{"id":77596,"date":"2026-08-21T22:33:15","date_gmt":"2026-08-21T22:33:15","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/77596\/"},"modified":"2026-08-21T22:33:15","modified_gmt":"2026-08-21T22:33:15","slug":"gold-coast-council-takes-housing-affordability-ruling-to-high-court-warning-of-statewide-impacts","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/77596\/","title":{"rendered":"Gold Coast council takes housing affordability ruling to High Court, warning of statewide impacts"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">Gold Coast City Council has applied to the High Court for permission to appeal against a ruling that found luxury apartments do not improve housing affordability.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-08-15\/gold-coast-high-rise-approvals-thrown-into-doubt\/107032372\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/107032372\" rel=\"nofollow noopener\" target=\"_blank\">Queensland Court of Appeal ruled in July<\/a> that council could not justify its approval of a luxury beach-side tower well above the area&#8217;s height limit, on the basis that it would improve &#8220;housing choice and affordability&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">In documents lodged with the High Court this week, the council argued the Court of Appeal&#8217;s ruling &#8220;will cause significant disruption to existing approvals&#8221; not only on the Gold Coast, but across Queensland.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;It would not be economically sensible or efficient to provide affordable housing in a beachfront development because the price of any dwelling in that location would not meet the definition of affordable housing,&#8221; council&#8217;s submission to the High Court stated.<\/p>\n<p class=\"paragraph_paragraph___QITb\">A spokesperson for Gold Coast City Council declined to comment.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;It would be inappropriate to comment on matters before the court,&#8221; the spokesperson said.<\/p>\n<p>Luxury gets &#8216;affordability&#8217; exemption<\/p>\n<p class=\"paragraph_paragraph___QITb\">Under council&#8217;s planning scheme, developers can build up to 50 per cent above an area&#8217;s height limit if a project meets certain criteria ranging from improved amenity to benefits for &#8220;housing choice and affordability&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">In 2023, developer Cielo Property Group applied to build a luxury high-rise in Bilinga, 10-metres above the suburb&#8217;s height-limit.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Court documents show the 34-metre high development was also 121 per cent above the area&#8217;s prescribed density limit.<\/p>\n<p><img decoding=\"async\" alt=\"a patch of dirt surrounded by fences\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/08\/44f950897e839b71443750a73ff5a0b8.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">The site of the luxury high-rise at 90-92 Pacific Parade, Bilinga, challenged in court. (ABC Gold Coast: Dominic Cansdale)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Council approved the development partly on the basis that it would benefit &#8220;housing choice and affordability&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Nearby residents appealed against the approval in the Planning and Environment Court but lost.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The Planning and Environment Court noted that, while the &#8220;very expensive apartments&#8221; would not provide affordable housing for low-to-middle income earners, it would &#8220;contribute to housing affordability through the provision of additional housing stock&#8221;, helping to &#8220;alleviate pressures on supply&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But in its judgment last month, the Court of Appeal found luxury apartments designed for the &#8220;more affluent market&#8221; could not be considered a benefit to housing affordability.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;To do so would be a distortion of the ordinary meaning of affordability,&#8221; Justice Shane Doyle stated.<\/p>\n<p>Affordable vs affordability<\/p>\n<p class=\"paragraph_paragraph___QITb\">Under state planning policies, &#8220;affordable housing&#8221; is defined as housing where low-to-middle-income households spend no more than 30 per cent of their income on housing costs.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But council&#8217;s planning scheme, which operates under those policies, does not directly define &#8220;housing choice and affordability&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">In its High Court submission, council argued the Court of Appeal interpreted &#8220;housing choice and affordability&#8221; too narrowly by equating it with &#8220;affordable housing&#8221;.<\/p>\n<p><img decoding=\"async\" alt=\"sing with the word 'greed' spraypainted over it\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/08\/23fef7c5c0a4e7daee36f1c7d1fe67ae.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">There&#8217;s been some community opposition to higher-density developments on the southern Gold Coast.
