{"id":43167,"date":"2026-07-02T22:09:08","date_gmt":"2026-07-02T22:09:08","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/43167\/"},"modified":"2026-07-02T22:09:08","modified_gmt":"2026-07-02T22:09:08","slug":"victims-blindsided-by-moratorium-on-all-cases-against-christian-brothers-lawyers-say","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/43167\/","title":{"rendered":"Victims &#8216;blindsided&#8217; by moratorium on all cases against Christian Brothers, lawyers say"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">Lawyers for victims of abuse at the hands of the Christian Brothers say they have been &#8220;blindsided&#8221; and &#8220;old wounds&#8221; have been re-opened by a moratorium on all cases against the religious order.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The NSW Supreme Court on Thursday granted the Trustees of the Christian Brothers<a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-07-02\/christian-brothers-court-moratorium-on-abuse-victim-payouts\/106869292\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\"> a moratorium on all cases nationally,<\/a> pending approval of a court-appointed creditor&#8217;s scheme that would distribute funds to the organisation&#8217;s creditors, including victims of abuse.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The court had heard the Christian Brothers had $23 million in cash and was losing about $1.7 million a week since October to victim payouts.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Under the moratorium, all current cases will be paused, including claims that have been settled but are yet to be paid out.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Head of Abuse Law at Slater and Gordon Lawyers, Stephanie Brown, said the court&#8217;s decision had thrown abuse survivors into uncertainty.<\/p>\n<p><img decoding=\"async\" alt=\"External images of a church-owned property.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/07\/92b40c473df29db61f2e0d3e3a4eaa2d.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">The court\u2019s decision has thrown abuse survivors into uncertainty. (ABC News: Floss Adams)<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Many survivors have told us it feels as though their suffering is being extended and old wounds are being reopened,&#8221; she said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;When institutions that presided over child abuse ask a court to freeze claims and channel compensation through a limited fund, there is a real risk of a new form of institutional harm: one that undermines hard-won outcomes and treats survivors&#8217; claims as just another liability to be managed.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;We call for the Christian Brothers to take accountability and responsibility for their actions and we await the findings of the actuarial report.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Survivors must not be silenced or short-changed.&#8221;<\/p>\n<p>&#8216;A win&#8217; in moratorium carve-outs<\/p>\n<p class=\"paragraph_paragraph___QITb\">The moratorium applies to all claims nationally, with all cases effectively on pause until a hearing in September to determine how the creditor&#8217;s scheme would operate.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But barrister for the Trustees of the Christian Brothers, David Sulan SC, told the court on Thursday there would be &#8220;carve-outs&#8221; that would allow impacted parties to seek leave to vary the moratorium.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;There are ongoing protections for interested parties that are affected by the moratorium,&#8221; he argued.<\/p>\n<p><img decoding=\"async\" alt=\"a woman wearing red glasses sitting staring at the camera\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/07\/6bb1489c41ce3cf4366ae82e469b1c3f.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Judy Courtin questions why the Christian Brothers\u00a0did not suggest carve-outs from the beginning. (Supplied: Judy Courtin)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Lawyer and advocate Judy Courtin said victims were &#8220;blindsided&#8221; by the application for a moratorium but described the carve-outs as a win.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Today&#8217;s hearing was a real win for all victim survivors of the sexual assaults and rapes by Christian brothers,&#8221; she said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;But why didn&#8217;t the Christian Brothers make this suggestion [of the carve-out] at the very beginning?
