{"id":66558,"date":"2026-08-06T15:48:45","date_gmt":"2026-08-06T15:48:45","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/66558\/"},"modified":"2026-08-06T15:48:45","modified_gmt":"2026-08-06T15:48:45","slug":"emma-lovells-killers-reduced-sentence-scrapped-by-high-court-2","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/66558\/","title":{"rendered":"Emma Lovell\u2019s killer\u2019s reduced sentence scrapped by High Court"},"content":{"rendered":"<p>The husband of a British woman who was brutally killed in her front yard has welcomed the High Court\u2019s decision to scrap her killer\u2019s reduced sentence. <\/p>\n<p>Emma Lovell was fatally stabbed in the chest during a burglary of her house at North Lakes in Brisbane\u2019s north on Boxing Day 2022.<\/p>\n<p>Her killer was aged 17 and eight months at the time of the attack. He pleaded guilty in 2024 to armed burglary and murder and was sentenced to 14 years\u2019 jail.<\/p>\n<p>Though the man was required by law to serve 70 per cent of this penalty behind bars, the Queensland Court of Appeal reduced this to 60 per cent after his lawyers argued the original sentence was \u201cmanifestly excessive\u201d.<\/p>\n<p>This decision was unanimously overturned on Wednesday by the High Court. <\/p>\n<p>Ms Lovell\u2019s husband, Lee, with whom she shared two daughters, told reporters in Brisbane the reinstated sentence was \u201csome validation that &#8230; Emma\u2019s life did matter\u201d. <\/p>\n<p>Mr Lovell said he was \u201cglad\u201d the case was done after four years of fighting for justice, and his eldest daughter was \u201cpleased\u201d with the outcome. <\/p>\n<p>He conceded he would have to \u201cmake peace\u201d with the court\u2019s final decision. <\/p>\n<p>\u201cFourteen (years) just didn\u2019t seem like enough for me. And you know to then have that 70 per cent reduced was just heartbreaking, I suppose,\u201d Mr Lovell said. <\/p>\n<p>Under the Youth Justice Act, a person under 18 cannot be detained for more than 10 years unless they face a sentence that would be life imprisonment if they were an adult or a judge finds their offending to be \u201cparticularly heinous\u201d.<\/p>\n<p>The Act also requires a child be released after serving 70 per cent of their sentence. A provision for \u201cspecial circumstances\u201d allows for a reduction of up to a 20 per cent in the default period of detention to be served before release. <\/p>\n<p>Mrs Lovell\u2019s killer\u2019s offending was ruled \u201cheinous\u201d in his original sentencing and despite an early plea of guilty, a \u201cdeprived\u201d upbringing, and remorse, Justice Tom Sullivan did not find any special circumstances to justify reduced prison time. <\/p>\n<p>But in August 2025, the Queensland Court of Appeal found Justice Sullivan \u201cought\u201d to have found the man\u2019s remorse and prospects for rehabilitation established special circumstances. <\/p>\n<p>This triggered a landmark challenge from the Queensland government in the High Court. <\/p>\n<p>In its judgment, the High Court found it was \u201cnot open, in the application of a standard of judicial restraint, for an appellate court to interfere with the sentencing judge\u2019s decision that no special circumstances existed\u201d under the Act.<\/p>\n<p>Queensland Attorney-General Deb Frecklington welcomed the court\u2019s decision, saying she had \u201cpursued all legal avenues\u201d to seek review of the reduced sentence. <\/p>\n<p>\u201c(The decision) will never bring Emma back. It will never give those two girls their mum back. It will never give Lee his wife back,\u201d Ms Frecklington said. <\/p>\n<p>\u201cBut it is a small amount of justice that we\u2019ve been able to deliver.\u201d<\/p>\n<p>Queensland Premier David Crisafulli described the ruling as a \u201cbig win\u201d for the Lovell family but acknowledged that it \u201cwould never be enough\u201d. <\/p>\n<p>\u201cWhilst this still falls well short of what we believe is justice &#8230; in some very small way, (it) preserves the very small amount of justice that the Lovell family deserve,\u201d Mr Crisafulli said.
