{"id":5285,"date":"2026-05-05T21:46:08","date_gmt":"2026-05-05T21:46:08","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/5285\/"},"modified":"2026-05-05T21:46:08","modified_gmt":"2026-05-05T21:46:08","slug":"canning-council-reveals-decision-on-bikie-gangs-motorcycle-themed-mens-shed-application","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/5285\/","title":{"rendered":"Canning council reveals decision on bikie gang\u2019s \u2018motorcycle-themed men\u2019s shed\u2019 application"},"content":{"rendered":"<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Canning council has knocked back a notorious bikie gang\u2019s request to turn their local clubhouse into a \u201cmotorcycle-themed men\u2019s shed\u201d.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\"><a class=\"css-445i33-StyledTextLink ezegcyi0\" data-link-type=\"article-inline\" target=\"_blank\" href=\"https:\/\/www.perthnow.com.au\/\" rel=\"nofollow noopener\">PerthNow<\/a> reported in late February that the Bandidos Perth Chapter had lodged the development application with the City of Canning, seeking retrospective approval of its clubhouse on Kembla Way in Willetton.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">The application was made after a police raid in May last year that drew the attention of council authorities.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Former police officer, turned Canning mayor, Patrick Hall, strongly objected to the gang\u2019s application at the time.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Councillors voted unanimously to reject the Bandidos\u2019 development application at last week\u2019s council meeting, after debating an item to reconsider the club\u2019s application. The city received 67 public submissions on the application &#8211; 64 of them objected to the club\u2019s proposal.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Mr Hall disclosed an impartiality interest in the item due to his past comments.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cPrevious comments I\u2019ve made publicly in relation to the Bandidos\u2019 outlaw motorcycle club may be perceived by others as demonstrating a degree of apprehended bias. That\u2019s not the case,\u201d he said.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cI\u2019m fully aware and accepting of my responsibility to deal with all planning matters in a quasi-judicial manner, having regard only to the facts of the matter and assessing them against the relevant planning framework.\u201d<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">He urged councillors to support the officer\u2019s recommendation to refuse the application.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cThe officer\u2019s recommendation has appropriately considered the impacts on amenity of residential properties within close proximity of the site, and (it) aligns and responds to the views received from the community during the advertising process,\u201d he said.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cThe proposed development is incompatible with the intended future character of the locality, and will have a significant detrimental impact on surrounding land.\u201d<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">According to the report, the club premises would accommodate up to 100 patrons with proposed 24-hour weekend operations.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Cr Michelle Hurn said controlling the behaviour of this many people, particularly with alcohol involved, was \u201cunrealistic\u201d.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cThere is no genuine and binding commitment to manage noise once the application is approved,\u201d she said.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cResponsibility then falls on local residents and the city officers to manage noise compliance.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cIf the premises were on the opposite side of the road, the application would have been stronger as the proximity to residential housing is the key issue in my consideration.\u201d<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/05\/117158265681ab61f297bed4e297fc942e7614da.jpg\" alt=\"Plans submitted by the Bandidos OMCG for its \u2018motorcycle-themed mens shed\u2019 clubhouse at Willetton. Picture: unknown\" class=\"css-16r7l45-StyledImage en5ut4d0\"\/>Camera IconPlans submitted by the Bandidos OMCG for its \u2018motorcycle-themed mens shed\u2019 clubhouse at Willetton. unknown Credit: unknown\/supplied<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">The club, accused of leading police on a dangerous freeway pursuit earlier this year, made the request in a desperate bid to stop its club house from being shut down.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">In January, the club saw 18 members charged by police, and their bikes seized following an alleged dangerous pursuit on the Kwinana Freeway.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">The club is an identified organisation under WA criminal law but their planning application makes clear that their \u2018men\u2019s shed\u2019 proposal is \u201cconsidered to clearly meet the scheme land-use definition of \u2018club premises\u2019.\u201d<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">In its application, prepared by Planning Outcomes WA, the bikie club sought approval to host 60 members or family at the \u2018men\u2019s shed\u2019, with up to 100 guests for occasional events, which would not have been open to the public.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">It proposed operating the club between 8am-10pm Monday to Friday for deliveries, occasional cleaning and set-up, while on weekends, meetings would run from 5.30pm on Fridays to 6pm on Sundays.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">It asked that motorcycle fans will have access to a BYO bar and said the club hoped to apply for a liquor licence in the future.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cThere are not, and will not be, any firearms or firearm safes on the premises,\u201d the Bandidos reassured in the application.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Ahead of the council\u2019s decision, the club had urged council staff to consider their \u201chuman right under international treaty to freedom of association\u201d.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cThere is an understandable tendency at first glance to regard the Bandidos MC as an \u2018outlaw gang\u2019 and therefore planning approval cannot or should not be granted for their clubrooms,\u201d the application says. \u201cHowever, the fact is that the mere existence of the club is not illegal.\u201d<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">The Bandidos said they were willing to meet with neighbours to discuss any proposals outlined in the application.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Local planning and development regulations, which were used to asses the Bandidos application, states a club premises means it is \u201cused by a legally constituted club or association or other body of persons united by a common interest\u201d.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">In its application, the Bandidos MC claimed they were \u201cclearly a body of persons united by a common interest of motorcycles\u201d.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cIf any crimes have been committed, or will in the future (crystal-balling), it is the individuals (not the club) that are investigated by WAPOL (not local government), they have legal rights to procedural fairness, and are presumed innocent until found guilty by a court.\u201d<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">Mr Hall said ahead of the council\u2019s decision last week that his \u201chands might be tied\u201d if the clubhouse met the planning laws.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">He called on the State Government to intervene and update the laws and said the definition of a club premises under planning laws needed to be urgently reviewed.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cWe can\u2019t do this by ourselves. We need a full-court press,\u201d Mr Hall said. \u201cWe are standing up against a national, if not international crime gang. If the planning application complies with the current laws, it is likely to pass.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cYou can\u2019t have WA claiming to have the toughest anti-consorting laws in Australia, but at the same time, allow it to happen behind closed doors. It wasn\u2019t the government\u2019s intent for this to happen, but the door needs to be shut on it.<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">\u201cWe need to use every lever available to us to stop this . . . we need to give these gangs no place to hide.\u201d<\/p>\n<p class=\"css-9cqv6l-StyledPNParagraph e8utp6u0\">The Bandidos \u2018men\u2019s shed\u2019 on Kembla Way first drew the attention of police and council staff last year when community members reports seeing \u201cpatched\u201d members gathering from around Australia near the venue.
