{"id":44023,"date":"2026-07-04T03:05:20","date_gmt":"2026-07-04T03:05:20","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/44023\/"},"modified":"2026-07-04T03:05:20","modified_gmt":"2026-07-04T03:05:20","slug":"mandated-duty-of-care-for-social-media-platforms-still-years-away-antisemitism-royal-commission-hears","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/44023\/","title":{"rendered":"Mandated duty of care for social media platforms still years away, antisemitism royal commission hears"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">A mandated digital duty of care for social media platforms remains more than 18 months away, despite a 2024 online safety law review recommending its implementation.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Public servant Delia Rickard was appointed to examine the Online Safety Act in November 2023, making 67 recommendations in late 2024 after a year-long consultation and review process.<\/p>\n<p class=\"paragraph_paragraph___QITb\">It included a recommendation to implement a digital duty of care requiring social media platforms to proactively and effectively manage the risk of harm to platform users.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The Royal Commission on Antisemitism and Social Cohesion on Friday examined the government and departmental response to the review and the status of the implementation of recommendations.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Counsel assisting Richard Lancaster SC asked Sarah Vandenbroek from the Department of Infrastructure to explain why it had taken 18 months for the government to issue its review response, which was published in April this year.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Do you consider the branch that you lead was not adequately resourced to manage platform policy in a timely way because it took that 18-month period to develop a governmental response to the Rickard review?&#8221; Mr Lancaster put to Ms Vandenbroek.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ms Vandenbroek rejected the suggestion.<\/p>\n<p>&#8220;We had an election during that period which meant a change in minister,&#8221;  he said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;A lot of the work that was done when the report was first handed over was redone with the new office to make them aware of the recommendations and the content, which is quite extensive.&#8221;<\/p>\n<p>&#8216;Urgent need&#8217;<img decoding=\"async\" alt=\"Ms Vandenbroek with long blonde hair sits at a desk with microphones in front of her.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/07\/b50c79adda27ac51e8226d5c059d2ee9.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Ms Vandenbroek says she accepts there is an urgent need for a better regulated online environment for the Jewish community&#8217;s protection. (ABC News)<\/p>\n<p class=\"paragraph_paragraph___QITb\">The commission heard that as of January this year, it was expected the digital duty of care would be another two years away.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Lancaster put to Ms Vandenbroek that members of the Jewish community, including the Special Envoy to Combat Antisemitism Jillian Segal, were frustrated by the lengthy timeline due to the significant impact of online hate on Jewish Australians.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Lancaster presented Ms Vandenbroek with an email from the eSafety commissioner that included concerns from Ms Segal about the fact the digital duty of care recommendation could take two years to implement.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ms Vandenbroek said she was aware an officer had been appointed to draft the legislation required for the digital duty of care, with the bill expected to be introduced at the end of the year.<\/p>\n<p class=\"paragraph_paragraph___QITb\">She said it would take another 12 months after that for the legislation to come into effect.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Does the department accept there is an urgent need for a better regulated online environment for the protection of the Jewish community specifically and the community more broadly?&#8221; Mr Lancaster put to Ms Vandenbroek.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Yes we do accept that,&#8221; she said in response.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The Rickard review also recommended a definition of online hate be developed and included in the Online Safety Act, which had not yet occurred.<\/p>\n<p>[<img decoding=\"async\" alt=\"A police officer in uniform stands near a sign for the Royal Commission on Antisemitism.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/07\/8b3deed11fe5c8ce64c72f48911e2dfb.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">The Royal Commission on Antisemitism and Social Cohesion has entered the third block of hearings. (ABC News: Abbey Haberecht)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Anthropic general manager for Australia, Theo Hourmouzis, told the hearing the company tested more than 50,000 user conversations with Claude last month, and only five contained requests for antisemitic material to be generated.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Of those, just one was not recognised by Claude.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Hourmouzis said the other prompts would have been met with a series of responses from the chatbot.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Its first response is a redirect, trying to educate the user on going down a different path or topic.
