{"id":60651,"date":"2026-07-29T05:08:07","date_gmt":"2026-07-29T05:08:07","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/60651\/"},"modified":"2026-07-29T05:08:07","modified_gmt":"2026-07-29T05:08:07","slug":"family-embroiled-in-decades-old-ivf-mix-up-files-lawsuit-against-sydney-hospital","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/60651\/","title":{"rendered":"Family embroiled in decades-old IVF mix-up files lawsuit against Sydney hospital"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">The biological parents of twins who were born after an IVF embryo mix-up at Royal North Shore Hospital in Sydney have launched a civil claim in the NSW Supreme Court against the facility.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Last year, Sasha Szafranski and her twin sister accidentally discovered they had been born to a woman who was not their biological parent, after a mix-up at a fertility clinic within the hospital.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The embryo mix-up occurred in 1995 and the twins were raised by their birth mother without either family being aware of what had occurred.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2026-03-17\/ivf-mix-up-discovered-decades-later-australia\/106362864\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">The mix-up<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">When Sasha Szafranski matched with a stranger on a genealogy website, she uncovered an IVF mix-up that had been hidden for 30 years.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Now the biological parents have taken legal action.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Lawyers acting for Jacqueline and Richard Hensby-Davies, have told the ABC that a statement of claim has been issued against Royal North Shore Hospital.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Our clients were hopeful that a formal apology and compensation could be negotiated without the need for issue of court proceedings,&#8221; Bill Madden and Matilda Lynch of Carroll and O&#8217;Dea Lawyers said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;However, as the matter is complex that could not be achieved and so a statement of claim has now been filed in relation to the IVF error.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">The lawyers added that the provision of care also involved another organisation and &#8220;investigations are continuing as to whether another defendant or defendants should be added to the claim&#8221;.<\/p>\n<p>Family left without answers after discovering embryo mix-up<\/p>\n<p class=\"paragraph_paragraph___QITb\">The embryo mix-up only came to light when Ms Szafranski tried to learn more about her father&#8217;s family by <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-03-17\/ivf-mix-up-discovered-decades-later-australia\/106362864\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/106362864\" rel=\"nofollow noopener\" target=\"_blank\">sending her DNA away for testing through the website Ancestry.com<\/a>.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ms Szafranski told her story to the ABC in March, detailing her confusing DNA results and the eventual match she found with a woman she later learned was her biological aunt.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Further independent DNA testing showed Ms Szafranski and her twin sister were the biological children of Richard and Jacqueline Hensby-Davies, a couple who lived a 15-minute drive away from the childhood home of the twins in Coffs Harbour.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Investigations by the families showed that the Hensby-Davieses and the twins&#8217; birth mother, Penny Szafranski, underwent IVF treatment at Royal North Shore Hospital&#8217;s fertility clinic at the same time in 1995.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ms Szafranski fell pregnant at that time, but Ms Hensby-Davies did not.<\/p>\n<p><img decoding=\"async\" alt=\"Sasha looking emotional\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/07\/e19283667a9c8cf5d083f0bc175dd958.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Sasha Szafranski shared her family&#8217;s story with the ABC in March. (ABC News: Danielle Bonica)<\/p>\n<p class=\"paragraph_paragraph___QITb\">In March, the Northern Sydney Local Health District, which controls Royal North Shore Hospital, said the hospital&#8217;s fertility unit was transferred to a company called North Shore A.R.T in August 1994.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The health district said it &#8220;did not operate the clinic after this time&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">August 1994 was eight months before the mistaken embryo transfer to Penny Szafranski occurred.<\/p>\n<p class=\"paragraph_paragraph___QITb\">North Shore A.R.T no longer exists and was acquired in the early 2000s by another company, which was later acquired by IVF giant Virtus Health.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Earlier this year, a spokesperson for Virtus Health strongly denied it was responsible, saying the incident occurred before the company was established.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;In 1995, Virtus Health did not own or operate any entity associated with this incident,&#8221; the spokesperson said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">That stalemate meant both families were left to deal with a life-changing discovery, without any understanding of how the embryo mix-up occurred.<\/p>\n<p class=\"paragraph_paragraph___QITb\">This case is Australia&#8217;s second-known instance of an IVF embryo mix-up where an embryo was transferred to the wrong family, and one of a series of incidents that has raised broader concerns about regulation in the sector.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Earlier this year, <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-03-05\/monash-ivf-settlement-embryo-bungle\/106419322\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/106419322\" rel=\"nofollow noopener\" target=\"_blank\">fertility giant Monash IVF agreed to pay financial settlements to families involved in two major bungles<\/a> \u2014 including the other known case of a wrong embryo being transferred between families, which occurred in Monash&#8217;s Brisbane clinic in 2023.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The second case involved a woman&#8217;s own embryo being incorrectly transferred to her, instead of her partner&#8217;s embryo, at Monash&#8217;s Melbourne facilities.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Monash is facing further legal action in relation to the Brisbane case from a <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-05-06\/monash-ivf-embryo-mix-up-negligence-claims\/106648704\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/106648704\" rel=\"nofollow noopener\" target=\"_blank\">third couple who believed their embryos had been provided for the Brisbane mother to give birth<\/a>.<\/p>\n<p>Daughter welcomes litigation, hopes it leads to change<\/p>\n<p class=\"paragraph_paragraph___QITb\">Sasha Szafranski is not part of any litigation regarding her case.<\/p>\n<p class=\"paragraph_paragraph___QITb\">She told the ABC she did not want to comment on the case that had been brought by her biological parents, but said she hoped it would lead to change in the IVF sector.<\/p>\n<p>&#8220;What I do hope comes from this is accountability, transparency and meaningful change,&#8221;
