{"id":74736,"date":"2026-08-18T09:45:13","date_gmt":"2026-08-18T09:45:13","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/74736\/"},"modified":"2026-08-18T09:45:13","modified_gmt":"2026-08-18T09:45:13","slug":"lawyer-for-rapist-ralph-carr-urges-court-to-halt-case-likening-it-to-that-of-last-man-hanged-in-australia","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/74736\/","title":{"rendered":"Lawyer for rapist Ralph Carr urges court to halt case, likening it to that of last man hanged in Australia"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">Prosecutors say the County Court should get on with sentencing rapist celebrity agent Ralph Carr, after his defence team made a rare legal move to halt the case.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Last month, <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-08-03\/ralph-carr-named-as-melbourne-businessman-guilty-of-rape\/106991074\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/106991074\" rel=\"nofollow noopener\" target=\"_blank\">a jury found Carr guilty of raping a woman at his West Melbourne home three years ago<\/a>, an allegation he denied. (ABC News)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Dann said it was the first time in 35 years he had made such an application, and described the jury verdict as &#8220;the most obvious miscarriage of justice I&#8217;ve ever seen&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Anyone who was in court who saw and heard the complainant give evidence in this trial should be very, very concerned; very, very uncomfortable about the guilty verdicts,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Dann said anyone who was comfortable with the verdicts had &#8220;lost sight of what justice is&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">However, prosecutor Matthew Fisher accused Mr Dann of making a &#8220;political&#8221; and &#8220;emotional&#8221; speech that was inappropriate and questioned whether it was designed to attract media attention.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mr Fisher said the jury was aware of &#8220;issues&#8221; with some aspects of the complainant&#8217;s evidence, but still decided beyond reasonable doubt that she was raped by Carr.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Your honour should not entertain the stay application,&#8221; he said.<\/p>\n<p><img decoding=\"async\" alt=\"A black-and-white image of criminal Ronald Ryan sitting in the back of a car staring straight into the camera.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/08\/6232e833091cda3fb58d8cff30806311.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Ronald Ryan is seen here between two police officers during his murder trial for murder. (ABC Archives)<\/p>\n<p class=\"paragraph_paragraph___QITb\">In calling for a stay of sentence, Mr Dann referenced the cases of Robert Tait and Ronald Ryan, two men sentenced to hanging in Victoria in the 60s.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Tait&#8217;s death sentence was eventually stayed, but Ryan&#8217;s was not, making him the final man to be hanged in Australia.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Judge Gucciardo told Mr Dann his client was not the first person found guilty to proclaim their innocence and said it was not his task to re-assess the evidence considered by the jury.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;What we had was a very conscientious jury who listened to the evidence, who listened to your very complete and, may I say, exceptional cross-examination of the complainant,&#8221; the judge said.<\/p>\n<p>&#8220;The whole process was exactly as it should have been.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">In scenes that resembled a mock appeal, Mr Dann outlined 16 pieces of evidence the defence was challenging, pointing to alleged inconsistencies with the woman&#8217;s account of the night in question and other events.<\/p>\n<p><img decoding=\"async\" alt=\"A digital sketch of a bald man in a grey tracksuit in court.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/08\/1787046313_614_d41d347d72804734b93f556698d1b256.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Ralph Carr appeared in the pre-sentence hearing without his trademark black wig.
