A prison maintenance officer directed a female inmate into a shed and ordered her to \u201cpull your pants down\u201d before raping her \u201crepeatedly and forcefully so it hurt\u201d, a court has heard.<\/p>\n
On Tuesday, prosecutors told a District Court jury that Enio Screpanti had also indecently assaulted the same inmate on a separate occasion at the Adelaide Women\u2019s Prison.<\/p>\n
Both offences, they alleged, occurred amid a background of sexual behaviour that gave him \u201cthe confidence\u201d to offend \u2013 a claim disputed by Mr Screpanti.<\/p>\n
His counsel urged jurors to \u201ccarefully\u201d consider how \u201ctalk, chatter, grievance, influence and ignorance can shape or frame\u201d allegations, saying \u201cthis is a prison case\u201d.<\/p>\n
Mr Screpanti, 67, of Hillbank, has pleaded not guilty to one aggravated count of indecent assault and one count of rape.<\/p>\n
Opening the trial, prosecutor Christine Hanna alleged the offences occurred inside the prison in 2020 and 2021.<\/p>\n
The alleged victim, she said, was entitled to work inside the prison and Mr Screpanti was her supervisor when she attended to maintenance jobs.<\/p>\n
\u201cMr Screpanti asked (the woman) to accompany him to the gym to put up a punching bag,\u201d she said.<\/p>\n
\u201cWhile they were together and alone in the gym, he asked her to walk on the treadmill while it was on so he could check it.\u201d<\/p>\n
Ms Hanna alleged Mr Screpanti indecently assaulted the woman as she walked on the treadmill before \u201cmoving his hand away\u201d.<\/p>\n
She alleged the rape occurred on a subsequent occasion after Mr Screpanti directed the woman into a maintenance shed on the prison grounds.<\/p>\n
\u201cHe said \u2018pull your pants down\u2019 to which she initially said no \u2026 he seemed angry with her, which made her afraid, and she did it,\u201d she said.<\/p>\n
\u201cHe had her bend over (and sexually assaulted her) repeatedly and forcefully so it hurt.\u201d<\/p>\n
Ms Hanna asked jurors to consider the \u201cbackground\u201d and \u201ccontext\u201d of interactions between Mr Screpanti and the woman.<\/p>\n
She said those acts and \u201csexual comments\u201d showed the offending \u201cdidn\u2019t come out of the blue\u201d.<\/p>\n
\u201cA prisoner named Angie Walsh saw Mr Screpanti pin (the woman) by her arms against a pantry (in the prison),\u201d she said.<\/p>\n
\u201cA prisoner named Nicole McGuinness saw Mr Screpanti exiting the bathroom of a unit where (the woman) was taking a shower.<\/p>\n
\u201c(Their evidence) might help you understand the way (the woman) responded to the charged offending, and why Mr Screpanti had the confidence to act in the way he did.\u201d<\/p>\n
Gilbert Aitken, for Mr Screpanti, told jurors that prosecutors would be unable to prove their case beyond a reasonable doubt.<\/p>\n
He said CCTV footage relating to the alleged incidents had been \u201clost\u201d and was \u201cno longer available\u201d, and asked jurors to \u201cexamine\u201d the reliability of the witnesses.<\/p>\n
\u201cYou might also think that talk, chatter, grievance, influence or ignorance can shape or frame how allegations are made, discussed and repeated,\u201d he said.<\/p>\n
\u201cThis is a prison case.\u201d<\/p>\n
