{"id":62949,"date":"2026-08-01T13:00:44","date_gmt":"2026-08-01T13:00:44","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/62949\/"},"modified":"2026-08-01T13:00:44","modified_gmt":"2026-08-01T13:00:44","slug":"magistrate-went-beyond-power-in-suppressing-high-profile-mans-name-court-told","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/62949\/","title":{"rendered":"Magistrate went beyond power in suppressing high-profile man&#8217;s name, court told"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">A judge has reserved his decision on whether to lift a suppression order preventing the identity of a Queensland man at the centre of an alleged extortion threat from being revealed.<\/p>\n<p class=\"paragraph_paragraph___QITb\">A man accused of a domestic violence extortion charge is alleged to have threatened a complainant by saying he would reveal details about an affair she allegedly had with someone who can only be referred to as &#8220;MM&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">MM&#8217;s name has been suppressed by a Cairns court since late May, although he was not the direct target of the alleged threat.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Media organisations, including the ABC, have challenged the suppression order through a judicial review at the Supreme Court in Cairns.<\/p>\n<p><img decoding=\"async\" alt=\"Exterior of Cairns Courthouse building\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/08\/f878efa0e241b9bf672dbe4adc5e128d.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Cairns Courthouse. (ABC News: Mark Rigby)<\/p>\n<p class=\"paragraph_paragraph___QITb\">After a four-hour hearing today, Justice James Henry reserved his decision on whether the order should be varied to allow MM&#8217;s name to be published.<\/p>\n<p>Threat &#8216;never communicated to MM&#8217;<\/p>\n<p class=\"paragraph_paragraph___QITb\">Media outlets have brought the judicial review of the suppression order on the grounds of a &#8220;jurisdictional error&#8221;, the court heard.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Andrew O&#8217;Brien KC, for the media outlets, argued the magistrate did not have the power to make the suppression order, or &#8220;either misapprehended the nature or the limit of the power&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr O&#8217;Brien said there was precedent for complainants and witnesses in blackmail cases to be suppressed to prevent a &#8220;chilling effect&#8221; that discouraged blackmail victims from coming forward.<\/p>\n<p><img decoding=\"async\" alt=\"A man in a suit and tie and glasses walking while carrying documents.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/08\/a888cfc95b77d61ab70787fbebfa2a1c.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Andrew O&#8217;Brien KC argued the magistrate did not have the power to make the suppression order. (ABC Far North: Christopher Testa)<\/p>\n<p class=\"paragraph_paragraph___QITb\">However, he told the court &#8220;no authority we&#8217;ve been able to identify takes it beyond that&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Unless MM has a status of witness or a victim, there has been no extension of the principle of protection,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr O&#8217;Brien told the court the alleged threat &#8220;was never communicated to MM&#8221;.<\/p>\n<p>&#8220;There was no threat ever made against MM \u2014 MM was not the victim of the offence,&#8221;  he said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Nor is MM a witness in the proceeding.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr O&#8217;Brien said the courts had to strike a balance between protecting complainants in extortion cases and allowing matters to proceed in open court.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Consistently, the cases have been limited to suppressing the identity of the complainant and that&#8217;s where the balance has been struck,&#8221; he told the court.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr O&#8217;Brien said the need for a suppression order must be &#8220;established by some evidence or other motivating factor&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">He argued the suppression order in this case went &#8220;beyond the limits of what was necessary&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;The idiosyncratic features of the person aren&#8217;t relevant to the decision you make today,&#8221; he told Justice Henry in submissions.<\/p>\n<p class=\"paragraph_paragraph___QITb\">However, Jonathan Horton KC, appearing for the Queensland Police Service, said the acting magistrate did have evidence before her showing she would find it &#8220;distressing&#8221; for the alleged extortion threat to be revealed.<\/p>\n<p><img decoding=\"async\" alt=\"A man in a blue shirt carrying red ropes over his shoulder\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/08\/1666b04cc692a393edef4d270dc7d623.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Jonathan Horton KC told the court there was evidence the complainant would be &#8220;distressed&#8221; if the man&#8217;s name was published. (ABC Far North: Christopher Testa)<\/p>\n<p>Suppression order became &#8216;Kafkaesque&#8217;<\/p>\n<p class=\"paragraph_paragraph___QITb\">The court heard the non-publication order was also opposed on the grounds of procedural fairness and overreach.<\/p>\n<p class=\"paragraph_paragraph___QITb\">MM&#8217;s name has been suppressed since a hearing on May 29, where the lawyer representing the man charged with extortion applied for a bail variation.<\/p>\n<p class=\"paragraph_paragraph___QITb\">That barrister, Brydie Bilic, told the Supreme Court today she initially asked for the names of her client and the complainant to be blocked from publication.<\/p>\n<p>&#8220;The inference that&#8217;s put against me is the applicant has a strong desire to make the allegation known,&#8221;  she said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;If that were the case, the matter would&#8217;ve simply ended there on that day.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">At the May hearing, Acting Magistrate Meoli requested a police prosecutor be replaced in the courtroom by a more senior police prosecutor, the court heard.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;[The magistrate] was concerned the prosecutor present would not understand what she was consenting to,&#8221; Ms Bilic told the court.<\/p>\n<p class=\"paragraph_paragraph___QITb\">An interim &#8220;blanket&#8221; non-publication order was made, which extended to suppressing the identity of MM.<\/p>\n<p class=\"paragraph_paragraph___QITb\">However, Ms Bilic said &#8220;a Kafkaesque situation evolved&#8221; when the court registry was unable to provide hard copies of the non-publication order &#8220;because Her Honour named MM specifically&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ms Bilic said there was an element of &#8220;potential public interest that might not otherwise be attracted&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;There is a concession that there&#8217;s information that&#8217;s sensational but not inaccurate.&#8221;<\/p>\n<p><img decoding=\"async\" alt=\"A woman wearing a striped jacket walking with her head down.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/08\/300a84fb485c59b480f1984b0f224aa3.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Defence barrister Brydie Bilic outside the Cairns Courthouse.
