<\/p>\nA man accusing Alan Jones of historical indecent assault has told a court he followed the broadcaster’s alleged direction to have a shower and come out in a robe because he did not want to disappoint Mr Jones.<\/p>\n
Complainant J, who alleges Mr Jones indecently assaulted him on nine occasions in 2003 and 2004, has been cross-examined by barrister Gabrielle Bashir about his account of the allegations in the Sydney Local Court trial.<\/p>\n
The Crown and Complainant J said he was 17 at the time of the first alleged assault in 2003, but under cross-examination Complainant J agreed he may have been 18.\u00a0<\/p>\n
The 85-year-old has pleaded not guilty to 20 counts of assault with act of indecency and two counts of sexual touching relating to six alleged victims between 2003 and 2020.<\/p>\n
The complainant, now in his 40s, alleged Mr Jones asked him to wear “a robe and nothing else” during a visit to his Fitzroy Falls property in 2004.<\/p>\n
The date of the trip to Fitzroy Falls is alleged to have happened at some time in 2004, when Complainant J was 18 or 19.<\/p>\n

Mr Jones’s barristers have pushed Complainant J on why he did not stop the alleged behaviour at any point, and why he followed the alleged instruction to wear a robe when he said Mr Jones had assaulted him several times already that day.<\/p>\n
“You must have understood that this was some kind of suggestion of getting ready for sexual activity?” Ms Bashir said.<\/p>\n
“Yes,” Complainant J replied.<\/p>\n
“You could have put your pants back on,” Ms Bashir said.<\/p>\n
“I could have,” Complainant J replied.<\/p>\n
Complainant J told the court he “very fearfully” put his robe on but also put on underwear as “protection,” and went back out to sit on the lounge with Mr Jones.<\/p>\n
Ms Bashir suggested multiple times to Complainant J during cross-examination that he had “concocted” or “fabricated” his story after reading media reports with similar allegations.<\/p>\n
‘I didn’t like when he was disappointed in me’<\/p>\n
Complainant J previously said he received weekly payments from the broadcaster to help with his sporting career, and that he was grateful for the money and did not want it to stop.<\/p>\n
“[Mr Jones] never said he’d pull the money if you didn’t do what he wanted, did he?” Ms Bashir asked.<\/p>\n
“No, but I didn’t like when he was disappointed in me,” Complainant J said.<\/p>\n
“It was not a good time, not a good feeling.”<\/p>\n

The court also heard there were several staff at Fitzroy Farm on the occasion Complainant J visited, but he agreed he did not raise the alarm or tell anyone there about what he alleges Mr Jones had done.<\/p>\n
Complainant J was then taken to allegations he made about an assault in the bedroom, where he says Mr Jones hugged him, kissed him and then moved so that their genitals touched as their robes parted.<\/p>\n
“You would have pushed him off you if he ever tried to do such a thing, wouldn’t you?” Ms Bashir asked.<\/p>\n
“I didn’t,” Complainant J replied.<\/p>\n
“I was very scared.<\/p>\n
“In that room that was as scared as I’ve ever been.”<\/p>\n
The cross-examination has sought to pick apart Complainant J’s account of the allegations, and Ms Bashir has suggested there were inconsistencies between his statement to police and the evidence given in court.<\/p>\n
Complainant J admitted at times that his memory of the events had changed, but told the court he was doing his best to recall alleged events from more than two decades ago.<\/p>\n
Complainant J was also asked whether an earlier comment he made in court referencing Mr Jones’s genitals was to “smear” or “humiliate” him.<\/p>\n
“You wouldn’t know because you’ve never seen Mr Jones’s penis, have you?” Ms Bashir asked.<\/p>\n
“Yes I have,” Complainant J replied.<\/p>\n
The complainant was also pushed on why he did not get up and leave when he alleged Mr Jones sat next to him on the bed and asked him to masturbate together.<\/p>\n
“I was very scared and thought I had to do that to have it all stop,” he said.<\/p>\n
He agreed while he was physically strong and an athlete competing in significant competitions at that the time, he was still “young in the head”.<\/p>\n
Mr Jones’s defence team said none of the allegations made by Complainant J ever happened.<\/p>\n
