A socially awkward man who was found with notebooks containing \u201chorrific fantasies of quite extreme violence\u201d will be released from custody.<\/p>\n

The 21-year-old, who cannot be named due to an indefinite suppression order over his identity, appeared in the County Court of Victoria on Tuesday where a judge ruled he should be freed immediately.<\/p>\n

The man first came to the attention of police in February 2024 when the United States\u2019 Federal Bureau of Investigations notified Victoria Police about suspicious activity on Reddit after a tip off from a member of the public.<\/p>\n

\u201cThey don\u2019t know they\u2019re all going to die for bullying me and ignoring me \u2026 this is the day I take my revenge,\u201d the man, then 19, had posted online.<\/p>\n

Crown prosecutor Jordan O\u2019Toole told the court police searched his parents\u2019 home on February 20, locating 500 rounds of ammunition, chemical precursors for explosives and handwritten diaries. <\/p>\n

He said the diaries were found to contain research and plans for homemade explosives, references to chemical and biological agents and \u201creferences to planning and preparation for what appears to be a school shooting\u201d and other acts of mass violence. <\/p>\n

Quoting a section of the diary, Mr O\u2019Toole said the man had written; \u201cthey can\u2019t keep ignoring me, it\u2019s too much to handle\u201d. <\/p>\n

\u201cI need to raise the game up a notch \u2026 chemical and biological agents, even as I\u2019m writing this I feel excited.\u201d<\/p>\n

The prosecutor said police conducted inquiries into the man\u2019s banking history, finding online transactions for the purchase of a tactical vest and precursor chemicals, including a purchase of 250g of potassium nitrate that \u201chas not been located\u201d. <\/p>\n

Police raided the teenager\u2019s home again in September the same year, finding further quantities of chemicals that can be used to make explosives, thermite, tactical gear and ball bearings.<\/p>\n

\u2018This time I will not hold back, I\u2019ve done my research\u2019<\/p>\n

On the man\u2019s mobile phone, Mr O\u2019Toole said they\u2019d found a partially constructed building in the video game Minecraft that bore a \u201cstrong resemblance\u201d to the secondary school he attended before being suspended.<\/p>\n

Under the terms of the suppression order, the name of the school in Melbourne cannot be published. <\/p>\n

\u201cIf society refuses to allow me in then I have to bust that door down with any way possible,\u201d the man had written in a new notebook found by police. <\/p>\n

\u201cI myself will have run out of excuses \u2026 This time I will not hold back, I\u2019ve done my research \u2014 its infallible.\u201d<\/p>\n

The court was told the teenager was taken into custody where he has remained for the past 667 days. <\/p>\n

He returned to court on Tuesday after pleading guilty to two charges of possessing an explosive substance without excuse. <\/p>\n

Called by the man\u2019s defence, consultant forensic clinical psychiatrist Michael Davis gave evidence he\u2019d diagnosed the man with autism-spectrum disorder and schizotypal personality disorder.<\/p>\n

Dr Davis said the man is, and would remain, fixated on chemistry, but there was \u201ccertainly no evidence that strongly indicated this was necessarily going to lead to him massacre people with the use of chemicals\u201d. <\/p>\n

He told the court it was his professional opinion the man\u2019s \u201chorrific fantasies\u201d in his diaries were a form of \u201cself-soothing\u201d his anger and grievance about being unable to form social connections. <\/p>\n

\u201c(He was) Angry and upset at the world for the way he feels he\u2019s been treated throughout the life,\u201d Dr Davis said. <\/p>\n

\u201cWe were far from anything untoward happening in terms of him deliberately trying to hurt anyone.\u201d<\/p>\n

Dr Davis said the man would require significant psychological assistance for years into the future, which the man\u2019s barrister, Glenn Cooper, said had been put in place for his release. <\/p>\n

Prosecutors called for the man to be placed on a community corrections order with required therapeutic treatment and judicial monitoring.
But Judge Douglas Trapnell said the young man had already spent far too long in prison and he did not think it was appropriate to impose additional punishment. <\/p>\n

He said the man\u2019s lawyers had tried \u201ctime and time again\u201d to resolve the case and the Crown had \u201ctaken it out of my control by dithering around\u201d. <\/p>\n

\u201cThis young man has been languishing in protection for 677 days,\u201d he said. <\/p>\n

\u201cThis should have been settled ages ago.\u201d<\/p>\n

Instead he convicted and discharged the man, meaning he will face no other penalty and is expected to be released from custody. <\/p>\n
