{"id":71344,"date":"2026-08-13T18:53:26","date_gmt":"2026-08-13T18:53:26","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/71344\/"},"modified":"2026-08-13T18:53:26","modified_gmt":"2026-08-13T18:53:26","slug":"investigators-misled-man-who-was-tasered-in-mareeba-watch-house-court-told","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/71344\/","title":{"rendered":"Investigators &#8216;misled&#8217; man who was tasered in Mareeba watch house, court told"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">Two police officers charged with assaulting and unlawfully restraining a prisoner in a regional Queensland watch house have asked a court to put an end to criminal proceedings against them.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The District Court in Cairns has heard Charlton Bong, 25, was tasered, cuffed and left alone in a padded cell for about two and a half hours at the Mareeba watch house in Far North Queensland on January 20, 2024.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Senior Constables Andrew David Couchman, 54, and Ulrich Weiss, 45, were investigated by the police Ethical Standards Command over the incident and charged with criminal offences, including assault and deprivation of liberty.<\/p>\n<p class=\"paragraph_paragraph___QITb\">A trial has been listed for next month, however, defence barrister David Jones KC, for Senior Constable Couchman, today argued for a permanent stay of the case.<\/p>\n<p class=\"paragraph_paragraph___QITb\">He acknowledged it would be an &#8220;extraordinary measure&#8221;, but said there was otherwise a risk of the &#8220;trial starting under the shadow of police misconduct&#8221;.<\/p>\n<p>Investigator &#8216;misled&#8217; alleged victim<\/p>\n<p class=\"paragraph_paragraph___QITb\">The officers&#8217; application for a permanent stay of the charges followed a January 2026 committal hearing in which investigating officer Detective Senior Sergeant Kim Cavill conceded she added a line into Mr Bong&#8217;s sworn statement saying he did not consent to the force used against him.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The court has <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-05-06\/queensland-police-officers-contest-charges-watch-house-tasering\/106644960\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/106644960\" rel=\"nofollow noopener\" target=\"_blank\">previously heard Mr Bong could not read or write and had been experiencing mental health issues at the watch house<\/a>.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Jones told the court on Tuesday that Detective Senior Sergeant Cavill &#8220;misled&#8221; Mr Bong.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Even after reading the final paragraph to Mr Bong, Detective Senior Sergeant Cavill said, &#8216;That&#8217;s from my recordings of what you have told me previously,'&#8221; Mr Jones told the court.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;That is a lie. (Supplied: QPS)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Senior Constable Weiss&#8217;s lawyer Calvin Gnech said the &#8220;contamination&#8221; of the case began well before the extra line in Mr Bong&#8217;s statement was typed.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Gnech said Mr Bong&#8217;s &#8220;understanding of the incident has been shaped by the investigating conduct&#8221;, including multiple formal interviews and a pre-trial hearing.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Mr Bong&#8217;s capacity to reset, give independent evidence at trial \u2014 genuinely independent of any of the contaminating influences \u2014 is at best speculative, and at worst, impossible,&#8221; Mr Gnech told the court.<\/p>\n<p>&#8220;That is a prejudice that any accused should not be faced with or have to even overcome when entitled to a fair trial.&#8221;<img decoding=\"async\" alt=\"Man in suit with tie\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/08\/81b713815374bf7ee4a51e87424b9d50.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Calvin Gnech says the case against his client was &#8220;contaminated&#8221; during the investigation. (ABC Far North: Conor Byrne)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Jones said the Ethical Standards Command investigation was neither impartial nor objective, and amounted to &#8220;improper conduct&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;If any unit of the Queensland Police Service should know better, it is that unit,&#8221; he told the court.<\/p>\n<p>Ruling due next week<\/p>\n<p class=\"paragraph_paragraph___QITb\">Crown prosecutor Christian Peters told the court it was a &#8220;false characterisation&#8221; to suggest the investigation was prejudiced.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Peters said Mr Bong was a &#8220;vulnerable Indigenous man in custody at the watch house&#8221; and that the sequence of events was entirely captured on video.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;[Mr Bong] is a person who will come along and be able to give evidence about his recollection of the incidents themselves,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Peters said the &#8220;state of all of the evidence in this matter&#8221; did not give rise to a level of unfairness that would warrant a permanent stay of the charges.<\/p>\n<p><img decoding=\"async\" alt=\"People leaving a courthouse building on a sunny day.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/08\/0bb383fc381074698a7e09c18804999a.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Charlton Bong outside court after giving evidence at an earlier hearing in May.
