{"id":59347,"date":"2026-07-27T10:30:07","date_gmt":"2026-07-27T10:30:07","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/59347\/"},"modified":"2026-07-27T10:30:07","modified_gmt":"2026-07-27T10:30:07","slug":"industrial-manslaughter-charges-laid-against-adelaide-company-after-2024-workplace-death","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/59347\/","title":{"rendered":"Industrial manslaughter charges laid against Adelaide company after 2024 workplace death"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">An Adelaide manufacturer has been charged with South Australia&#8217;s first case of industrial manslaughter two years after the death of a 28-year-old worker, a workplace safety watchdog says.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Lachlan Carslake died after he was allegedly &#8220;struck in the head by a metal object&#8221; while operating a milling machine at the Nylastex&#8217;s Edwardstown plant on July 24, 2024, according to court documents.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The Director of Public Prosecutions (DPP) filed charges in Adelaide Magistrates Court against Nylastex Tooling Pty Ltd, Nylastex Holdings Pty Ltd and the directors last week.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The charges followed what SafeWork SA described as an &#8220;extensive&#8221; investigation.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Court documents alleged the companies used a number of milling machines, each fitted with an interlock guarding switch designed to prevent the machine operating at a hazardous speed with the guard open.<\/p>\n<p class=\"paragraph_paragraph___QITb\">According to the documents, this switch was allegedly &#8220;in a disabled state&#8221; on the machine Mr Carslake was operating on July 24, 2024.<\/p>\n<p><img decoding=\"async\" alt=\"SafeWork SA sign on a wall.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/07\/f210efb8dd19d15bff5667b5015b2f5c.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">SafeWork SA says the case is the first time the state has filed industrial manslaughter charges. (YouTube: SafeWork SA)<\/p>\n<p class=\"paragraph_paragraph___QITb\">The documents also alleged Mr Carslake &#8220;died as a result of&#8221; being hit by a metal object ejected from the machine while the switch was disabled and a moveable guard was opened.<\/p>\n<p class=\"paragraph_paragraph___QITb\">SafeWork SA said two days prior to Mr Carslake&#8217;s death, an external technician engaged by Nylastex Tooling Pty Ltd had allegedly advised the company of &#8220;safety concerns&#8221; regarding the guarding switch.<\/p>\n<p class=\"paragraph_paragraph___QITb\">SafeWork SA said the companies and its two directors had allegedly &#8220;breached&#8221; their health and safety duty &#8220;by engaging in conduct with gross negligence that caused the death of the worker or were reckless as to the risk of death or serious injury&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">A project manager of the company has also been charged for allegedly engaging in gross negligence or reckless conduct under the Work Health and Safety Act 2012.<\/p>\n<p class=\"paragraph_paragraph___QITb\">They were all expected to appear in court in August.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Industrial manslaughter became a criminal offence in South Australia on July 1, 2024, and carries a maximum penalty of 20 years imprisonment while the maximum fine for a corporate is $18 million.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The company has been contacted for comment.<\/p>\n","protected":false},"excerpt":{"rendered":"An Adelaide manufacturer has been charged with South Australia&#8217;s first case of industrial manslaughter two years after the&hellip;\n","protected":false},"author":2,"featured_media":59348,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[8],"tags":[395,38058,2717,7274,65270,65269,65268,65271,52394],"class_list":["post-59347","post","type-post","status-publish","format-standard","has-post-thumbnail","category-adelaide","tag-adelaide","tag-adelaide-magistrates-court","tag-death","tag-edwardstown","tag-nylastex","tag-nylastex-holdings-pty-ltd-a","tag-nylastex-tooling-pty-ltd","tag-safework","tag-safework-sa"],"_links":{"self":[{"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/posts\/59347","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/comments?post=59347"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/posts\/59347\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/media\/59348"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/media?parent=59347"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/categories?post=59347"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/australia\/wp-json\/wp\/v2\/tags?post=59347"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
