A Melbourne man has lost his bid to work from home full-time after taking his fight to the Fair Work Commission.<\/p>\n
Jonathan Robinson works as a dispute resolution specialist at the Australian Financial Complaints Authority (AFCA), with his role focused on assessing and resolving insurance complaints worth up to $15,000.<\/p>\n
He asked for a permanent work from home arrangement in September 2024 due to care arrangements because his child has ongoing health issues, but his request was refused because AFCA\u2019s policy requires staff to be in the office at least two days per week.<\/p>\n
\u201cThis request would limit his ability to build crucial face-to-face connections, engage with colleagues, and collaborate effectively especially with new team members,\u201d an email from management addressing his request read.<\/p>\n
\u201cIt is essential that he is present in the office to contribute to knowledge-sharing and team cohesion.\u201d<\/p>\n
AFCA proposed a gradual return to the office, starting with once a fortnight then building up to three days, with flexibility around school drop-offs and appointments.<\/p>\n
Fair Work Commission deputy president Andrew Bell said the matters raised by Mr Robinson regarding his personal circumstances in support of his request were \u201cgenuine\u201d but AFCA\u2019s refusal was made on \u201creasonable business grounds\u201d.<\/p>\n
He further found there was no \u201ccapriciousness or arbitrariness\u201d about a policy that mandated two days per week in the office.<\/p>\n
\u201cThere remains vast tracts of the workforce \u2013 largely blue-collar work \u2013 for whom the option to work from home for any period is an impossibility,\u201d he said.<\/p>\n
\u201cEven for other employees for whom many tasks can be performed remotely, a requirement for some in-person attendance at work has long been recognised as a legitimate business need in many (although not all) businesses.\u201d<\/p>\n
