A prison worker is standing trial in South Australia’s District Court charged with the alleged rape of a female prisoner at an Adelaide prison facility.<\/p>\n

Enio Screpanti has pleaded not guilty to the aggravated indecent assault and rape of the woman on separate occasions in the early 2020s.<\/p>\n

Opening the trial on Tuesday, prosecutor Christine Hanna told the jury that both alleged incidents had occurred when Mr Screpanti and the victim had been alone together.<\/p>\n

“On one occasion \u2026 the accused asked [the alleged victim] to accompany him to the gym,” Ms Hanna said.<\/p>\n

“And while they were together alone in the gym the accused asked [the alleged victim] to walk on the treadmill while it was in use so that he could check it.”<\/p>\n

Ms Hanna said it was alleged Mr Screpanti had then sexually assaulted the woman.<\/p>\n

She told the jury the alleged victim was again alone with Mr Screpanti several months later and, on that occasion, he “asked [her] to come to a shed as they had a job to do”.<\/p>\n

Ms Hanna said it was alleged the now 67-year-old then raped her.<\/p>\n

The prosecutor told the jury two prisoners would be called to give evidence about interactions between the alleged victim and Mr Screpanti.<\/p>\n

“There were physical incidents which are not the subject of charges,” Ms Hanna said.<\/p>\n

“[Prisoner] Angie Walsh saw an incident where the accused pinned [the alleged victim] by her arms against a pantry.”<\/p>\n

Ms Hanna told the jury another prisoner, Nicole McGuinness, had seen Mr Screpanti exiting the bathroom where the alleged victim was taking a shower.<\/p>\n

“On the prosecution case that evidence still has a part to play in your (the jury) consideration and deliberations on the charged acts,” Ms Hanna said.<\/p>\n

“That evidence is not introduced into this trial to simply paint the accused in a bad light,” she said.<\/p>\n

“It is introduced to you for a particular reason \u2026 it is evidence, the prosecution say, about the way the accused related to [the alleged victim].<\/p>\n

“It might for example assist you to understand how [the alleged victim] responded to the alleged charged acts.<\/p>\n

“It might also help you to understand that the alleged charged acts did not come out of the blue.”<\/p>\n

Mr Screpanti’s defence lawyer Gilbert Aitken urged the jury to carefully scrutinise the evidence of witnesses.<\/p>\n

“I ask you to keep in mind what a witness actually saw as distinct from what may have been assumed,” he said.<\/p>\n

“Some witnesses, namely prisoners or ex-prisoners may have reason for things like resentment, hostility or indeed self-interest.<\/p>\n

“This, as you’ve heard, is a prison case. The defence says that context matters.”<\/p>\n

Mr Aitken said the jury would also be told about “the loss of CCTV evidence that is no longer available”.<\/p>\n
