{"id":8199,"date":"2026-05-09T22:04:11","date_gmt":"2026-05-09T22:04:11","guid":{"rendered":"https:\/\/www.europesays.com\/australia\/8199\/"},"modified":"2026-05-09T22:04:11","modified_gmt":"2026-05-09T22:04:11","slug":"chris-minns-staffers-legal-win-chipping-away-at-democracy","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/australia\/8199\/","title":{"rendered":"Chris Minns staffer&#8217;s legal win &#8216;chipping away&#8217; at democracy"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">In a sign of the deteriorating relationship between the Minns government and the house of parliament that keeps it in check, the premier faced an extraordinary question this week.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Would Chris Minns revive the attempts of past Labor premiers to abolish the Legislative Council\uff1f<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;No,&#8221; the premier said with a laugh on Thursday.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Jack Lang tried twice in the 1920s and 1930s. Bob Heffron took it to a referendum in 1961 and lost.\u00a0<\/p>\n<p>&#8220;Look, it&#8217;s a democratic chamber. But democratic chambers are answerable to the public,&#8221;  Minns said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">This week, that democratic chamber voted to suspend its Labor leader, Penny Sharpe, and censure her deputy, John Graham.<\/p>\n<p class=\"paragraph_paragraph___QITb\">It was to protest the government&#8217;s refusal to comply with the upper house&#8217;s orders to produce certain documents for scrutiny.<\/p>\n<p><img decoding=\"async\" alt=\"Woman in a red shirt and black jacket and glasses with red frames.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/05\/d6bca7cfc55096b4adee745e19a009a0.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Sharpe has been suspended from the upper house. (Supplied)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Since the decision, which is <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-01-16\/nsw-mps-back-challenge-ruling-forcing-witnesses-front-inquiries\/106238374\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/106238374\" rel=\"nofollow noopener\" target=\"_blank\">being appealed to the High Court<\/a>, more witnesses are declining to appear at inquiries.<\/p>\n<p class=\"paragraph_paragraph___QITb\">In March, a contractor <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-03-13\/witness-cites-court-win-for-no-show-nsw-inquiry-\/106452662\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/106452662\" rel=\"nofollow noopener\" target=\"_blank\">cited the case in his refusal to attend an inquiry<\/a> into a hospital plagued with safety issues.\u00a0<\/p>\n<p class=\"paragraph_paragraph___QITb\">Last week, three witnesses failed\u00a0to attend an inquiry into a scandal involving the Director of Public Prosecutions. Parliamentary staff strongly suspect the ruling influenced their decision.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Lynn Lovelock, the clerk of the Legislative Council from 2007 to 2011, wrote the textbook on the upper house.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;What happened with the Cullen case I think has started down a path that could lead to some very serious unintended consequences in the role of what the parliament does,&#8221; Lovelock told the ABC.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;What we&#8217;ve effectively done is taken away the right of the people to have access to information.<\/p>\n<p>&#8220;This is actually chipping away at the foundations of democracy. It&#8217;s affecting the people.&#8221;&#8216;This is a political chamber&#8217;<\/p>\n<p class=\"paragraph_paragraph___QITb\">At a press conference on Wednesday, Sharpe appeared at odds with her boss over whether the parliament should have the power to force attendance.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;The fact that that&#8217;s been thrown out and it&#8217;s now been undermined by the court case is not great,&#8221; Sharpe said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;The situation we&#8217;re in is as a result of the imprudent action of others.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">Moments later, the premier confirmed that as a matter of principle he did not believe the parliament should have such powers.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;No, politicians shouldn&#8217;t have the right to arrest people,&#8221; Minns said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;This is a political chamber.&#8221;<\/p>\n<p><img decoding=\"async\" alt=\"nsw premier chris minns talks to the  media as penney sharpe minister for environment stands to the side\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/australia\/wp-content\/uploads\/2026\/05\/b1c70e177392adb383919a2a85a5e2ad.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Chris Minns and Penny Sharpe appeared to be at odds over parliament&#8217;s power to force attendance. It has worked with the Greens and crossbench to tack the provisions onto non-urgent pieces of legislation to send a message.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But the premier, who has <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2025-06-27\/nsw-minns-staffers-politics-dural-caravan-inquiry\/105467780\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/105467780\" rel=\"nofollow noopener\" target=\"_blank\">previously likened a committee to a &#8220;star chamber&#8221;<\/a> and &#8220;kangaroo court&#8221;, made it clear he has no plans to reinstate the powers.\u00a0<\/p>\n<p>&#8220;I think you&#8217;d be going down a really bad route if all of a sudden [independent MLC] Mark Latham wakes up one morning and says, &#8216;You know what? (Supplied)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Lovelock said the power was never questioned before because committees were cautious about its use.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;If we feel that we&#8217;re going to hit a block where somebody&#8217;s going to deny our powers, we have to decide whether this is a rock we want to die on or not,&#8221; she said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;That works really well if you have reasonable people working on that. I&#8217;m not saying we have people who aren&#8217;t reasonable.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;But you do have a situation where people can be motivated by reasons other than upholding the powers and privileges of the parliament.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;It can be for party political reasons. And it can be for personal reasons.&#8221;<\/p>\n<p>&#8216;If you&#8217;ve got nothing to hide you don&#8217;t mind being questioned&#8217;<\/p>\n<p class=\"paragraph_paragraph___QITb\">Among the upper house inquiries underway is a probe into claims Minns conspired to funnel illegal donations into Labor coffers a decade ago. He strenuously denies any wrongdoing.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2026-05-07\/election-watchdog-reopen-sunny-seafood-chris-minns-investigation\/106653260\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Electoral commission reopens investigation into Minns allegations<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">The NSW election watchdog has quietly re-opened an investigation into explosive allegations that NSW Premier Chris Minns conspired to evade state donations laws.<\/p>\n<p class=\"paragraph_paragraph___QITb\">As the ABC reported on Thursday, the NSW Electoral Commission only reopened an investigation into the claims after a parliamentary inquiry received the allegation in November.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Greens MLC Abigail Boyd, who chairs that committee, believes Minns is worried about what her inquiry might uncover if it had the power to force attendance.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Whilst ministers in the lower house, where Minns sits, cannot be compelled to appear, their staff can.<\/p>\n<p>&#8220;If you&#8217;ve got nothing to hide then you don&#8217;t mind being questioned about things,&#8221;  Boyd said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Last year she ran an <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2025-09-23\/nsw-childcare-inquiry-ceo-questioned-over-bonuses\/105805562\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/105805562\" rel=\"nofollow noopener\" target=\"_blank\">inquiry into childcare<\/a> exposing numerous safety failures.
