{"id":107716,"date":"2026-08-20T20:31:18","date_gmt":"2026-08-20T20:31:18","guid":{"rendered":"https:\/\/www.europesays.com\/britain\/107716\/"},"modified":"2026-08-20T20:31:18","modified_gmt":"2026-08-20T20:31:18","slug":"social-housing-tenants-facing-homelessness-after-london-council-blunder-saw-homes-sold-for-private-rent","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/britain\/107716\/","title":{"rendered":"Social housing tenants facing homelessness after London council &#8216;blunder&#8217; saw homes sold for private rent"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.europesays.com\/britain\/wp-content\/uploads\/2026\/08\/newsletter_we_final_embed_desktop.png\" alt=\"WEST END FINAL\" width=\"175\" height=\"192\" class=\"sc-bIaHMm clJOzG\"\/><\/p>\n<p>Social <a href=\"https:\/\/www.standard.co.uk\/topic\/housing\" rel=\"nofollow noopener\" target=\"_blank\">housing<\/a> tenants living in a block of flats in central London are facing <a href=\"https:\/\/www.standard.co.uk\/topic\/homelessness\" rel=\"nofollow noopener\" target=\"_blank\">homelessness<\/a> because a council \u201cblunder\u201d has seen them sold off for private rent.<\/p>\n<p><a href=\"https:\/\/www.standard.co.uk\/topic\/housing-association\" rel=\"nofollow noopener\" target=\"_blank\">Housing association<\/a> residents living in Gem House, Marylebone, said their new private <a href=\"https:\/\/www.standard.co.uk\/topic\/landlord\" rel=\"nofollow noopener\" target=\"_blank\">landlord<\/a> has asked them to pay rents up to eight times higher than their current rate \u2014 or pack up and leave.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.europesays.com\/britain\/wp-content\/uploads\/2026\/08\/Councillor-Concia-Albert.jpeg\" width=\"904\" height=\"548\" alt=\"&lt;p&gt;Councillor Concia Albert&lt;\/p&gt;\" class=\"sc-dkPvMp YXmIZ\"\/><\/p>\n<p>Labour Councillor Concia Albert has criticised Tory-run Westminster council over the situation<\/p>\n<p>Westminster Labour \/ LDRS<\/p>\n<p>The 16 flats were sold to Gem House Limited due to a legal loophole within the council\u2019s original agreement with the site developer. <a href=\"https:\/\/www.standard.co.uk\/topic\/westminster-city-council\" rel=\"nofollow noopener\" target=\"_blank\">Westminster City Council<\/a> launched a legal claim to try and stop the new landlord from converting the social <a href=\"https:\/\/www.standard.co.uk\/topic\/homes\" rel=\"nofollow noopener\" target=\"_blank\">homes<\/a> to private rentals.<\/p>\n<p>Earlier this month, the <a href=\"https:\/\/www.standard.co.uk\/topic\/court-of-appeal\" rel=\"nofollow noopener\" target=\"_blank\">Court of Appeal<\/a> rejected the council\u2019s bid which means the new landlord can now let the <a href=\"https:\/\/www.standard.co.uk\/topic\/properties\" rel=\"nofollow noopener\" target=\"_blank\">properties<\/a> out at market rates, which for Marylebone are eye-watering.<\/p>\n<p>Westminster City Council has told the tenants, many of whom have already spent years in temporary accommodation, that they must make a new homelessness application in order to be rehoused by the local authority.<\/p>\n<p>Many of the families and residents still have no idea where they will be living at the end of summer, despite being told previously their homes were secure permanent affordable accommodation and are blaming the council for the \u201cblunder\u201d that left them in this position.<a href=\"https:\/\/www.standard.co.uk\/news\/london\/london-council-affordable-housing-high-court-b1241735.html\" rel=\"nofollow noopener\" target=\"_blank\"><\/p>\n<p>\u2018We don\u2019t know where we are going\u2019<\/p>\n<p>Mr and Mrs Banjak, who live in Gem House with their three children, claim they have been asked to pay \u00a36,850 per month \u2014 more than eight times higher than their current social rent of \u00a3793.<\/p>\n<p>Unable to pay, the family is now set to be evicted at the end of August pending a legal case.<\/p>\n<p>The council has asked them to make a homelessness application which they say means they may not find out where they are moving until a few days before the eviction date.<\/p>\n<p>\u201cIt\u2019s very, very horrible, especially because we don\u2019t know where we are going. For example, if they had time to tell us the address, we could move in peace. But, we are just waiting. We don\u2019t know where we are going.\u201d<\/p>\n<p>The 16 flats were sold to Gem House Limited due to a legal loophole within the council\u2019s original agreement with the site developer. You can\u2019t show them the schools they\u2019ll be going to\u2014you don\u2019t know. You can\u2019t say, \u2018Oh, we\u2019re not that far from your friends,\u2019 because you have no idea,\u201d she said.<\/p>\n<p>Mr Banjak said he believes that the council should make his family a direct housing offer rather than forcing them to go through the homeless system again. The former Transport for London bus driver was placed into temporary accommodation after he was forced to stop work due to a stroke.<\/p>\n<p>After marrying Mrs Banjak, the family moved into a one-bedroom temporary home in Westminster. They spent 12 years at this property, with all three of their children born there.<\/p>\n<p>The family was finally moved into what they thought would be their \u201cforever home\u201d in 2019.<\/p>\n<p>\u201c<a href=\"https:\/\/www.standard.co.uk\/topic\/westminster-council\" rel=\"nofollow noopener\" target=\"_blank\">Westminster Council<\/a> has to play a more important role in supporting and assuring the tenants,\u201d said Mr Banjak.<\/p>\n<p>\u201cThe council has to do it more flexibly, not [making us] start from the very beginning to do another application, another load of papers to be uploaded for them. The 60-year-old father is disabled and relies on a relative who lives nearby to help with his care needs.<\/p>\n<p>\u201cWe\u2019re worried about becoming homeless,\u201d he said, adding: \u201cI thought this was my dream home \u2013 my home for life.\u201d<\/p>\n<p>His son, who is studying at university, said that the uncertainty has greatly affected his studies.<\/p>\n<p>\u201cIt\u2019s a game and we are in the middle of the cross fire,\u201d he said.<\/p>\n<p>Another tenant, who has asked to remain anonymous, said the experience has been \u201cquite traumatising\u201d.<\/p>\n<p>Like the other householders, her family has been told that they must now make a homelessness application in order to be rehoused.<\/p>\n<p>\u201cWe have been living around two years in total instability,\u201d she said. \u201cWe don\u2019t know if we are staying or going.\u201d<\/p>\n<p>\u2018The council needs to take responsibility\u2019<\/p>\n<p>When the development was first completed, Westminster City Council required the 16 affected houses at Chiltern Street to be kept as affordable accommodation.<\/p>\n<p>In 2023, the then-owner of the properties, Kinsman, was deregistered as a social housing provider, on the basis that it had breached the Governance and Financial Viability Standard.<\/p>\n<p>Kinsman was declared bankrupt and its mortgagee decided to sell the homes to Gem Properties Limited for \u00a312.6million.<\/p>\n<p>Councillor Concia Albert, Labour\u2019s Shadow Cabinet Member for Housing Services, said: \u201cThe people living here are not private tenants who found their homes on the open market. They were placed in these flats by Westminster Council on the understanding that these were affordable homes.<\/p>\n<p>\u201cWestminster Conservatives must now take responsibility for the consequences of their own contract and ensure every affected resident is rehoused promptly in suitable, secure accommodation within the borough. These people did everything that was asked of them and should not lose their homes because of a mistake that had nothing to do with them.\u201d<\/p>\n<p>In a statement to the LDRS, Westminster City Council did not commit to providing direct offers to affected residents. A spokesperson said: \u201cWestminster faces significant demand for affordable home and there are more than 6,500 households currently on the housing register.
