A family involved in an IVF mix-up where a mother gave birth after being implanted with another patient’s embryo is suing Monash IVF for negligence.<\/p>\n

In February 2025, the company became aware that one of the patients in its Brisbane clinic had wrongly been implanted with another patient’s embryo<\/a> in 2023.<\/p>\n

In March this year, Monash IVF said it had reached settlements<\/a> with families involved in the Brisbane mix-up, as well as with families affected by another mix-up at its Clayton clinic in Melbourne, where a woman’s own embryo was incorrectly transferred to her, instead of her partner’s embryo.<\/p>\n

The new legal action, filed in the Supreme Court of Victoria last month, involves a couple who believed their embryos had been provided for the Brisbane mother who gave birth.<\/p>\n

The couple are suing Monash IVF for negligence and breach of contract, claiming they have suffered psychiatric injury, including trauma and grief, as a result of Monash IVF’s mistake.<\/p>\n

In the claims filed to the court, the plaintiffs allege they understood the child was genetically theirs until February 2025, when the couple who gave birth informed them Monash IVF had transferred the embryo of another couple.<\/p>\n

The plaintiffs allege Monash IVF informed them days later of the error.<\/p>\n

The negligence claim includes a list of allegations about how Monash IVF contributed to the error, including failures to develop safe systems to transfer correct embryos and poor record keeping.<\/p>\n

In response to questions from the ABC a Monash IVF spokesperson said the company did not comment on individual cases or matters before the courts.<\/p>\n

When the settlements were reached earlier this year, Monash IVF said it “deeply regret[ted] the events from 2025” and had taken “significant steps” to strengthen its safety culture and oversights.<\/p>\n

“We have also worked closely with the regulator to ensure our systems meet and, where possible, exceed required standards and community expectations,” a Monash IVF spokesperson said at the time.<\/p>\n
