A bus driver who struck and killed a woman in the Brisbane CBD more than two years ago has failed to have his conviction overturned.<\/p>\n

Lindsay Francis Selby was found guilty of careless driving causing the death of Tia Cameron by a magistrate last year<\/a>.<\/p>\n

The 18-year-old was pinned against a building by the bus after it mounted the curb during peak hour in March 2024.<\/p>\n

She suffered critical injuries and died at the scene.<\/p>\n

The 72-year-old was given an eight-month sentence which was wholly suspended and was disqualified from driving for a year.<\/p>\n

Last month Selby challenged his conviction in the Brisbane District Court<\/a>.<\/p>\n

On Tuesday Judge Bernard Porter KC dismissed the appeal.<\/p>\n

Selby was ordered to pay $1,800 in legal costs to the Queensland Police Service.<\/p>\n

‘Not paying sufficient attention’<\/p>\n

In a written decision, Judge Porter said he came to the same verdict after considering “the whole of the evidence for myself” and after visiting the crash site in person last week.<\/p>\n

“I agree with the learned Magistrate’s decision to convict the appellant, though by slightly different reasoning,” he said.<\/p>\n

During the summary trial and again during the appeal hearing, the court heard Selby had been turning left into Edward Street and was travelling downhill when he suddenly swerved left again, to avoid banked traffic.<\/p>\n

The magistrate rejected Selby’s arguments that during that first left turn he had been keeping a proper lookout.<\/p>\n

Judge Porter agreed and said he was satisfied beyond a reasonable doubt Selby was “not paying sufficient attention to what was unfolding before him”.<\/p>\n

He said in his view when Selby was first turning left, he “either did not notice or did not consider” the movements of a specific car directly in front of him, which was clearly braking and coming to a stop.<\/p>\n

“He only noticed the peril in the last second, literally, and took the only evasive action available, to turn away,” he said.<\/p>\n

“If he had been driving with due care and attention, he would have either slowed or started braking before, that is at least three seconds before, he had to take evasive action.”<\/p>\n

Selby’s defence team argued during the trial and on appeal that Selby believed he was applying the brakes, despite them never being activated.<\/p>\n

The magistrate rejected this, but Judge Porter said the question of whether he “tried to brake, and inexplicably failed to do so, is moot”.<\/p>\n

“I am not persuaded to find that Mr Selby attempted, ineffectively, to brake, albeit just before he steered [left],” he said.<\/p>\n

“However, nor do I think that his evidence can be rejected.”<\/p>\n

Judge Porter said there were “powerful forensic considerations” from defence and prosecution arguments, but he was ultimately left considering that Selby’s evidence “might be correct”.<\/p>\n
