehend.<\/p>\n<p>&#8220;You really scramble to get stuff drafted and talked about &#8230;
