Mossadek Ageli, gestionnaire immobilier pendant plusieurs d\u00e9cennies dans l\u2019entreprise britannique Sabtina, a obtenu le versement de 392.000 livres sterling, soit pr\u00e8s de 450.000 euros, pour 827 jours de cong\u00e9 non pris, <a href=\"https:\/\/www.telegraph.co.uk\/news\/2026\/04\/10\/worker-wins-400k-in-unused-holiday-pay\/\" target=\"_blank\" class=\"c-link c-link--is-underlined\" rel=\"nofollow noopener\">rapporte le journal britannique The Telegraph<\/a>.<\/p>\n<p>La raison de ce travail continu pendant vingt-cinq ans\u00a0? L\u2019employ\u00e9 \u00e9tait le seul, avec son assistant, \u00e0 travailler \u00e0 temps plein dans l\u2019entreprise et sa pr\u00e9sence \u00e9tait essentielle \u00e0 son bon fonctionnement. Entre\u00a01987, quand il a rejoint la soci\u00e9t\u00e9, et 1996, 200 jours de cong\u00e9 lui ont ainsi \u00e9t\u00e9 refus\u00e9s.<\/p>\n<p>Un licenciement et tout bascule<\/p>\n<p>En\u00a01998, quand il a compris qu\u2019il ne pourrait pas prendre de vacances, sa soci\u00e9t\u00e9 et lui se sont mis d\u2019accord pour que ses jours non pris lui soient <a href=\"https:\/\/www.20minutes.fr\/vie-pro\/4200251-20260207-salaires-risques-reels-salarie-versement-indu\" target=\"_blank\" class=\"c-link c-link--is-underlined\" rel=\"nofollow noopener\">pay\u00e9s<\/a>. Il a ainsi \u00e9t\u00e9 pay\u00e9 deux fois 15.000 livres, soit 17.200 euros environ, en\u00a02001 et\u00a02004. Mais il n\u2019a re\u00e7u aucun autre paiement.<\/p>\n<p>C\u2019est en\u00a02022, apr\u00e8s son <a href=\"https:\/\/www.20minutes.fr\/arts-stars\/medias\/4216341-20260402-giulia-fois-licenciee-cause-reelle-journaliste-reclame-300-000-euros-radio-france-prud-hommes\" target=\"_blank\" class=\"c-link c-link--is-underlined\" rel=\"nofollow noopener\">licenciement <\/a>pour faute grave, lors du changement du conseil d\u2019administration, que la situation \u00e9volue. A cette date, 827 jours de cong\u00e9 ne lui avaient toujours pas \u00e9t\u00e9 pay\u00e9s et l\u2019entreprise l\u2019a inform\u00e9 qu\u2019elle ne le paierait pas.<\/p>\n<p>Mossadek Ageli a attaqu\u00e9 sa soci\u00e9t\u00e9 devant les tribunaux, qui ont estim\u00e9 qu\u2019il avait \u00e9t\u00e9 \u00ab\u00a0maltrait\u00e9\u00a0\u00bb \u00e0 cause de la \u00ab\u00a0retenue de ses paiements\u00a0\u00bb et ordonn\u00e9 son indemnisation. Il a \u00e9galement per\u00e7u 105.000 livres (120.000 euros environ) pour son licenciement abusif, le juge estimant que la proc\u00e9dure avait \u00e9t\u00e9 entach\u00e9e de nombreux probl\u00e8mes.<\/p>\n","protected":false},"excerpt":{"rendered":"Vingt-cinq ans sans vacances, \u00e7a se paye (litt\u00e9ralement).
